RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About measures for enhancement of activities of the Ministry of employment and employment relationships of the Republic of Uzbekistan

(as amended on 02-12-2020)

In pursuance of the resolution of the President of the Republic of Uzbekistan of August 20, 2018 No. PP-3913 "About measures for enhancement of structure of bodies for work and strengthening of system of protection of labor rights and labor protection of citizens", for the purpose of enhancement of activities of the Ministry of employment and employment relationships of the Republic of Uzbekistan, increase in efficiency of realization of the tasks assigned to the ministry, and also creation of additional terms for effective control of compliance with law about work, employment of the population and labor protection the Cabinet of Ministers decides:

1. Approve:

Regulations on the Ministry of employment and employment relationships of the Republic of Uzbekistan according to appendix No. 1;

Regulations on procedure for forming and use of means of the State fund of assistance of employment of the Republic of Uzbekistan according to appendix No. 2;

Regulations on the State labor inspection of the Ministry of employment and employment relationships of the Republic of Uzbekistan according to appendix No. 3;

structures of the State labor inspection of the Ministry of employment and employment relationships of the Republic of Uzbekistan, the Ministry of employment and employment relationships of the Republic of Karakalpakstan, head departments of employment of areas and the city of Tashkent according to appendices No. 4, 4a and 4b.

2. Determine that:

the solutions of the State labor inspection of the Ministry of employment and employment relationships of the Republic of Uzbekistan (further - Inspection) accepted within its competence concerning compliance with law about work, employment of the population, labor protection, obligatory civil liability insurance of the employer and the legislation on social security of persons with disability regarding creation of working conditions to persons with disability for easy access to objects of social infrastructure and also for use of all modes of transport, transport communications, means of communication public and information, are obligatory for execution of the public and economic board by bodies, public authorities on places and other organizations, and also the physical persons which are employers;

conducting short-term checks by employees of Inspectorate, including employees engagement of Inspection to the inspections which are carried out by state bodies is performed based on the order of the head of relevant organ on work, with registration in the departmental electronic information system "Monitoring of Verifications of the Labor Law";

state bodies are forbidden to assign to the employees of Inspectorate performance of works who are not entering their competence.

3. To the ministry of employment and employment relationships of the Republic of Uzbekistan:

in two-month time to develop and implement the departmental electronic information system "Monitoring of Verifications of the Labor Law", having provided attraction as source of financing of its development, implementation and technical maintenance of means of the State fund of assistance of employment of the Republic of Uzbekistan;

till April 1, 2019 to carry out certification of heads and employees of bodies for work and the organizations which are a part of the system of the Ministry of employment and employment relationships of the Republic of Uzbekistan, the abolished State legal inspection of work and the State inspectorate for protection and examination of working conditions on compliance of post and to take measures for completion of Inspection and its territorial subdivisions by the qualified personnel capable at the high professional level to provide accomplishment of the assigned tasks.

4. Grant the right to the minister of employment and employment relationships of the Republic of Uzbekistan to make changes to the number of staff of inspectors on employment of the district (city) centers of assistance of employment of the population (production personnel), proceeding from the situation which is really developing in the labor market and requirement, and also to structure of Inspection within the established total number and the salary fund.

5. Allocate to the Ministry of employment and employment relationships of the Republic of Uzbekistan limit for acquisition for central office of Inspection and its territorial subdivisions of automobile vehicles in number of 15 units and their content at the expense of the saved means of the State fund of assistance of employment of the Republic of Uzbekistan.

6. Transfer to the Ministry of employment and employment relationships of the Republic of Uzbekistan on the right of operational management of the building and construction of Sergeliysky professional college of light industry and service with the adjacent territory, at the address: the city of Tashkent, Sergeliysky district, Ulitsa Lutfikor, 33, for placement of Republican professional development course of employees of bodies for work.

7. To provide to the ministry of the higher and secondary vocational education of the Republic of Uzbekistan:

completion of the training of pupils of 3 rates transferred to the Ministry of employment and employment relationships of the Republic of Uzbekistan of Sergeliysky professional college of light industry and service till September 1, 2019 with their inclusion in school enrollment of nearby professional colleges with the similar directions of training;

together with the Center of professional education of the Ministry of the higher and secondary vocational education of the Republic of Uzbekistan in a month transfer, and to the Ministry of employment and employment relationships of the Republic of Uzbekistan acceptance of the above-stated buildings and constructions with the adjacent territory and their target use.

