About approval of the Technical regulation of the equipment working under pressure

(as amended on 08-09-2021)

According to article 5 of the Law of Ukraine "About technical regulations and assessment of conformity" the Cabinet of Ministers of Ukraine decides:

1. Approve the Technical regulation of the equipment working under pressure which is attached.

2. To provide to the ministry of development of economy, trade and agricultural industry implementation of the Technical regulation approved by this resolution.

3. Determine that provision in the market and/or commissioning of the equipment working under pressure which conforms to requirements of the Technical regulation of safety of the equipment working under pressure, approved by the resolution of the Cabinet of Ministers of Ukraine of January 19, 2011 No. 35 (The Official Bulletin of Ukraine, 2011, No. 5, of the Art. 246) and is introduced into circulation before entry into force of this resolution, it cannot be forbidden or limited because of such discrepancy of the equipment to requirements of the Technical regulation approved by this resolution.

4. Bring in Item 11 of the list of types of products by which bodies of the state market supervision exercise the state market supervision of the Cabinet of Ministers of Ukraine approved by the resolution of December 28, 2016 No. 1069 (The Official Bulletin of Ukraine, 2017, No. 50, the Art. 1550), change which is applied.

5. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

6. This resolution becomes effective in 12 months from the date of its publication.

The technical regulation of the equipment working under pressure

General part

1. This Technical regulation determines requirements concerning designing, production and evaluating compliance of the equipment working under pressure and aggregates with the maximum allowable pressure (PS) of more 0,5 of bar. The technical regulation is developed for the purpose of implementation of provisions of the Directive 2014/68/EU of the European Parliament and Council of May 15, 2014 about harmonization of the legislation of state members concerning provision in the market of the equipment working under pressure.

2. Requirements of this Technical regulation do not extend on:

1) pipelines and systems of pipelines for transportation of working environment or substances to installations (coastal or port), including to the last blocking installation device, including all auxiliary devices designed especially for such pipeline except the standard equipment working under pressure, in particular that which can be used at the stations regulating pressure or compressor stations;

2) networks of water supply, distribution and water disposal, and also the related equipment and the bringing conduits, such as pressure head pipes, pressure head mines, pressure head tunnels on hydropower stations and devices, related;

3) the simple vessels working under pressure, falling under action of the Technical regulation of simple vessels of the high pressure approved by the resolution of the Cabinet of Ministers of Ukraine of December 28, 2016 No. 1025 (The Official Bulletin of Ukraine, 2017, No. 4, the Art. 130);

4) aerosol sprays;

5) the equipment intended for functioning of vehicles which falls under action of one of the following documents:

Approval procedure of design of vehicles, their parts and the equipment approved by the order of the Ministry of Infrastructure of August 17, 2012 No. 521;

The technical regulation of the approval like agricultural and forestry and landscape tractors, their trail cars and replaceable trailing machines, systems, components and separate technical nodes approved by the resolution of the Cabinet of Ministers of Ukraine of December 28, 2011 No. 1367 (The Official Bulletin of Ukraine, 2012, No. 1, the Art. 22);

The technical regulation concerning components and characteristics of wheel agricultural and forestry and landscape tractors approved by the resolution of the Cabinet of Ministers of Ukraine of December 28, 2011 No. 1368 (The Official Bulletin of Ukraine, 2012, No. 1, the Art. 23);

6) the equipment which belongs to the category not above category I according to Items 42, 43 presents of the Technical regulation which falls under action of one of the following technical regulations:

The technical regulation of the devices using gaseous fuel, the Cabinet of Ministers of Ukraine approved by the resolution of July 4, 2018 as No. 814 (The Official Bulletin of Ukraine, 2018, No. 80, the Art. 2659);

The technical regulation of safety of machines approved by the resolution of the Cabinet of Ministers of Ukraine of January 30, 2013 No. 62 (The Official Bulletin of Ukraine, 2013, No. 9, the Art. 344);

The technical regulation of rather medical products approved by the resolution of the Cabinet of Ministers of Ukraine of October 2, 2013 No. 753 (The Official Bulletin of Ukraine, 2013, No. 82, the Art. 3046);

The technical regulation of the low-voltage electric equipment approved by the resolution of the Cabinet of Ministers of Ukraine of December 16, 2015 No. 1067 (The Official Bulletin of Ukraine, 2015, No. 102, the Art. 3526);

