About additional measures for implementation of modern and transparent procedures for granting of the parcels of land and realization of the right to the life inherited tenancy by the parcels of land under individual housing construction

For the purpose of implementation of modern and transparent mechanisms, accelerations and simplifications of procedures of provision of the parcels of land the Cabinet of Ministers decides:

1. Approve:

Regulations on procedure for provision of the parcels of land for the state and social needs according to appendix No. 2.

2. To provide to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent control of unconditional observance on places of requirements of the provisions approved by this resolution.

3. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 20.12.2019 No. 1023

4. Recognize invalid:

Chapters II and III of the Provisions on individual housing construction approved by the resolution of the Cabinet of Ministers of December 30, 2006 No. 272 (the joint venture of the Republic of Uzbekistan, 2006, No. 12, the Art. 97);

appendices No. 2 and No. 3, and also Chapter II of Provisions on procedure for the differentiated approach in case of determination of terms and cost of implementation of procedures for issue of documents of allowing nature in the sphere of the construction approved by the resolution of the Cabinet of Ministers of May 30, 2013 No. 150 (the joint venture of the Republic of Uzbekistan, 2013, No. 5, the Art. 33).

5. To the state committee of the Republic of Uzbekistan on land resources, geodesy, cartography and the state inventory together with the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

6. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and on the chairman of the State committee of the Republic of Uzbekistan on land resources, geodesy, cartography and the state inventory A. H. Abdullaev.

Regulations on procedure for provision of the parcels of land for the state and social needs

Chapter 1. General provisions

1. This Provision determines procedure for provision of the parcels of land:

for the state and social needs;

on massifs where the construction of available apartment houses according to standard projects in the rural zone and the cities according to resolutions of the President of the Republic of Uzbekistan of October 21, 2016 No. PP-2639 "About the Program for construction of available apartment houses for the projects updated standard in the rural zone for 2017 - 2021" and of November 22, 2016 No. PP-2660 "About measures for program implementation for construction of reconstruction of available apartment houses in the cities for 2017 - 2020 is conducted";

to physical persons and legal entities in connection with withdrawal of the parcels of land at them for the state and social needs in accordance with the established procedure;

to joint-stock companies with 100 percent state share;

in the areas and the cities which are lagging behind in social and economic development, determined by the Ministry of Economy and Industry of the Republic of Uzbekistan in coordination with the Cabinet of Ministers of the Republic of Uzbekistan.

2. In this Provision the following basic concepts are used:

the automated information system "YERELEKTRON" (further - AIS "YERELEKTRON") - the automated information system for implementation of procedures of collection, consideration and coordination of materials on provision of the parcels of land with the authorized bodies and the organizations connected to it according to the resolution of the Cabinet of Ministers of June 30, 2018 No. 493;

the state needs - provision of lands for:

needs of defense and state security, creation of the protected natural territories, creation and functioning of free economic zones;

accomplishment of the obligations following from international treaties of the Republic of Uzbekistan;

detection and developments of mineral deposits;

constructions (reconstruction) automobile and railroads, airports, airfields, objects of air navigation and aerotechnical centers, objects of rail transport, bridges, subways, tunnels, objects of power systems and power lines, communication lines, objects of space activities, bulk distribution lines, engineering and communication networks;

execution of master plans of settlements regarding construction of facilities at the expense of means of the Government budget of the Republic of Uzbekistan, and also in other cases, stipulated by the legislation the Republic of Uzbekistan;

the parcel of land - the part of land fund having the fixed border, the area, location, legal regime and other characteristics reflected in the state land cadastre;

social needs - the need for construction:

automobile drives and pedestrian passes to the buildings and constructions, the territories belonging to legal entities irrespective of forms of business, and also to physical persons;

the engineering communications to buildings and constructions, the territories belonging to legal entities irrespective of their forms of business and also to physical persons;

aryk, channels and other waterways, reservoirs intended for supply with water of the population, green plantings and crops;

the public educational and medical institutions, boarding schools, houses of mercy, and also within public-private partnership;

the areas, and also parks of rest, avenues, boulevards, rest areas, lakes, water storage basins, ponds and other recreational facilities financed from means of the Government budget of the Republic of Uzbekistan and means of the state organizations created of the sources which are not forbidden by the legislation;