8. Accept the offer of the Ministry of employment and employment relationships of the Republic of Uzbekistan on reshaping of the 2nd Tashkent legal college which is under authority of the ministry in the Tashkent college of personnel management and labor protection, with preserving till September 1, 2020 school enrollment and issue by it upon completion of training of diplomas of the Tashkent college of personnel management and labor protection.

Determine source of financing of activities of the Tashkent college of personnel management and labor protection of means of the State fund of assistance of employment of the Republic of Uzbekistan.

9. To the ministry of employment and employment relationships of the Republic of Uzbekistan:

in two-month time together with the Ministry of the higher and secondary vocational education of the Republic of Uzbekistan to provide development of new training programs in the new directions and specialties of the Tashkent college of personnel management and labor protection, and also regulations on assessment of knowledge of pupils of college, final state assessment and passing of practice by them;

grant the right to render by fund of work incentives of workers and strengthening of material and technical resources of bodies for work financial support to the departmental organizations, including off-budget funds, for establishment to their workers of monthly allowances according to the procedure, provided for employees of bodies for work.

10. Determine the Ministry of employment and employment relationships of the Republic of Uzbekistan authorized body by coordination and methodical providing security services of work in the organizations, irrespective of their forms of business.

11. Determine that:

candidates in case of employment without fail go to territorial administrations of employment and the district (city) centers of assistance of employment of the population week, and employees of bodies for work - on regular basis, at least once in three years professional development course based on Republican professional development course of employees of bodies for work;

workers and teachers of Republican professional development course of employees of bodies for work and the Tashkent college of personnel management and labor protection under the terms of compensation are equated to workers and teachers of the highest educational institutions of the republic;

employees of Republican scientific center of employment and labor protection are equated under the terms of compensation to scientific and leading employees of the research establishments participating in implementation of scientific and technical programs of basic, applied researches and innovative works.

12. Approve Regulations on procedure for creation and the organization of activities of security service of work in the organizations according to appendix No. 5.

13. To the ministry of employment and employment relationships of the Republic of Uzbekistan in two-month time:

a) to critically review activities of Republican professional development course of employees of bodies for work, including questions:

the organizations of development of the updated curricula and programs providing widespread introduction of progressive methods of interactive training with use of the methods "case-study", "team-work presentation", the business games directed to discussion and search of optimal solutions of specific problems which bodies for work in the activities face;

completions of Republican professional development course of bodies for work by skilled workers and teachers;

developments and approvals of structure and charter of Republican professional development course of bodies for work;

b) develop and approve procedure for functioning and implement the electronic information system "Monitoring of Verifications of the Labor Law" in practice;

c) make in the Cabinet of Ministers of the Republic of Uzbekistan offers on creation on the basis of public-private partnership of the new popular scientific magazine "Labor economics" including content about labor market researches, questions of labor protection and protection of labor rights, employment, trainings and estimates of professional competences, employment standards and compensation.

14. To the ministry of national education of the Republic of Uzbekistan together with the Ministry of employment and employment relationships of the Republic of Uzbekistan to include in the training program on discipline "Professional education" for the 11th classes of comprehensive schools the subject "Development of Personal Skills of Competitiveness in the Labor Market" directed to professional orientation, training in bases of the labor law, to skills of search of suitable vacancies in the labor market, preparation of the summary and for interview with the employer, document creations for employment within the basic curriculum of general secondary education.

15. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 6.

16. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 7.

17. To impose control of execution of this resolution on the deputy prime minister - the Minister of Finance of the Republic of Uzbekistan D. A. Kuchkarov and the minister of employment and employment relationships of the Republic of Uzbekistan Sh. D. Kudbiyev.

Regulations on the Ministry of employment and employment relationships of the Republic of Uzbekistan

Chapter 1. General provisions

1. The ministry of employment and employment relationships of the Republic of Uzbekistan (further - the Ministry) is the state body enabling the realization of single policy in the sphere of employment of the population, labor migration and employment relationships and in the activities is accountable to the Cabinet of Ministers of the Republic of Uzbekistan.

2. The ministry in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, and also this Provision and other acts of the legislation.