The technical regulation of the equipment and protective systems, held for use in potentially explosive environments, the Cabinet of Ministers of Ukraine approved by the resolution of December 28, 2016 No. 1055 (The Official Bulletin of Ukraine, 2017, No. 8, the Art. 236);

The technical regulation of elevators and components of safety of elevators approved by the resolution of the Cabinet of Ministers of Ukraine of June 21, 2017 No. 438 (The Official Bulletin of Ukraine, 2017, No. 54, the Art. 1631);

7) the equipment intended only for the military purposes;

8) the equipment which is specially designed for application in the field of the nuclear equipment and which defect can lead to release of radioactivity;

9) the equipment for control of wells which is used for oil, gas and geothermal investigation and mining industry, and also in the underground storage warehouses intended for maintenance or regulation of pressure level in wells including gushing armature of oil wells, the protivovybrosovy equipment, pipelines and distributive systems, and also the related devices;

10) the equipment containing covers and details of machines for which the sizes, the choice of material and design are determined first of all by requirements of sufficient durability, stability and resistance to static and dynamic production impacts or other criteria connected with production for which pressure is not essential factor. It is possible to carry to such devices:

engines, including turbines and internal combustion engines;

steam-engines, gas and steam turbines, turbogenerators, compressors, pumps, actuating units;

11) blast furnaces, including cooling system, recuperative air heaters, separators of dust, the device for purification of grid-iron gas, the furnace of mine type with chilling, gas exchange devices and reservoirs for melting, melting, removal of gases and pouring of steel, iron and non-ferrous metals;

12) covers for the high-voltage electric equipment, in particular switches, control and control devices, transformers and machines with parts which rotate;

13) the covers and casings working under pressure, intended for protection of systems of transfer, detail of electric and telephone cables;

14) vessels, rockets, planes and mobile sea aggregates and devices which are specially intended for installation onboard for its movement;

15) the equipment working under pressure, consisting of elastic cover, in particular the pneumatic tires, airbags, balls used for game, inflatable boats and other similar equipment working under pressure;

16) final and inlet mufflers;

17) bottles and banks of the drinks saturated with carbonic acid for final consumption;

18) vessels for transportation and sale of drinks which have work PS on V is made by less than 500 bars on liter and the maximum allowable pressure does not exceed 7 bars;

19) the movable equipment working under pressure which is used only for transportation of dangerous goods between Ukraine and the third countries automobile, railway or inland waterways according to requirements of the European agreement on international delivery of dangerous goods inland waterways which Ukraine joined according to the Law of Ukraine of November 17, 2009 No. 1727-VI, the European Agreement on the international road delivery of dangerous goods (DOPOG) which Ukraine joined according to the Law of Ukraine of March 2, 2000 No. 1511-III, appendix C to the Convention on the international rail haulings (KOTIF) which Ukraine joined according to the Law of Ukraine of June 5, 2003 No. 943-IV if other is not provided in appendices to the specified Agreements;

20) radiators and pipes in water heating systems;

21) vessels for liquids with the gas pressure of no more 0,5 of bar.

3. In this Technical regulation terms are used in such value:

1) the aggregate - the integrated and functional design united by the producer consisting from several units of equipment, working under pressure;

2) commissioning - use of the equipment working under pressure or the aggregate on their appointment as the consumer (user) in Ukraine for the first time;

3) issuance - provision of the equipment working under pressure or aggregates in the market of Ukraine for the first time;

4) retirement - measure for prevention of provision in the market of the equipment working under pressure or the aggregates which are in supply chain of such equipment;

5) producer - physical person or legal entity (the resident or the nonresident of Ukraine) which makes the equipment working under pressure or the aggregate or charges its development or production and realizes them under the name or trademark (sign for goods and services);

6) safety devices - the devices intended for protection of the equipment working under pressure in case of excess of admissible parameters including devices for direct restriction of pressure, including safety valves, explosive membranes, flexible cores, the managed systems of emergency pressure release and restrictive devices which the action put correcting devices in action or cause shutdown or cutting off, such as switches of pressure, temperature or level of working environment, and also means of the measuring equipment and control devices;

7) mark of conformity to technical regulations - marking by means of which the manufacturer specifies that the equipment working under pressure, or the aggregate meet the requirements which are applied to them and are determined in technical regulations which provide drawing such marking;

