About approval of the Procedure for rotation of officials of diplomatic service in bodies of diplomatic service

(as amended of the Order of the Ministry of Foreign Affairs of Ukraine of 05.08.2020 No. 292)

According to part three of article 17 of the Law of Ukraine "About diplomatic service" and for the purpose of regulation of implementation of rotation in bodies of diplomatic service I ORDER:

1. Approve the Procedure for rotation of officials of diplomatic service in bodies of diplomatic service which is applied.

2. Declare invalid the order of the Ministry of Foreign Affairs of Ukraine of May 31, 2012 No. 147 "About approval of the Procedure for rotation of employees of diplomatic service in system of bodies of diplomatic service of Ukraine", registered in the Ministry of Justice of Ukraine on June 20, 2012 for No. 1016/21328.

3. To provide to department of management of personnel submission of this order on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of entry into force of the Law of Ukraine "About diplomatic service", but not earlier than day of official publication of this order.

5. To impose control of execution of this order on the State secretary the MFA.

Procedure for rotation of officials of diplomatic service in bodies of diplomatic service

I. General provisions

1. This Procedure determines the basic organizational principles and the procedure of implementation of rotation of officials of diplomatic service (further - officials) in bodies of diplomatic service.

Rotation of officials is performed for the purpose of increase in efficiency of their professional activity and taking into account interests of diplomatic service. Rotation is performed by planned substitution of positions for proper staffing of bodies of diplomatic service, effective use of human resources, ensuring planned character of office career and job development.

Planned substitution of positions of diplomatic service by the prepared officials is implemented in the device the MFA, representations the MFA in the territory of Ukraine and foreign diplomatic organizations of Ukraine (further - ZDU) according to the procedure determined by part one of article 20 of the Law of Ukraine "About diplomatic service" (further - the Law).

2. Action of this Procedure does not extend to officials who are appointed to diplomatic positions by the President of Ukraine.

3. Matching of candidates for carrying out rotation is performed on the principles of competitiveness taking into account office need, appropriate level of professional competence, personal qualities, work experience and results of assessment of office activities.

4. Consideration of candidates for substitution of positions of diplomatic service (further - candidates) is performed by the Tender committee the MFA formed according to the Law of Ukraine "About public service".

5. The decision on transfer of the official to position in bodies of diplomatic service according to the procedure of rotation is made by the State secretary the MFA based on recommendations of the Tender committee the MFA.

6. Appointment, transfer into positions of diplomatic service in bodies of diplomatic service of officials is made based on the Plan of rotation for certain year which affirms the order the MFA signed by the State secretary the MFA (further - the Plan of rotation).

The plan of rotation consists of two parts:

Plan of rotation of ZGU;

The plan of rotation of the device the MFA and representations the MFA in the territory of Ukraine.

7. Professional training to business trip by training in structural divisions of the device precedes the direction in long-term business trip the MFA and post-qualifying education institution - Diplomatic academy of Ukraine of Gennady Udovenko in case of the MFA (further - DAU) according to the procedure, established by Regulations on training of employees of diplomatic service which go to foreign diplomatic organizations of Ukraine, the approved order of the Ministry of Foreign Affairs of Ukraine of October 3, 2017 No. 415, registered in the Ministry of Justice of Ukraine on October 26, 2017 for No. 1313/31181.

II. Preparation and approval of the Plan of rotation of ZGU

1. The direction and response of officials in/from ZGU are performed according to the Plan of rotation of ZGU within certain calendar year.

2. Preparation of the Plan of rotation of ZGU is performed by service of personnel management the MFA on the following stages:

1) determination of the list of the positions which are subject to substitution next year;

2) forming of the draft of the Plan of rotation of ZGU;

3) approval of the Plan of rotation of ZGU.

3. Determination of the list of the positions which are subject to substitution next year is performed on the following stages:

1) forming of the list of officials who are subject to rotation next year, sending before DEPARTURE and generalization of offers on terms of their response;

2) approval by the State secretary MFA of the schedule of response of officials and its bringing to DEPARTURE;

3) acquaintance of officials who are subject to response next year, under list;

4) adjustment of drafts of staff lists ZDU the next year taking into account proposals of their heads and standard staff lists ZGU;

5) approval by the State secretary the MFA of the list of positions which are subject to substitution next year (further - the list of positions of ZGU);

6) acquaintance of officials with the list of positions and submission due date of statements;

7) bringing to other state bodies specified in part one of article 23 of the Law, statements from the list of positions in the part concerning them.

4. Forming of the draft of the Plan of rotation of ZGU is performed on such stages:

1) submission of statements by officials addressed to the State secretary the MFA in service of personnel management the MFA with observance of requirements of part two of article 18 of the Law, and also introduction by heads of ZGU of offers on candidates for substitution of the positions released in ZGU;

2) study of personnel management by service MFA of statements of candidates for substitution of positions for ZGU;

3) forming of the rating candidate list;

4) consideration of candidates Tender committee MFA and introduction of recommendations to the State secretary MFA.
