Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of seed farming.

Article 2. Legislation on seed farming

The legislation on seed farming consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about seed farming then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

approbation - field investigation for determination of genetical (high-quality) purity of plants, porazhayemost wreckers, infectiousnesses diseases and general condition of the seeds provided for crops;

hybrid seeds - the seeds received from crossing of grades, types, different in heredity, and parent forms;

original seeds - the seeds made by the author of grade or person authorized by it and intended for further reproduction;

the patent holder (licensor) - the legal entity or physical person which acquired the property right to selection grade and (or) hybrid seeds;

population - set of the plants of free crossing (distinguished from each other by heredity) widespread in identical edaphic-climatic conditions and belonging to one type;

reproductive seeds - the seeds of the subsequent generations received from elite seeds;

seeds - the seed, fruits used for crops, the vegetable parts which are made multiple copies in the vegetative way;

genetic (high-quality) quality of seeds - complex of the indicators characterizing genetical purity of seeds of certain grade;

sowing qualities of seeds - complex of the indicators characterizing suitability of seeds for crops;

batch of seeds - certain quantity homogeneous by origin and to quality of seeds;

seed farming - the activities connected with production, storage, realization and use of seeds, and also with the held events for determination of genetic (high-quality) and sowing qualities of seeds;

elite seeds - the seeds received by consecutive reproduction of original seeds.

Article 4. Categories of seeds

Depending on stages of reproduction of grades of crops the following categories of seeds are determined:

original;

elite;

reproductive.

Article 5. Objects of seed farming

Treat objects of seed farming:

grade;

hybrid;

population;

seeds;

the seed crops used for cultivation of seeds.

Article 6. Subjects of seed farming

Treat subjects of seed farming:

author of grade;

producer of seeds;

implementor of seeds;

consumer (user) of seeds;

the organization rendering services in determination of genetic (high-quality) and sowing qualities of seeds.

Article 7. Rights of subjects of seed farming

Subjects of seed farming have the right:

take part in implementation of the state and other programs in the field of seed farming;

use selection achievements;

participate in exhibitions sales (auctions) of seeds;

use the innovation technologies in the activities and implement achievements of science;

apply resource-saving technologies for production of seeds.

Article 8. Obligations of subjects of seed farming

Subjects of seed farming shall:

provide carrying out periodic approbation of the areas used for cultivation of seeds;

follow requirements of flow sheets of production of the seeds, rules of their storage and realization approved by authorized body and also to provide high-quality and quantitative storage of seeds;

represent the certificate of conformity on batch of seeds, and also characteristics of hybrids and grades to consumers (users) of seeds;

carry out approbation of the areas used for production of seeds with authorized bodies.

The producers of seeds, the organizations rendering services in determination of genetic (high-quality) and sowing qualities of seeds shall keep complete account of each batch of seeds on genetic (high-quality) and sowing qualities.

Chapter 2. State regulation in the field of seed farming

Article 9. The main directions of state policy in the field of seed farming

The main directions of state policy in the field of seed farming are:

creating favorable conditions for investment attraction, development of infrastructure and customer services;

development of research works and implementation of modern forms of activities;

preserving indicators of genetic (high-quality) quality in case of production of seeds;

creation of effective system of reproduction of seeds and providing consumers (users) of seeds with them;

stimulation of activities of subjects of seed farming and creation of necessary conditions for production of seeds;

development of international cooperation in the field of seed farming.

Article 10. Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of seed farming

Cabinet of Ministers of the Republic of Uzbekistan:

provides realization of single state policy in the field of seed farming;

approves state programs in the field of seed farming and provides their realization;

adopts regulatory legal acts in the field of seed farming;

coordinates activities of bodies of the public and economic board in the field of seed farming.

Article 11. Powers of the Ministry of Agriculture of the Republic of Uzbekistan in the field of seed farming

Ministry of Agriculture of the Republic of Uzbekistan:

participates in development and implementation of the state and other programs in the field of seed farming of crops;

creates modern system of preparation, use and export of seeds of crops, including seeds of cotton and grain;

will organize and develops primary seed farming of grades of domestic and foreign selection, including biotechnology grades;

according to international standards and the technical regulation develops normative requirements for production, conversion and storage of seeds of crops;

determines the priority directions scientific and experienced pilot studies in the field of seed farming;

cooperates with the international and national seed-growing organizations, implements the innovation technologies of processing and conversion of seeds before crops, know-how in this area;

will organize work on strain testing of seeds of crops;

keeps the State register of the crops recommended for crops in the territory of the Republic of Uzbekistan;

develops suggestions for improvement of the legislation on seed farming;
