1. Approve:

1) Rules of crediting/microcredit in the cities and monotowns, according to appendix 1 to this order;

2) Rules of guaranteeing on the credits/microcredits issued by the microfinancial organizations / banks of the second level in the cities according to appendix 2 to this order.

2. Recognize invalid some orders of the Minister of national economy of the Republic of Kazakhstan according to appendix 3 to this order.

3. To provide to department of the state support of entrepreneurship of the Ministry of national economy of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on official Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of crediting/microcredit in the cities and monotowns

Chapter 1. General provisions

1. These rules of crediting/microcredit in the cities (further - Rules) are developed within the State program of development of productive employment and mass entrepreneurship for 2017-2021 of Enbek approved by the order of the Government of the Republic of Kazakhstan No. 746 of November 13, 2018 (further - the Program) and determine procedure for provision of the credits/microcredits in the cities and the monotowns of the Republic of Kazakhstan, except the small cities.

Crediting/microcredit within Rules is used as measures for employment assistance jobless, self-employed with entrepreneurial potential.

2. In Rules the following concepts and determinations are used:

1) "Fund of Financial Support of Agricultural Industry" joint-stock company (further - JSC FFPSH) - the legal entity, not being bank, performing separate types of banking activities based on the license of National Bank of the Republic of Kazakhstan;

2) authorized body concerning agricultural industry - the central executive body of the Republic of Kazakhstan performing management and cross-industry coordination in the field of agricultural industry;

3) Participants of the Program are the jobless persons, separate categories of busy persons determined by the order of the Government of the Republic of Kazakhstan of April 11, 2019 No. 178 "About determination of separate categories of busy persons", youth, including the youth of category NEET, members of young and needy large families, needy able-bodied disabled people, agricultural cooperatives and their members who did not reach retirement age, stipulated in Item 1 article 11 of the Law of the Republic of Kazakhstan "About provision of pensions in the Republic of Kazakhstan" country and farms including participants of anchor cooperation;

4) starting business (startup the project) - business projects of participants of the Program which term of state registration as legal person / registration of the status of the individual entrepreneur constitutes at the time of the address to the creditor behind the credit/microcredit less than one year;

5) the agreement of budget credit - the written agreement about provision of budget credit signed according to the civil legislation between local executive body and the Microcredit/JSC FFPSH organization;

7) the acting entrepreneur - the entrepreneur whose term of state registration as the individual entrepreneur or the legal entity constitutes at the time of the appeal to banks of the second level (further - BVU) / the microfinancial organization (further - IFI) / JSC FFPSH / credit partnership (further - KT) behind the credit/microcredit more than three years;

8) investments - acquisition/construction/upgrade / reconstruction / capital repairs of fixed assets, acquisition of biological/intangible assets;

9) the entrepreneur - the beginning entrepreneur, the beginning young entrepreneur and the acting entrepreneur own projects implementing and (or) planning to implement in all cities and monotowns, except for the small cities without industry restrictions and without place of registration of the entrepreneur;

10) authorized body concerning entrepreneurship (further - authorized body) - the central executive body of the Republic of Kazakhstan performing management and cross-industry coordination in the field of entrepreneurship;

11) the credit/microcredit - the borrowed funds provided to BVU/IFI/JSC FFPSH to the participant of the Program for the agreement on provision of credit/microdomestic currency loan of the Republic of Kazakhstan on the terms of the paid nature, urgency, recoverability, security and purpose;

12) the agreement on provision of the credit/microcredit - the written agreement signed between the creditor and the participant of the Program for provision to the last of the credit/microcredit at the expense of funds of loan for the purposes determined by these rules;

13) the creditor - the microfinancial organization / banks of the second FFPSH level / KT / joint-stock company;
