About approval of the Regulations on procedure of hydrometeorological activities of authorized body in the field of hydrometeorology

According to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", articles 5-1 and 13 of the Law of the Kyrgyz Republic "About hydrometeorological activities in the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on procedure of hydrometeorological activities of authorized body in the field of hydrometeorology according to appendix.

2. This Resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure of hydrometeorological activities of authorized body in the field of hydrometeorology

1. This Provision determines procedure of hydrometeorological activities of authorized body in the field of hydrometeorology which includes maintaining by authorized body in the field of hydrometeorology of the State hydrometeorological register of producers (physical persons and legal entity) of hydrometeorological information (further - the State register); determines procedure for provision by physical persons and legal entities of hydrometeorological information of results of observations of state of environment and information products, and also determines procedure of hydrometeorological activities of authorized body in the field of hydrometeorology with the departmental hydrometeorological organizations and services, legal entities and physical persons.

2. The departmental hydrometeorological organizations and services, legal entities and physical persons performing hydrometeorological activities have the right to conduct hydrometeorological observations and observations of state of environment only for office use. Release of different type of information and prognostic products, and also its distribution are not allowed.

3. Producers of hydrometeorological information (the departmental hydrometeorological organizations and services, legal entities and physical persons performing hydrometeorological activities) which are not entering into the Public hydrometeorological service undergo state registration of producers of hydrometeorological information in authorized body in the field of hydrometeorology (in the State register).

4. Producers of hydrometeorological information provide data of primary observations in authorized body in the field of hydrometeorology gratuitously in the format provided by the World Meteorological Organization which is registered in the State register.

The hydrometeorological information provided by producers of information is provided in authorized body in the field of hydrometeorology for the purpose of forming of the state hydrometeorological fund.

5. The authorized body in the field of hydrometeorology performs maintaining the state register electronically according to appendix to this Provision.

6. For registration in the State hydrometeorological register the physical persons and legal entities performing hydrometeorological observations and monitoring of the environment need to file in authorized body on hydrometeorology the written application, application of copies of technical data sheet on the equipment, the certificate of conformity (quality) and other necessary documents.

Responsibility for reliability of the provided information is born by the applicant.

Term of registration of producer of hydrometeorological information 1 year.

Registration can be prolonged for one year based on the written application of the producer of hydrometeorological information.

7. The statement and documents attached to it are considered by the commission of authorized body in the field of hydrometeorology on registration of producers of hydrometeorological information in the State register of producers of hydrometeorological information (further - the Commission).

8. The decision on registration or on refusal in registration of the applicant in the State register is accepted by the Commission and is drawn up by the protocol which affirms the head of authorized body in the field of hydrometeorology.

The structure of the Commission affirms the head of authorized body in the field of hydrometeorology (director). Shall be part of the Commission: head of department of hydrometeorological observations, forecasts and providing with information, head of department of the state system of observations, head of department of telecommunications and information technologies, head of marketing department, chief of mounting and operational department and other responsible persons of the Agency of hydrometeorology of the Ministry of emergency situations of the Kyrgyz Republic.

The basis for refusal in registration in the State register is discrepancy specified in the list of works and services enclosed to the application to the works and services constituting production of hydrometeorological information.

9. After decision making about registration of the applicant in the State register register (registration) number is assigned to it.

10. The producer of hydrometeorological information in case of violation of requirements of regulatory legal acts and (or) technical regulatory legal acts by it in the field of hydrometeorological activities, and (or) non-presentation of hydrometeorological information by it can be excluded from the State register.

The basis for exception of the State register also is the statement of the producer of hydrometeorological information on intention to stop it performance of works and rendering the services constituting production of hydrometeorological information.

11. Data of hydrometeorological monitoring and observations of the environment acquire legal force from the moment of registration of physical persons and legal entities in the state hydrometeorological register on implementation of observations in the field of hydrometeorology and the environment.
