About approval of Rules of application of national, interstate standards and national qualifiers of technical and economic information in regulatory legal acts

According to the subitem 11) article 9 of the Law of the Republic of Kazakhstan of October 5, 2018 "About standardization" PRIKAZYVAYU:

1. Approve the enclosed Rules of application of national, interstate standards and national qualifiers of technical and economic information in regulatory legal acts.

2. Declare invalid the order of the acting minister on investments and development of the Republic of Kazakhstan of December 4, 2015 No. 1158 "About approval of Rules of application of reference regulating documents on standardization" (registered in the Register of state registration of regulatory legal acts for No. 12833, No. 22 published on February 4, 2016 in the Kazakhstanskaya Pravda newspaper (28148)).

3. To provide to committee of technical regulation and metrology of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective since April 11, 2019 and is subject to official publication.

Rules of application of national, interstate standards and national qualifiers of technical and economic information in regulatory legal acts

1. These rules are developed according to the subitem 11) of article 9 of the Law of the Republic of Kazakhstan of October 5, 2018 "About standardization" and determine procedure for application of national, interstate standards and national qualifiers of technical and economic information (further - documents by standardization) (further - Rules) on which references in regulatory legal acts are given.

2. In regulatory legal acts references to the existing documents on standardization are given.

3. References share on direct and indirect.

4. The direct reference in regulatory legal acts on documents on standardization is given, in case of need achievements of requirements of the specific document for standardization.

5. The references to documents given in regulatory legal acts on standardization are obligatory if there are instructions about it in the legislation of the Republic of Kazakhstan.

6. The direct reference is specified in the form of designation and the name of the document on standardization, without specifying of year of its approval, for example: "ST of PK 1125 "Route signs. General specifications", RK Group 08 "Qualifier of specialties of the higher and postgraduate education of the Republic of Kazakhstan".

7. In case of application of the document on standardization on which in regulatory legal acts the direct reference is given its last urgent edition, with all changes is used.

8. Indirect references in regulatory legal acts to documents on standardization are applied, in case of need achievements of requirements of documents for standardization without specifying of their designations and names.

9. The choice of documents on standardization on which indirect references in regulatory legal acts are had for the purpose of their application, is voluntary.

10. Establishment in regulatory legal acts of the reference to structural element of the document on standardization is not allowed.

11. When replacing the document on standardization on which in regulatory legal acts the direct reference is had for regulating documents on standardization with other designation, the document on standardization on which in regulatory legal acts the direct reference is had, is effective until entering of changes into regulatory legal acts in which they are brought.

The national authority on standardization notifies the state body responsible for development of regulatory legal acts, on need of modification of regulatory legal acts, in connection with replacement of the document provided in it on standardization within ten working days from the date of approval of the replacing regulating document on standardization.

12. State bodies concerning regulatory legal act, accepted by them and (or) developers of which they were, and also the acts which are within their competence, for the purpose of updating carry out the monthly analysis of the documents provided in them on standardization, on need of their updating, according to the Information index of standards placed on official Internet resource of Single state fund of regulating technical documents.

13. The state bodies responsible for development of regulatory legal acts within ten working days from the moment of its state registration, send to National authority on standardization the notification on acceptance of regulatory legal acts, containing the reference to the document on standardization, in form, according to appendix to these rules.

14. The national authority on standardization will organize placement of information on documents on standardization on which in regulatory legal acts references in the catalog of documents on standardization, the information index of standards, and also on Internet resource of National authority on standardization are given.
