About approval of the Regulations on the state committee of industrial safety of the Republic of Uzbekistan

In pursuance of the Presidential decree of the Republic of Uzbekistan of December 12, 2018 No. UP-5594 "About Measures for Cardinal Enhancement of System of Public Administration and Supervision in Spheres of Industrial, Radiation and Nuclear Safety" and resolutions of the President of the Republic of Uzbekistan of December 12, 2018 No. PP-4058 "About the organization of activities of the State committee of industrial safety of the Republic of Uzbekistan" the Cabinet of Ministers decides:

1. Approve Regulations on the State committee of industrial safety of the Republic of Uzbekistan according to appendix No. 1.

2. To the state committee of industrial safety of the Republic of Uzbekistan to approve regulations on structural divisions and job descriptions of employees of the State committee of industrial safety of the Republic of Uzbekistan in a month.

3. Take into consideration that financing of activities of the Almalyk mining inspection and the Kyzyl Kum mining inspection of the State committee of industrial safety of the Republic of Uzbekistan is made at the expense of means of JSC Almalyksky MMC and GP "Navoiy by MMC", respectively.

4. Determine that:

the structure of personnel of the Almalyk mining inspection and Kyzyl Kum mining inspection of the State committee of industrial safety of the Republic of Uzbekistan joins in the number of staff of JSC Almalyksky MMC and GP "Navoiy MMC", respectively;

the officials of the State committee of industrial safety of the Republic of Uzbekistan exercising supervision of ensuring industrial, radiation and nuclear safety are assigned to persons under surveillance by objects depending on supervision industry;

guarantees and preferences under the terms of work of the officials of the State committee of industrial safety of the Republic of Uzbekistan exercising supervision of ensuring industrial, radiation and nuclear safety are determined according to results of certification of workplaces under the terms of work and injury risk of the equipment on persons under surveillance objects.

5. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

6. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

7. To impose control of execution of this resolution on the chairman of the State committee of industrial safety of the Republic of Uzbekistan and the adviser to the Prime Minister of the Republic of Uzbekistan concerning development fuel and energy and key branches of the industry.

Regulations on the State committee of industrial safety of the Republic of Uzbekistan

Chapter 1. General provisions

1. This Provision determines the status, the main objectives, functions, the rights, responsibility, procedure for the organization of activities and the reporting of the State committee of industrial safety of the Republic of Uzbekistan (further - Goskomprombez), and also functional obligations of his heads.

Goskomprombez is the authorized body of public administration responsible for realization of single state policy and control in the sphere of ensuring radiation and nuclear safety on objects of nuclear power and nuclear technologies, and also in the field of industrial safety on hazardous production facilities.

Goskomprombez in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, this Provision and other acts of the legislation.

4. Goskomprombez's decisions made within its powers are obligatory for execution of the public and economic board by bodies, executive bodies on places, and also other organizations and physical persons.

Chapter 2. Goskomprombez's structure

Kyzyl Kum mining inspection;

The militarized mine-rescue part (further - VGSCh);

SUE Kontekhnazorat¸kuv;

SUE Sanoat nazorati laboratoriyasi.

9. The central office, territorial administrations, mining inspections and the subordinated organizations of Goskomprombez form single system of public administration and regulation of the Republic of Uzbekistan in the field of industrial, radiation and nuclear safety.

Territorial administrations are independent of public authorities on places and submit directly to Goskomprombez.

State bodies and other organizations are forbidden to assign to Goskomprombez's workers performance of works who are not entering their competence.

Chapter 3. Tasks and Goskomprombez's functions

10. The main objectives and activities of Goskomprombez are:

coordination of work on carrying out single state policy and control in the sphere of ensuring radiation and nuclear safety on objects of nuclear power and nuclear technologies, and also in the field of industrial safety on hazardous production facilities;

implementation of the state supervision and control of observance by legal entities and physical persons of requirements of the legislation and regulating documents in the field of technical regulation in spheres of industrial, radiation and nuclear safety, safety of conducting works during the using natural resources, and also operation of park attractions;

participation in development of strategic plans and programs for further development of fuel and energy complex and key branches of economy of the republic regarding ensuring industrial, radiation and nuclear safety;

licensing in the field of use of atomic energy, coordination of activities of state control bodies in the field of ensuring industrial, radiation and nuclear safety;

enhancement of system of examination and accreditation of industrial safety, and also the organization of examination of reasons for safety of subjects to use of atomic energy and (or) activities in the field of use of atomic energy;

development and acceptance in accordance with the established procedure regulatory legal acts and regulating documents in the field of technical regulation in spheres of industrial, radiation and nuclear safety, safety of conducting works during the using natural resources, and also operation of park attractions;

implementation of close cooperation with the international and foreign organizations, and also ensuring accomplishment of obligations of the Republic of Uzbekistan according to the international treaties relating to field of activity;

advanced training of the specialists performing activities in spheres of industrial, radiation and nuclear safety, safety of conducting works when using natural resources taking into account dynamic development of technology and technologies.
