About approval of the Instruction about procedure for sealing in sea commercial and river ports of Ukraine of the ship locking devices intended for dumping of the pollutants and waters containing them

According to the resolution of the Cabinet of Ministers of Ukraine of 29.03.2002 N431 "About Introduction of Amendments to the Resolution of the Cabinet of Ministers of Ukraine of February 29, 1996 N269" and Article 3 of the Merchant Marine Code of Ukraine

I ORDER:

1. Approve the Instruction about procedure for sealing in sea commercial and river ports of Ukraine of the ship locking devices intended for dumping of pollutants and waters, them containing (further - the Instruction) which is applied.

2. Main state inspectorate of Ukraine for safety of navigation (Shchiptsov O. A.):

2.1. Provide provision of the specified Instruction on state registration.

2.2. Bring the order to permission of sea commercial and river ports, other interested companies, organizations, the organizations.

2.3. Provide control of observance of requirements of the Instruction.

3. To chiefs of sea trade, Nikolaev and Kherson river ports to make changes and additions to obligatory resolutions on ports taking into account requirements of the Instruction (term - 1 month).

4. To impose control of execution of this order on the Deputy State secretary Simonenko S. V.

The instruction about procedure for sealing in sea commercial and river ports of Ukraine of the ship locking devices intended for dumping of the pollutants and waters containing them

1. General provisions

1.1. This Instruction is developed according to the Merchant Marine Code of Ukraine, the resolution of the Cabinet of Ministers of Ukraine of 29.03.2002 of N431 "About Introduction of Amendments to the Resolution KMU of February 29 1996 N 269", the Regulations on the Main state inspectorate of Ukraine for safety of navigation approved by the resolution of the Cabinet of Ministers of Ukraine of 30.12.98 of N2098 with the changes made by resolutions of the Cabinet of Ministers of Ukraine of 27.12.2001 of N1758 and of 28.12.2001 N 1796, the Regulations on the captain of sea commercial harbor of Ukraine approved by the order of the Ministry of transport of Ukraine of 18.10.2000 of N573 and the Regulations on Inspection of the state port supervision of sea commercial harbor of Ukraine approved by the order of the Ministry of transport of Ukraine of 18.10.2000 of N574 registered by the Ministry of Justice 02.11.2000 for N774/4995, and registered by the Ministry of Justice 02.11.2000 for N775/4996.

1.2. The instruction extends to captains of sea commercial harbors of Ukraine (further - captains of ports), inspections of the state port supervision of sea commercial harbors of Ukraine (further - IGPN), Ukrmorrechinspektion, captains and crews of vessel coming into the ports of Ukraine.

1.3. Sealing of ship locking devices (valves, sluice valves, valves, clacks, cranes, hatches and another, daleeustroystvo) is performed for the purpose of prevention of unauthorized dumping from courts of the waters prohibited to dumping which can lead to pollution of inland waters and territorial sea of Ukraine.

1.4. Closing of all devices intended for dumping of pollutants, including waters, containing them is performed by persons in charge of ship crew before vessel entrance to territorial and inland waters of Ukraine with the corresponding record about it in the logbook. Sealing of devices is performed in case of statement of the vessel in port by the inspector of IGPN.

2. Sealing

2.1. The harbor captain in accordance with the established procedure designates person (persons) responsible for safety of ice cream (ice creams) of IGPN, and also establishes procedure for issue of ice cream to inspectors of IGPN. Ice cream is issued to inspectors of IGPN and is accepted from them by person in charge under the signature in the magazine of issue of ice cream (ice creams) which is kept in IGPN.

2.2. The ship devices which are specially intended for direct dumping overboard of the vessel of pollutants or waters, them containing are subject to sealing (such as llyalny waters of engine and boiler rooms, slime and other petroremaining balance, dirty and net ballast, drain waters, garbage). The approximate list of the ship locking devices intended for dumping of pollutants and waters, containing them which shall be sealed up is given in appendix 1 to this Instruction. The complete list of devices for certain vessel is determined taking into account type, assignment and design features of the vessel, its equipment and systems.

2.4. When sealing ship devices the inspector of IGPN shall:

determine the list of the devices which are subject to sealing;

seal up devices on the established technology;

draw up sealing.

2.5. Determination of the list of the devices which are subject to sealing

2.5.1. The list of the devices which are subject to sealing is determined by the inspector of IGPN together with the captain or person authorized by the ship master.

2.5.2. Are not subject to sealing of the device, intended for ship transactions which are constantly performed in port (for delivery of llyalny waters, dirty and net ballast, petroremaining balance, waste and economic and household waters on port inshore and floating reception facilities; for dumping of segregated ballast; for pumping of all types of water within the vessel; for acceptance and issue of fuel, lubricant and another).

2.6. Technology of sealing

2.6.1. For sealing of ship devices the inspector of IGPN uses the IGPN ice cream which is specially intended for this work. The print of IGPN ice cream shall have the reduced name in English of "PC" (Port Control) and number corresponding to the list of numbers for prints of ice cream of the inspections of the state port supervision intended for sealing of ship locking devices given in appendix 2 to this Instruction.

2.6.2. The devices which are subject to sealing shall be to oplombirovyvaniye completely closed for exception of possibility of dumping of the pollutants and waters containing them via the sealed-up device.

2.6.3. If the device has remote (mechanical or other operation principle) drives, except the drive located on the device, then are sealed up all its remote drives.

2.6.4. Sealing is performed so that after imposing of seal any manipulations with the device directed to its opening would lead to violation of seal.