3. The decisions of the Ministry made within its powers are obligatory for execution of the public and economic board by bodies, executive bodies on places, other organizations and their officials, and also citizens.

4. The ministry, territorial and subordinated subdivisions entering organizational structure of the Ministry are legal entities, have seal and forms with the image of the State Emblem of the Republic of Uzbekistan, separate balance, treasurer personal accounts, bank accounts, including in foreign currency.

The ministry of employment and employment relationships of the Republic of Karakalpakstan, head departments of employment of areas and Tashkent, and also the district (city) centers of assistance of employment of the population submit and are accountable to the Ministry and, respectively, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent, and also areas (cities).

8. The ministry when implementing the tasks and functions interacts with other bodies of the public and economic board, public authorities on places and other organizations.

Chapter 3. Tasks and functions of the Ministry, Ministry of employment and employment relationships of the Republic of Karakalpakstan, head departments of employment of areas and Tashkent, district (city) centers of assistance of employment of the population

§ 1. Tasks and functions of the Ministry

9. The main objectives of activities of the Ministry and its territorial subdivisions are:

implementation on the basis of the careful analysis of actual state of the labor market by regions of the country of complex of the target measures aimed at employment of the population by development and efficient coordination of implementation of territorial and industry programs of employment of the population, establishment of the state order on creation of new workplaces and quotas for employment of socially vulnerable segments of the population;

ensuring employment of the unemployed who addressed to bodies for work, attraction of the population to participation in social jobs, first of all within implementation of large investment projects, implementation of construction, repair and reconstruction of objects of road and housing-and-municipal infrastructure, improvement of the cities and areas, seasonal agricultural works;

cardinal enhancement of system of professional training, retraining and advanced training of persons needing employment, especially unoccupied youth, persons with disability and the unemployed proceeding from real requirements of industries of economy and the labor market;

realization together with other ministries, departments and bodies of economic board of measures for ensuring employment of graduates of comprehensive schools, the highest and average special educational institutions according to the specialties received by them;

development and implementation of the regulatory legal acts corresponding to market conditions in the sphere of regulation of the labor market, employment, employment relationships, labor protections, professional and employment standards, ensuring compliance with gender equality, professional training and retraining of the unoccupied population, social protection of the unemployed, and also control of the course of their execution;

active implementation of the advanced information technologies in employment processes, including creation and constant development of the Program complex "Single National System of Work" and National base of vacancies;

creation of modern infrastructure and competitive environment in the market of services in employment assistance, forming of effective mechanisms of interaction of bodies of the public and economic board, public authorities on places, educational institutions, non-state non-profit organizations, subjects of entrepreneurship, self-government institutions of citizens and the public in questions of employment of the population;

ensuring control and supervision of observance of requirements of the legislation in the field of labor protection and employment, implementation of examination of working conditions, realization of specific measures for further enhancement of employment relationships, mechanisms of material work incentives;

regulation and compensation, implementation of employment standards and enhancement of employment relationships;

adjustment and strengthening international cooperation in the sphere of work, employment, labor protection and labor migration;

carrying out broad information and explanatory work among the population and employers concerning labor rights and labor protection;

implementation of monitoring of timely allowance payment and financial support to needy families, with development of individual programs for conclusion of families from low-security by rendering to them assistance in employment and activization of private business activity of able-bodied members of families;

coordination and methodical ensuring activities of security services of work of the organizations;

rendering assistance to citizens of the Republic of Uzbekistan in employment abroad, their homecoming, legal and social protection during implementation of labor activity abroad, and also implementation of issue of permissions to attraction of foreign labor power and confirmations on the right of labor activity to foreign citizens in the territory of the Republic of Uzbekistan.

10. The ministry according to the tasks assigned to it performs the following functions:

1) concerning development of complex of the target measures aimed at employment of the population, establishment of the state order on creation of new workplaces and quotas for employment of socially vulnerable segments of the population:

together with the Ministry of Economics of the Republic of Uzbekistan, proceeding from the purposes and priorities of the performed transformations in society, will organize and coordinates work of bodies of the public and economic board, public authorities on places, research institutions regarding development of strategy for employment of the population and sustainable development of the labor market on the basis of modern market mechanisms and tools;