8) the importer - physical or legal resident person of Ukraine who introduces into market circulation of Ukraine the equipment working under pressure or aggregates from other country;

9) the maximum allowable pressure (PS) - the maximum excessive pressure which the equipment or determined by the producer for certain place of the equipment is expected by the producer it can be connection of safety and/or restrictive devices, the highest point the equipment or other place determined by the producer;

10) the minimum/maximum admissible temperature (T Ѕ) - the minimum/maximum temperature determined by the producer which the equipment working under pressure is expected;

11) provision in the market - paid or free delivery of the equipment working under pressure or aggregates for distribution, consumption or use in the market of Ukraine in the course of implementation of economic activity;

12) one-piece connections - connections which can be diconnected only by the methods including destruction;

13) the nominal diameter (DN) - digital designation of the size which is applied to all elements which are logging in the pipeline except parts which designate on the outer diameter or parameters of cutting;

This rounded value which is used as reference parameter and corresponds to the amount of production. It is designated by the letters DN after which specify figures;

14) No. 938 Is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 08.09.2021

15) amount (V) - the internal capacity of the camera, including capacity of branch pipes to the first entering connection, without reservoir of the built-in internal details;

16) the equipment working under pressure - the vessels, pipelines, safety devices and devices working under pressure including where it is applicable, the elements attached to details under pressure such as flanges, nozzles, couplings, support, loops for rise;

17) conformity assessment body - the company, organization, the organization or their structural division performing activities for assessment of conformity, including testing, calibrations, certification and inspection;

18) assessment of conformity - process of the proof that the essential requirements for safety concerning the equipment working under pressure or aggregates were executed.

Assessment of conformity of body is carried out by accreditation of conformity assessment bodies;

19) vessel - the sealed container designed and made for placement of working environment under pressure including additional devices to it, to point of connection with other equipment; one reservoir can turn on several cameras;

20) the devices working under pressure - devices with operational function which have the case which pressure affects;

21) working environment - gas, liquid or vapor in pure form or in the form of their mix.

The working environment may contain suspension of solid substances;

22) the distributor - other, than the producer or the importer, physical person or legal entity in supply chain of the equipment working under pressure or aggregates which provides such equipment in the market of Ukraine;

23) approval on use of materials - the technical document in which characteristics of the material intended for reuse during production of the equipment working under pressure which are not regulated by national standards are determined;

24) the technical specification - the document establishing technical requirements to which the equipment working under pressure or aggregates, process or service shall answer;

25) pressure - pressure of rather atmospheric pressure, in particular excessive pressure. At the same time pressure, below atmospheric, is estimated as negative size;

26) pipelines - components of the pipelines intended for transportation of working environment when they represent the joint system working under pressure.

Pipes, systems of pipes, pipeline armature, fitting, compensators, hoses or other parts working under pressure are considered as pipelines, in particular; tubular heat exchangers for chilling or heating of air;

27) the authorized representative - physical or legal resident person of Ukraine who received the written order from the producer to be effective from his name concerning the tasks determined in the order.

Other terms are used in the value given in the Laws of Ukraine "About technical regulations and assessment of conformity", "About the state market supervision and control of non-food products", "About general safety of non-food products", "About standardization".

Representation in the market and commissioning

4. The equipment working under pressure, and aggregates can be placed in the market and are put into operation on condition of their compliance to requirements of this Technical regulation, proper installation, maintenance and proper use.

5. Requirements of regulatory legal acts and regulating documents concerning ensuring protection of workers in case of operation of the equipment working under pressure, and aggregates cannot provide modification of such equipment by the method which is not provided by this Technical regulation.

6. Demonstration of the equipment working under pressure or aggregates which do not conform to requirements of this Technical regulation during fairs, exhibitions or other similar actions, is performed in the presence of visible designation on which it is accurately specified that such equipment and aggregates cannot be introduced into circulation or are presented at the market before their reduction in compliance with requirements of this Technical regulation. Demonstration of the equipment working under pressure or aggregates can be made only on condition of implementation of proper measures of safety.

