About approval of the Regulations on cross-border movement of currency values

According to Articles 6, of 7, of 15, of 44, 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of implementation of requirements of the Law of Ukraine "About currency and currency transactions" the Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on cross-border movement of currency values which are applied.

2. To department of the public markets (Ponomarenko S. V.) after official publication to inform banks information on adoption of this resolution.

3. The resolution becomes effective from the date of enforcement of the Law of Ukraine "About currency and currency transactions".

Regulations on cross-border movement of currency values

1. This Provision determines procedure import, transfer to customs area of Ukraine, export, transfer from customs area of Ukraine or transit through customs area of Ukraine by physical persons, legal entities and banks of cash and bank metals.

2. In this Provision terms are used in such values:

1) cash is the cash of Ukraine and cash foreign currency in the form of banknotes and coins which are in circulation and being legal means of payment in the territory of the relevant state, banknote and coin, withdrawn from circulation or such which are withdrawn from it, but are subject to exchange for the bank notes which are in circulation;

2) the plenipotentiary - person having necessary powers according to the legislation on implementation of specific actions.

Other terms which are used in this Provision are used in the values determined by the Law of Ukraine "About currency and currency transactions", other laws of Ukraine and regulatory legal acts of the National Bank of Ukraine.

3. Recalculation of the amounts of cash and cost of bank metals in euro for requirements of this Provision is performed on the official rate of hryvnia to euro established by the National Bank of Ukraine (further - National Bank), or on the cross-rate determined according to the official rate of hryvnia to the corresponding foreign currencies and bank metals established by National Bank on the date of crossing of customs border of Ukraine or on the date of transfer of cash, bank metals.

4. Physical/legal entities and banks perform declaring of movement of cash and bank metals according to the procedure, determined by the Cabinet of Ministers of Ukraine.

5. The physical person imports into Ukraine and exports out of limits of Ukraine cash and bank metals in the amount/cost which is not exceeding 10 000 euros in equivalent without written declaring to customs authority.

6. The physical person imports into Ukraine and exports out of limits of Ukraine cash and bank metals in the amount/cost equal or exceeding 10 000 euros in equivalent, on condition of its written declaring to customs authority in full.

7. The legal entity imports into Ukraine or exports out of limits of Ukraine cash through the plenipotentiary without restriction of the amount on the terms of written declaring to customs authority in full provided that such import / export is caused by economic activity.

8. The legal entity imports into Ukraine or exports out of limits of Ukraine bank metals without restriction of the amount on the terms of written declaring to customs authority in full provided that such import / export is caused by economic activity.

9. The basis for import by the legal entity in Ukraine/export out of limits of Ukraine of bank metals is the contract with the partner or the document which replaces it.

The basis for import by the legal entity to Ukraine of bank metals which refining is performed from the precious metals which are exported out of limits of customs area of Ukraine is the contract with the partner or the document which replaces it, and the delivery agreement of bank metals to National Bank.

10. The legal entity imports into Ukraine or exports out of limits of Ukraine bank metals through the plenipotentiary on the conditions determined in Items 8 and 9 of this provision.

11. The plenipotentiary declares separately cash and bank metals which he imports/takes out to Ukraine / from Ukraine at the request of the legal entity and own means.

12. Banks perform cross-border movement of cash and bank metals based on the banking license and the relevant contracts with partners or the document replacing these agreements.

13. Legal persons / banks perform export of the bank metals made by the Ukrainian producers in the presence of written refusal of National Bank of purchase of the bank metals (made by the Ukrainian producers) which are exported.

14. Transfer to Ukraine / from Ukraine of cash and bank metals in the international mailings is performed only with their declared value.

15. Transfer to Ukraine / from Ukraine of cash and bank metals in the international mailings is performed on conditions and according to the procedure, established by Items 5, of 6, of 8, of 9, of 12, of the 13th this provision.
