About approval of the Regulations on the State committee of the Republic of Uzbekistan on ecology and environmental protection

In pursuance of the resolution of the President of the Republic of Uzbekistan of October 3, 2018 "About additional measures for enhancement of system of public administration in the sphere of ecology and environmental protection" the Cabinet of Ministers decides No. PP-3956:

1. Approve Regulations on the State committee of the Republic of Uzbekistan on ecology and environmental protection according to appendix No. 1.

2. In a month to provide to the chairman of the State committee of the Republic of Uzbekistan on ecology and environmental protection:

distribution of functional obligations between vice-chairmen of the State committee of the Republic of Uzbekistan on ecology and environmental protection;

completion of central office and subordinated divisions by the highly qualified specialists having the necessary theoretical and practical knowledge capable at the high professional level to provide realization of the tasks and functions assigned to committee;

approval of regulations on structural divisions of central office, Committee of the Republic of Karakalpakstan on ecology and environmental protection, managements on ecology and environmental protection of areas and city of Tashkent.

3. To the state committee of the Republic of Uzbekistan on ecology and environmental protection together with the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

4. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

5. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

6. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and the chairman of the State committee of the Republic of Uzbekistan on ecology and environmental protection B. T. Kuchkarov.

Regulations on the State committee of the Republic of Uzbekistan on ecology and environmental protection

Chapter 1. General provisions

1. This Provision determines the status, the main objectives, functions, the rights and responsibility, procedure for the organization of activities and the reporting of the State committee of the Republic of Uzbekistan under ecology and environmental protection of the Republic of Uzbekistan (further - Goskomecologies), its structural divisions, and also functional obligations, the rights and responsibility of his heads.

2. Goskomecologies is state body in the sphere of ecology, environmental protection, rational use and reproduction of natural resources.

3. Submits to Goskomecology and it is accountable to the Cabinet of Ministers of the Republic of Uzbekistan.

4. Goskomecologies in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, and also this Provision and other acts of the legislation.

5. The decisions of Goskomecology made within its powers are obligatory for execution of the public and economic board by bodies, executive bodies on places, other organizations and their officials, and also citizens.

Goskomecologies, Committee of the Republic of Karakalpakstan on ecology and environmental protection, managements on ecology and environmental protection of areas and the city of Tashkent (further - territorial subdivisions) and the subordinated organizations entering into its structure are legal entities, have seal and forms with the image of the State Emblem of the Republic of Uzbekistan and the name in state language, separate balance, treasurer personal accounts in Treasury of the Ministry of Finance of the Republic of Uzbekistan, bank accounts, including in foreign currency.

Chapter 3. Tasks and functions of Goskomecology

§ 1. Tasks and functions of Goskomecology

10. The main objectives of Goskomecology are:

public administration in the sphere of ecology, environmental protection, rational use and reproduction of natural resources;

ensuring favorable ecological state of environment, protection of ecological systems, natural complexes and separate objects, improvements of ecological situation;

implementation of the state control of compliance with law in the field of the address with waste, the organization of efficient system of collection, transportation, utilization, conversion and burial of household waste in case of close interaction with public authorities on places and self-government institutions of citizens;

11. Goskomecologies according to the tasks assigned to it performs the following functions:

brings in the Cabinet of Ministers of the Republic of Uzbekistan, state bodies and executive bodies on the places of the offer on projects implementation directed to environmental improvement for subsequent their inclusion in annual and long-term programs of social and economic development of the country;

b) in the field of ensuring favorable ecological state of environment, protection of ecological systems, natural complexes and separate objects, improvement of ecological situation:

approves programs of actions for ecology, environmental protection and carrying out research works on environmental protection and rational use of natural resources;

establishes procedure for plan development on management of the protected natural territories;

provides the population with information on the state of environment and the taken measures for its improvement according to the procedure established by the legislation;

1) exercises the state environmental control behind condition of ecosystems, natural gene pool, biological balance, and also sources of pollution of atmospheric air, surface and underground water, soils, flora (including the woods), fauna, their habitat and water biological objects;

2) exercises the state environmental control behind execution of requirements of the legislation by legal entities and physical persons in the field of environmental protection and rational use of natural resources, including:

the established ecological standard rates of emissions and dumpings of pollutants into the environment, education and placement of waste, and also the approved actions for decrease in these emissions, dumpings and waste to the established standard rates;

requirements of ecological safety in case of placement, design, construction and commissioning of the new and reconstructed companies and other objects;

3) together with bodies of the public and economic board, executive bodies on places, other organizations creates and keeps the single republican database about state of environment, the available pollution and other harmful effects, use of natural resources, using modern information and communication technologies;

4) approves standard rates of maximum permissible emissions and dumpings of pollutants into the environment and limits of placement of waste;

5) levies compensation payments for environmental pollution and placement of waste in the territory of the Republic of Uzbekistan according to the procedure, stipulated by the legislation;