Technical requirements

7. The equipment working under pressure and which shall meet the essential requirements for safety stated in annex 1, are:

1) vessels, except those that are specified in the subitem 2 of Item 7 of this Technical regulation, for:

gases, the liquefied gases dissolved under pressure of gases, vapors and also working environments (liquids) which vapor pressure at the most admissible temperature exceeds the normal atmospheric pressure (1013 millibars) more than on 0,5 of bar, in limits of the following extreme values:

- for working environment of group 1, if the amount exceeds 1 liter and the work PS on V exceeds 25 bars on 1 liter or pressure of PS exceeds 200 bars (the chart of 1 appendix 2);

- for working environment of group 2, if the amount exceeds 1 liter and the work PS on V exceeds 50 bars on 1 liter or pressure of PS exceeds 1 thousand bars, and also all portable fire extinguishers and cylinders for respiratory devices (the chart 2 appendices 2);

 it is higher than the normal atmospheric pressure of working environment (liquids) with vapor pressure at the most admissible temperature of no more 0,5 of bar (1013 millibars) within such extreme values:

- for working environments of group 1, if the amount exceeds 1 liter and the work PS on V exceeds 200 bars on 1 liter or pressure of PS exceeds 500 bars (the chart 3 appendices 2);

- for working environment of group 2, if pressure of PS exceeds 10 bars and the work PS on V exceeds 10 thousand bars on 1 liter or pressure of PS exceeds 1 thousand bars (the chart 4 appendices 2);

2) the equipment working under pressure, with a capacity more than 2 liters and intended for production of steam or superheated water at temperature more than 110 °C which is warmed up by flame or otherwise and to which danger of overheat, including autoclaves/pressure cooker (the chart 5 of appendix 2) threatens;

3) pipelines for:

gases, the liquefied gases dissolved under pressure of gases, of vapors and working environment with vapor pressure at the most admissible temperature it is higher than the normal atmospheric pressure (1013 millibars) more than on 0,5 of bar within the following extreme values:

- for working environment of group 1, if DN exceeds 25 (the chart 6 of appendix 2);

- for working environment of group 2, if DN more than 32 and the work PS on DN exceeds 1 thousand bars (the chart 7 of appendix 2);

working environment with vapor pressure at the most admissible temperature of no more 0,5 of bar of atmospheric pressure (1013 millibars) within such extreme values:

- for working environment of group 1, if DN more than 25 and the work PS on DN exceeds 2 thousand bars (the chart 8 of appendix 2);

- for working environment of group 2, if pressure of PS exceeds 10 bars, DN more than 200 and the work PS on DN exceeds 5 thousand bars (the chart 9 of appendix 2);

4) the safety devices and devices working under pressure are intended for the equipment which is regulated by subitems 1 - 3 Items 7 of this Technical regulation, including for the equipment which is built in aggregates.

8. Aggregates which include at least than one unit of equipment, of this Technical regulation working under pressure, specified in Item 7 and which shall meet the essential requirements for safety determined in appendix 1, are:

1) the aggregates intended for development of vapor or superheated water at temperature more than 110 °C which contain at least than one unit of equipment working under pressure and it is warmed up by flame or otherwise and to which danger of overheat threatens;

2) aggregates, except those that are specified in the subitem 1 of Item 8 of this Technical regulation if the producer intends to provide them in the market and to introduce into circulation as aggregates.

As departure from the subitem 1, the aggregates intended for receipt of warm water at temperature not above 110 °C which are loaded manually by solid fuel and the work PS on V exceeds 50 bars on 1 liter, shall conform to the essential requirements for safety specified in Items 22 - 25, 38 - 40, paragraphs the fifth and eighth Item 46 of appendix 1.

9. The equipment working under pressure and aggregates with the working parameters equal or below the borders given in Items 7 and 8 of this Technical regulation shall be designed and manufactured according to requirements for proper engineering practice which are applied in Ukraine. The equipment working under pressure, and aggregates shall be followed by the corresponding instructions for application.

Such equipment and aggregates cannot have the mark of conformity to technical regulations specified in Item 60 of this Technical regulation without violation of other applicable legislation which assumes its drawing.

10. In the territory of Ukraine shall not be prohibited, be limited or interfere with provision in the market or to input in turnover on the conditions determined by the producer of the equipment working under pressure or aggregates which correspond to this Technical regulation, referring to the danger connected with pressure.

In the territory of Ukraine shall not be prohibited, be limited or interfere with provision in the market or to issuance, referring to the danger connected with pressure, the equipment working under pressure or aggregates which answer Item 9 of this Technical regulation.

11. For the purpose of proper safe operation of the equipment working under pressure and aggregates information specified in Items 37 - the 40th appendices 1, shall move according to the law on procedure for application of languages.
