About approval of standards of the state services in the field of communication

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve the following standards of the state services:

1) the standard of the state service "Licensing for Provision of Services in the field of Communication" according to appendix 1 to this order;

2) the standard of the state service "Distribution of Resource of Numbering and Allocation of Numbers, and also Their Withdrawal" according to appendix 2 to this order;

3) the standard of the state service "Issue, Cancellation, Prolongation and Renewal of Permission to Use of Radio-frequency Range of the Republic of Kazakhstan" according to appendix 3 to this order;

4) the standard of the state service "Issue of the Conclusions on Import to the Territory of the Republic of Kazakhstan of the Radio-electronic Means and High-frequency Devices of Civil Appointment including Which Are Built in or Being Part of Other Goods in the Cases Other than Import and (or) Licensing for Their Import" according to appendix 4 to this order.

2. Recognize invalid some orders according to appendix 5 to this order.

3. To provide to committee of telecommunications of the Ministry of information and communications of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of information and communications of the Republic of Kazakhstan;

4) within ten working days after state registration of this order submission to Legal department of the Ministry of information and communications of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of information and communications of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Appendix 1

Standard of the state service "Licensing for Provision of Services in the field of Communication"

Chapter 1. General provisions

1. The state service "Licensing for Provision of Services in the field of Communication" (further - the state service).

2. The standard of the state service is developed by the Ministry of information and communications of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears Committee of telecommunications the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service is performed by the service provider through the web portal of "the electronic government": www.egov.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. Terms of rendering the state service constitute from the moment of the address through the portal:

licensing and (or) appendices to the license - 5 (five) working days;

renewal of the license and (or) appendix to the license - 3 (three) working days;

renewal of the license and (or) appendix to the license by reorganization of legal person licensee, in case of confirmation of conformity to the qualification requirements imposed when licensing - 10 (ten) working days;

issue of duplicates of the license and (or) appendix to the license - 2 (two) working days.

5. Form of rendering the state service: electronic.

7. The state service is rendered on paid basis to physical persons and legal entities (further - uslugopoluchatel). In case of issue of appendices to the license (duplicates of appendices to the license) the license fee is not levied.

When rendering the state service in the location of uslugopoluchatel the license fee is paid for the occupation right by separate types of activity:

1) the license fee when licensing for the occupation right this type of activity constitutes 6 monthly settlement indicators (further - MRP);

2) the license fee for renewal of the license constitutes 10% of rate when licensing, but no more than 4 monthly settlement indicators (further - MRP).

3) the license fee for issue of the duplicate of the license constitutes 100% of rate when licensing.

Payment is performed in cash and non-cash form through the banks of the second level and the organization performing separate types of banking activities.

Payment can, is performed through payment gateway of "the electronic government" (further - PShEP).

8. the document confirming payment of the license fee for the occupation right with separate types of activity in the form of the electronic copy of the document, except as specified payments through PShEP;

2) for receipt of appendix to the license within type of activity on which there is license:

request in electronic form, the uslugopoluchatel certified by the EDS;

10. The bases for refusal in rendering the state service are:

1) occupation type of activity is forbidden by the laws of the Republic of Kazakhstan for this category of physical persons or legal entities;

2) not introduction of the license fee;

3) not compliance of the applicant to qualification requirements;

4) availability concerning the applicant of the decision (sentence) of court on suspension or prohibition of activities or the separate types of activity which are subject to licensing took legal effect.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials concerning rendering the state service

11. 12. In disagreement cases with results of the rendered state service, the uslugopoluchatel takes a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

1) Internet resource of the Ministry - www.mic.gov.kz;

2) portal.

14. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also single contact center concerning rendering the state services.
