Article 1. General provisions

This Federal Law determines features of legal status, the main objectives and powers of the Comissioner for the President of the Russian Federation by the child's rights (further - the Representative), and also bases of legal status of Ombudsmen for Children in subjects of the Russian Federation.

Article 2. Activities of the Representative

1. Activities of the Representative are aimed at providing guarantees of the state protection of the rights and legitimate interests of children, realization and observance of the rights and legitimate interests of children by state bodies, local government bodies and officials.

2. The representative helps:

1) to recovery of the violated the rights and legitimate interests of children;

2) to enhancement of the legislation of the Russian Federation in the part concerning protection of the rights and legitimate interests of children;

3) to development of international cooperation in the field of protection of the rights and legitimate interests of children;

4) to enhancement of forms and methods of protection of the rights and legitimate interests of children.

3. Activities of the Representative supplement the existing remedies of the rights and legitimate interests of children, do not cancel powers of the state bodies providing protection and recovery violated the rights and legitimate interests of children, and do not involve review of such powers.

Article 3. Position assignment of the Representative. Termination of powers of the Representative

1. The representative is appointed to position by the President of the Russian Federation for a period of five years. The same person cannot be appointed the Representative more than to two terms in a row.

Article 4. Requirements to the Representative

3. Requirements, the restrictions and prohibitions established by the Federal Law of December 25, 2008 No. 273-FZ "About anti-corruption" concerning persons replacing the state positions of the Russian Federation extend to the Representative.

4. The representative shall stop activities, incompatible with its status, within fourteen days from the date of position assignment.

Article 5. Main objectives of the Representative

The main objectives of the Representative are:

1) ensuring protection of the rights and legitimate interests of the children who are citizens of the Russian Federation, in the territory of the Russian Federation and in the territories of foreign states, the children who are foreign citizens or stateless persons, in the territory of the Russian Federation in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation;

2) assistance to forming and effective functioning of the state system of ensuring realization, observance and protection of the rights and legitimate interests of children by state bodies, local government bodies and officials;

3) monitoring and efficiency analysis of functioning of mechanisms of realization, observance and protection of the rights and legitimate interests of children the federal executive bodies, public authorities of subjects of the Russian Federation, local government bodies, the educational and medical organizations, the organizations rendering social and other services to children and the families having children and officials;

4) participation in forming and realization of single state policy in the field of providing and protection of the rights and legitimate interests of children, including participation in activities of the coordinating bodies created for the purpose of realization of the specified state policy and also preparation and the direction to the President of the Russian Federation and in the Government of the Russian Federation of relevant proposals;

5) the prevention of violation of the rights and legitimate interests of children, assistance to recovery of the violated the rights and legitimate interests of children;

6) participation in activities for prevention of neglect and offenses of minors;

7) assistance to development of international cooperation in the field of protection of the rights and legitimate interests of children.

Article 6. Powers of the Representative

1. The representative for the purpose of realization of the tasks assigned to him:

Sends 1) to the state bodies having the right to the address to the Constitutional Court of the Russian Federation, motivated offers within the competence on the address to the Constitutional Court of the Russian Federation with request about compliance of the Constitution of the Russian Federation of the Federal Laws, other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation;

2) sends to senators of the Russian Federation, deputies of the State Duma of Federal Assembly of the Russian Federation, to legislative (representative) public authorities of subjects of the Russian Federation, to other persons of law of the legislative initiative motivated offers on adoption of legal acts, on entering into legal acts of the changes aimed at providing realization and observance of the rights and legitimate interests of children;

3) sends to heads of federal executive bodies, public authorities of subjects of the Russian Federation, other state bodies, local government bodies motivated offers on recognition invalid or suspension of action of legal acts and decisions in cases if these acts and decisions violate the rights and legitimate interests of children, or about entering into these acts and solutions of the changes aimed at providing realization and observance of the rights and legitimate interests of children;
