About measures for development of activities of appraisers and the estimative organizations in the Kyrgyz Republic

For the purpose of liberalization, enhancement and development of estimative activities in the Kyrgyz Republic, in pursuance of Item 3 of the Plan of liberalization for service sector according to the property approved by the decision of the Supreme Eurasian economic council of December 26, 2016 No. 23, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for maintaining the register of subjects of estimative activities in the Kyrgyz Republic according to appendix.

2. Bring in the Order of the Government of the Kyrgyz Republic "About development of activities of appraisers and the estimative organizations in the Kyrgyz Republic" of August 21, 2003 No. 537 the following change:

in Provisional rules of activities of the appraisers and the estimative organizations in the Kyrgyz Republic approved by the above-stated Resolution:

- add Item 2 with the paragraph the second the following content:

"Maintaining the register of subjects of estimative activities in the Kyrgyz Republic is performed by authorized body on development and regulation of estimative activities in the Kyrgyz Republic.".

3. This Resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for maintaining the register of subjects of estimative activities in the Kyrgyz Republic

1. General provisions

1. This Provision determines procedure for maintaining and forming of the register of subjects of estimative activities in the Kyrgyz Republic (further - the Register).

The register is legal mechanism for recognition of qualification and permission of the admission of personnel of the service provider according to property of the Kyrgyz Republic on the market of state members of the Eurasian Economic Union.

2. Procedure for maintaining Register

2. Maintaining the Register is performed by authorized body on development and regulation of estimative activities in the Kyrgyz Republic (further - authorized body) on the basis of the data provided by subjects of estimative activities of the Kyrgyz Republic.

3. Subjects of estimative activities physical persons and legal entities of the Kyrgyz Republic of all patterns of ownership, irrespective of their form of business, the performing services in the field of property assessment are recognized.

4. The register is kept in electronic form in form according to appendix 1 to this Provision.

5. The register is posted in open access on the official site of authorized body and contains the information about the subjects of estimative activities of the Kyrgyz Republic performing services in the field of property assessment.

6. Inclusion in the Register is performed according to the statement of the subject of estimative activities of the Kyrgyz Republic on voluntary and non-paid basis.

7. Data in the Register are updated by authorized body annually, till April 20 of the next calendar year, on the basis of the submitted applications of estimative activities in the Kyrgyz Republic.

8. The information provided by subjects of estimative activities of the Kyrgyz Republic is subject to inclusion in the Register within five working days from the date of receipt.

9. Responsibility for reliability of the data provided for inclusion in the Register is born by the subject of estimative activities.

10. For refining of the data provided by the subject of estimative activities and enclosed to the application of documents, the authorized body has the right to request the missing data and documents specified in Item 14 of this provision.

11. The subject of estimative activities of the Kyrgyz Republic included in the Register is excluded from the Register in cases:

1) ideas by the subject of estimative activities of the written application of exception of the Register;

2) non-presentations in authorized body of documents and data or the formal notice on lack of any changes in its activities till April 15 of the next calendar year according to Item 7 of this provision;

3) liquidations of the subject (legal entity) of estimative activities;

4) terminations by the subject (physical person) of estimative activities of the activities;

5) recognitions by the bankrupt of the subject of estimative activities;

6) recognitions of the subject of estimative activities by incapacitated, it is limited by capable, is unknown absent;

7) announcements of the subject of estimative activities by the dead.

Information specified in subitems 3-7 of this Item is provided by close relatives of the subject of estimative activities and/or authorized bodies.

12. The subject of estimative activities in case of change of the data containing in the Register within ten working days directs up-to-date information (in paper and electronic type) to authorized body for entering of corresponding changes into the Register.

3. Procedure for provision of information by subjects of estimative activities

13. The subject of estimative activities of the Kyrgyz Republic for inclusion in the Register file in authorized body petition in form according to appendix 3 to this Provision.

14. Documents are enclosed to the application:

for legal entities:

1) copies of constituent documents;

2) the documents confirming lack of debts on obligatory payments in the budget;

3) the information about the number of staff employees - appraisers, in form according to appendix 2 to this Provision;

4) data on assessment types;

5) data on amounts of the rendered services for the last three years, in national currency;

for physical persons:

1) passport copy;

2) copy of the patent of the individual entrepreneur;

3) copies of education documents and qualification;

4) copies of documents on availability of academic status and academic degree;

5) the documents confirming lack of debts on obligatory payments in the budget;
