About employment

This Law according to article 35 of the Constitution of the Azerbaijan Republic and Item 1 of part I of article 94 of the Constitution of the Azerbaijan Republic determines legal, economic and organizational basis of state policy in the field of employment assistance, and also the state guarantees in the field of social protection of rabotoiskatel and jobless persons.

Chapter 1. General provisions

Article 1. Basic concepts

1.1. The basic concepts used in this Law express the following values:

1.1.1. active measures of employment - the measures directed to expansion, assistance in job search and self-employment, employment opportunities of rabotoiskatel and jobless persons, ensuring professional orientation, professional training, increase in their knowledge and skills, implementation of special programs for them for the purpose of forming of labor power according to work market requirements;

1.1.2. the labor market - set of the demand and supply of labor power;

1.1.3. the individual program of employment - the document the electronic, determining specific amount, type and duration of execution of the active measures of employment developed for the purpose of assistance to jobless person in employment and return to the labor market;

1.1.4. the individual card of employment - the document electronic, consisting of individual data on rabotoiskatel and the unemployed, including information on education and profession (specialty), employment history, and also information on the offered suitable work and active measures of employment and condition of their execution;

1.1.5. paid social jobs - the socially useful workplaces organized according to this Law for the purpose of providing temporary employment and which are not requiring availability of primary professional education;

1.1.6. jobless person - the able-bodied person of working-age which does not have work and earnings, registered in body (organization), certain relevant organ of the executive authority as the unemployed and ready to get to work.

1.1.7. rabotoiskatel - person who addressed for suitable work and in connection with active actions of employment in the cases provided by this Law in the body (organization) determined by relevant organ of the executive authority, and registered as rabotoiskatel;

1.1.8. quota - the minimum quantity of workplaces (workers) determined by the body (organization) determined by relevant organ of the executive authority for employers for the purpose of employment of the persons needing special social protection, and experiencing difficulties with employment;

1.1.9. informal employment - accomplishment of certain types of activity without execution of an employment agreement (contract) according to the Labor code of the Azerbaijan Republic or the civil agreement according to the Civil code of the Azerbaijan Republic, implementation of business activity and use of the earth suitable for agricultural industry which is in property, without official registration according to the Tax code of the Azerbaijan Republic, and also income acquisition (profits) as a result of the organization of family economy without registration in local government bodies according to the Law of the Azerbaijan Republic "About family peasant economy";

1.1.10. employment - any activities of citizens of the Azerbaijan Republic, foreigners and stateless persons (further - persons) which does not contradict the legislation of the Azerbaijan Republic and brings in the income (profit);

1.1.11. the register of occupied - individual data about occupied, provided in article 4.1 of this Law, set of data on their education, place of employment, position (profession) or the performed work (service);

1.1.12. the bodies exercising control in the sphere of legalization of informal employment - bodies (organizations) determined by relevant organ of the executive authority which performs control measures in the field of identification and prevention of informal employment;

1.1.13. control measures - actions, the stipulated in Article 2.1 Laws of the Azerbaijan Republic "On regulation of the inspections which are carried out in the field of entrepreneurship and protection of interests of entrepreneurs";

1.1.14. temporary employment - involvement of person in seasonal works according to the Labor code of the Azerbaijan Republic, the social jobs paid according to the procedure, established by this Law, or socially useful activities for a certain period of time through employment exchanges;

1.1.15. self-employment - providing with person work independently or with assistance of the state;

1.1.16. professional standards - set of the minimum requirements established by the body (organization) determined by relevant organ of the executive authority to the work content which the worker shall execute on certain area of profession, and working conditions;

1.1.17. professional training - professional education according to the Laws of the Azerbaijan Republic "About education" and "About professional education", taking into account requirements of this Law;

1.1.18. insurance payment - the monthly money paid by the insurer to the insurer in case of the insured event determined by the Law of the Azerbaijan Republic "About insurance by unemployment";

1.1.19. released workers - persons whose employment relationships are stopped in connection with liquidation, reorganization of state body or the legal entity, reducing number of persons employed or states;

1.1.20. the social company - the specialized legal entity created for employment of the persons needing special social protection and experiencing difficulties with employment;

1.1.21. social workplace - workplace which part of the salary is financed by the body (organization) determined by relevant organ of the executive authority for the vacant workplace provided by the employer to vacant bank for the purpose of employment of rabotoiskatel and jobless persons and motivation of employers;

1.1.22. the persons needing special social protection and experiencing difficulties with employment - person with disability, youth up to 20 years, the single and parents having many children raising minor children, the parents raising children with the established disability to 18 years, person who to retirement age remained less than two years, persons exempted from places of serving sentence, displaced persons;