together with the Ministry of Economics of the Republic of Uzbekistan and the State committee of the Republic of Uzbekistan according to the statistics, proceeding from forecasts of demographic and economic development of the republic and the territories, develops reasonable forecast parameters of balances of manpower, and also complex measures for effective employment of the population;

will organize accounting of jobless citizens and the unoccupied population needing employment;

will organize together with accounting of the citizens occupied with family entrepreneurship and mechanical activities, working in personal subsidiary farms, in the sphere of livestock production, crop production, poultry farming, fish breeding, other types of agricultural activities in the personal subsidiary and Dehkan farms occupied with the temporary one-time and seasonal works without execution of the employment or civil contract interested in state bodies and other organizations;

carries out the analysis of number and structure of manpower of the republic and administrative-territorial educations, develops offers on their enhancement;

together with the research organizations conducts social researches for detection of professional preferences and labor orientation of youth and the unoccupied population;

coordinates activities of public authorities on places on establishment of quotas (the minimum number of workplaces) for employment of persons not capable to compete on equal terms in the labor market, and provides control of allocation by employers of the determined number of workplaces for their employment;

provides one-time subsidies to the organizations which employed persons from among socially vulnerable segments of the population, including persons with disability over established the reserved minimum quantity (quota), on condition of preserving employment the employed persons of this category within at least 12 months from the date of excess of the minimum quantity (quota);

carries out studying and the analysis of questions of allocation of the minimum quantity of workplaces in the organizations and acceptances on these places of persons belonging to the separate categories of the population experiencing difficulties in job search and not capable on equal terms to compete in the labor market, develops offers on establishment for the organizations of quotas for employment of such persons;

performs the analysis of market development of work for the purpose of providing the most complete and objective assessment of level and structure of employment of the population, identification of the available structural disproportions in the labor market and the reasons of their origin, determination of persons needing employment and on this basis creates annual orders for creation of new workplaces by industries and the territories;

carries out the analysis of labor force mobility and labor migratory processes, establishes the reasons and factors of external labor migration;

will organize collection and the analysis of data on vacant workplaces, records the vacancies provided in accordance with the established procedure and brings information on free workplaces to the population with use of information and communication technologies;

performs system monitoring and the analysis of processes of creation of workplaces, employments of the population and market situation of work and on this basis develops effective measures of employment increase of the population;

performs the analysis of level and structure of unemployment and informal employment, including by carrying out inspections of employment of the population and holding polls among the population and employers;

will organize forming and complex information analysis about employment and employment of the population, including youth, women, persons with disability, released workers and other categories of the population;

together with the interested ministries and departments, and also executive bodies on places provides system coordination of development and implementation of territorial and industry programs of employment of the population for development of effective work arrangements;

together with the Ministry of Economics of the Republic of Uzbekistan performs forming of the state order on creation of workplaces on short-term (one year), medium-term (two - three years) and long-term (more than three years) the periods, interconnected with programs of structural transformations and diversifications of economy, comprehensive programs of social and economic development of the territories;

together with public authorities on places develops and approves programs for assistance to employment of the unemployed, youth, first of all graduates of the highest and average special, professional educational institutions, and also other socially vulnerable categories of the population by the organization and holding specialized fairs of workplaces, improvement of quality and availability of the services rendered by bodies for work to the population and employers;

together with the Ministry of Economics and the Ministry of the higher and secondary vocational education of the Republic of Uzbekistan on the basis of forecast parameters of balances of manpower creates the state order on training of specialists in the directions of the higher and professional education by the territories and industries of economy;

coordinates development of target programs for creation of workplaces in regions with intense situation in the labor market and together with the interested ministries, the state committees and departments, executive bodies on places participates in their development;

coordinates development of target territorial programs of employment and social protection of the workers released during reforming and structural transformations of economy and also as a result of reorganization, bankruptcy and liquidation of the organizations;

gives methodical and practical help to executive bodies on places in development of territorial programs of employment and creation of workplaces;

together with the interested ministries and departments, executive bodies on places, commercial banks develops and realizes target programs for economic support and stimulation of persons wishing to organize own business including graduates of educational institutions;

2) concerning ensuring employment of the unemployed who addressed to bodies for work, attraction of the population to participation in social jobs, first of all within implementation of large investment projects, implementation of construction, repair and reconstruction of objects of road and housing-and-municipal infrastructure, improvement of the cities and areas, seasonal agricultural works:
