About Regulations on local authorities of military management

1. Approve Regulations on local authorities of military management it (is applied).

2. Declare invalid the order of the Government of the Republic of Tajikistan of May 4, 2000, No. 201 "About approval of the Regulations on local authorities of military management".

Provision about local authorities of military management

1. General provisions

1. The regulations on local authorities of military management (further the Provision) are developed with I aim implementation of article 9 of the Law of the Republic of Tajikistan "About defense" and subordination, tasks, obligations, accountability, providing, and also procedure for their interaction with local executive bodies of the government and self-government institutions of settlements and dekhot determines the basic principles of creation of system of local authorities of military management of the Republic of Tajikistan.

2. In this Provision the following basic concepts are used:

- local authorities of military management - military commissariats of the Gorno-Badakhshan Autonomous Region, Khatlon, Sughd areas, the city of Dushanbe, cities and areas of republican subordination, the zone, city and district military commissariats created by the Ministry of Defence of the Republic of Tajikistan according to the existing administrative-territorial division of the Republic of Tajikistan;

- the device on strengthening of activities of military commissariat number of citizens, necessary quantity for attraction in military commissariats to works on the notification, appeal and sending mobilization reserve to Armed Forces of the Republic of Tajikistan, other troops and military structures;

- base for carrying out mobilization of military commissariat control centers, sites (headquarters) of the notification, assembly points and sendings mobilization reserve, Items of providing fuels and lubricants, Items of heating and food of staff which are provided with necessary controls, communications and notifications, transport, property and equipment.

3. The Ministry of Defence of the Republic of Tajikistan within the established number of staff in Armed Forces of the Republic of Tajikistan creates the following military commissariats:

- military commissariat of the Gorno-Badakhshan Autonomous Region, regional military commissariats, military commissariat of the city of Dushanbe, cities and areas of republican subordination;

- zone, city and district military commissariats.

4. In necessary cases in regions of the Republic of Tajikistan for the purpose of management of several administrative and territorial units zone military commissariats can be created.

5. Proceeding from availability of reserve of the citizens staying on the military registry, regional, zone city to district military commissariats the following categories are established:

Military commissariats in the activities are guided by the Constitution of the Republic of Tajikistan, the constitutional laws, the laws of the Republic of Tajikistan, decrees and orders of the President of the Republic of Tajikistan, resolutions and orders of the Government of the Republic of Tajikistan, this Provision, regulatory legal acts of the Ministry of Defence of the Republic of Tajikistan and the General Staff of Armed Forces of the Republic of Tajikistan.

7. Military commissariats together with local authorities of the government and self-government institutions of settlements and dekhot for the purpose of protection of the constitutional system and defense of the Republic of Tajikistan consider questions of preparation of mobilization reserve, including the citizens who are in inventory and transport of the national economy for needs of Armed Forces of the Republic of Tajikistan, troops and other military forming.

8. The organization of activities of military commissariats is performed by the General Staff of Armed Forces by means of organizationally mobilization management of the General Staff of Armed Forces.

9. The chief of the General Staff of Armed Forces - the First Deputy Minister of Defence of the Republic of Tajikistan is the direct chief of staff of military commissariats and according to the legislation of the Republic of Tajikistan, this Provision and other regulatory legal acts of the Ministry of Defence and General Staff of Armed Forces of the Republic of Tajikistan determines tasks to military commissariats.

10. Military commissioners, other military personnel and the government administrative employees of military commissariats are appointed to positions according to the states approved by the Minister of Defence of the Republic of Tajikistan.

11. Completing of established posts of military commissariats by the military personnel and government administrative employees is performed according to their organizational and regular structure approved by the Minister of Defence of the Republic of Tajikistan.

12. Matching of the military personnel, appointment them to positions in military commissariats, and also their release from positions is performed according to Regulations on procedure for passing of military service. Candidacies of the military personnel for appointment to executive positions in military commissariats are approved with members of board of the Ministry of Defence of the Republic of Tajikistan.

13. To positions of military commissioners of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, the military commissioner of the cities and areas of republican subordination, their deputies, chiefs of departments of military commissariats of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, military commissariat of the cities and areas of republican subordination, military commissioners of the cities and areas experienced officers with the higher military education are appointed.

The officers having the higher military education, graduates of the public institutions of higher education which finished the program for training of reserve officers at military departments of these organizations and also graduates of public institutions of higher education as jurisprudence are appointed to other positions of military commissariats.
