About the organization and functioning of Public organization "National Bureau on Implementation of Projects in the field of the Environment"

For the purpose of increase in effective management of projects on rendering financial and technical assistance in the field of environmental protection and use of natural resources, based on Items b) and e) article 7 of the Law on the Government No. 136/2017 (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), Art. 32 of the Law on the central branch public management No. 98/2012 (The official monitor of the Republic of Moldova, 2012, No. 160-164, the Art. 537), with subsequent changes, the Government DECIDES:

1. Rename Public organization "Division on Implementation and Coordinating of Projects Public Organization "EMP Management Durabil POP"" into Public organization "National Bureau on Implementation of Projects in the field of the Environment".

2. The legal entities provided in appendix No. 1 to this resolution are subject to reorganization by merge (absorption) to Public organization "National Bureau on Implementation of Projects in the field of the Environment".

3. The public organization "National Bureau on Implementation of Projects in the field of the Environment" is successor of the rights and obligations of the reorganized legal entities.

4. To transfer property of the reorganized legal entities to Public organization "Division on Implementation of Projects in the field of the Environment" according to requirements of the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015 of year.

5. The current projects on assistance realized by the reorganized legal entities on the date of entry into force of this resolution are subject to further implementation by Public organization "Division on Implementation of Projects in the field of the Environment" according to provisions of agreements on assistance.

6. Approve:

1) the Charter of public organization "National Bureau on Implementation of Projects in the field of the Environment", according to appendix No. 2;

2) the Organizational structure of public organization "National Bureau on Implementation of Projects in the field of the Environment", according to appendix No. 3;

3) to Organigramm of public organization "National Bureau on Implementation of Projects in the field of the Environment", according to appendix No. 4.

6-1. Establish the extreme number of public organization "National Bureau on Implementation of Projects in the field of the Environment" in number of 8 units.

7. To the minister of the environment:

1) in 3-day time of the date of entry into force of this resolution to designate person who will temporarily perform function of the director;

2) in 30-day time of the date of entry into force of this resolution to appoint members of the committee on supervision of Public organization "National Bureau on Implementation of Projects in the field of the Environment";

3) in 60-day time of registration date of changes in the Agency of public services to appoint the director of Public organization "National Bureau on Implementation of Projects in the field of the Environment".

8. To the ministry of the environment:

1) to bring the regulations into accord with this resolution;

To provide 2) to the Government of the offer on modification of regulations for the purpose of their reduction to compliance with this resolution.

9. To public organization "Division on Implementation of Projects in the field of the Environment":

1) within 30 days of registration date of changes in the Agency of the state services:

a) develop and submit for approval to Committee on supervision of Public organization "Division on Implementation of Projects in the field of the Environment" the organizational structure, its organigramma and the extreme number of staff;

b) estimate current status of all projects / programs on implementation of the projects realized by the reorganized legal entities, the prospects of implementation of new projects / programs in the field of environmental protection and climate change and to submit to the Ministry of the environment the progress report on implementation of projects/programs;

2) within 60 days of registration date of changes in the Agency of the state services to provide transfer of remaining balance of financial resources from bank accounts of the reorganized legal entities for treasurer accounts. In case, in coordination with creditors/donors on assistance, transfer of financial resources does not guarantee the maximum achievement of one general and/or several specific purposes of the project/program or leads to emergence of risk of the termination of projects/programs for assistance, bank accounts of the reorganized legal entities remain before full implementation of the agreements on assistance existing on the date of entry into force of this resolution.

10. To the agency of the state services to make necessary changes to cadastral and constituent documents according to the address of the owner.

11. Recognize invalid:

1) the Order of the Government No. 888/2014 about Division on implementation and coordinating of projects Public organization "EMP Management Durabil POP" (The official monitor of the Republic of Moldova, 2014, Art. No. 325-332, 956);

2) the Order of the Government No. 899/2005 about creation of Office of carbon financing (The official monitor of the Republic of Moldova, 2005, Art. No. 117-118, 971).

12. To impose control over execution of this resolution on the Ministry of Agriculture, regional development and the environment.

13. This resolution becomes effective since January 1, 2019.
