About alternative types of fuel
This Law determines legal, social, economic, ecological and organizational basis of production (production) and use of alternative types of fuel, and also stimulation of increase in share of their use up to 20 percent from the total amount of consumption of fuel in Ukraine till 2020.
In this Law the terms below are used in the following value:
alternative types of fuel - solid, liquid and gas fuel which is alternative to the corresponding traditional types of fuel and which is made (is extracted) from unconventional sources and types of energy raw materials;
waste - slags and waste of the industry, agricultural industry, household and other companies which can be source or raw materials for production or production of alternative types of fuel;
unconventional sources and types of energy raw materials - phytogenesis raw materials, waste, solid combustible substances, other natural and artificial sources and types of energy raw materials, including oil, gas, gas-condensate and oil-gas condensate exhausted, nonindustrial value and technogenic fields, heavy grades of oil, natural bitumens, gas-saturated waters, gas hydrates, etc., production (production) and which conversion requires use of the latest technologies and which are not used for production (production) of traditional types of fuel;
consumers of alternative types of fuel - the physical persons and legal entities using technical means, including the internal combustion engines, boiler aggregates, furnaces, other energy aggregates, installations and machines working fully or partially at alternative types of fuel;
the sphere of alternative types of fuel - the field of activity connected with production (production), transportation, storage and consumption of alternative types of fuel.
species of fuel (biofuel) - the solid, liquid and gas fuel made of biologically recovery raw materials (biomass) which can be used as fuel or component of other types of fuel;
biocomponent - biofuel which is used as component of other types of fuel;
biomass – not fossil, biologically renewable substance of organic origin capable to biological decomposition, in the form of products, waste and remaining balance of forest and agricultural industry (crop production and livestock production), fishery and technology related industries, and also the component of industrial or household wastes capable to biological decomposition;
bioethanol - the alcohol ethyl dehydrated, made of biomass or alcohol ethyl - raw for use as biofuels;
biobutanol - alcohol butyl, made of biomass which is used as biofuel or biocomponent;
biogas - the gas received from biomass which is used as fuel;
biohydrogen - the hydrogen received from biomass and which is one of biogas types;
biomethane - biogas which meets the requirements of regulatory legal acts to natural gas for giving in gas-transport or gas-distribution system for the physical and chemical characteristics or for use as motor fuel;
the biomethane origin guarantee - the document created by means of the register of biomethane which confirms that biomethane is made from biomass and contains information on amount of biomethane which is given to gas-transport or gas-distribution system, and also other information which list is provided by Procedure for functioning of the register of biomethane;
the certificate of origin of biomethane - the document created by means of the register of biomethane which confirms that biomethane is made from biomass and contains information on cancellation of guarantee of origin of biomethane, and also other information which list is provided by Procedure for functioning of the register of biomethane
producer of biofuel - business entity which directly makes biofuel from biomass;
additives on the basis of bioethanol - the biocomponents of motor fuel received by synthesis using bioethanol or mixing of bioethanol with the organic compounds and fuel received from hydrocarbonic raw materials in which content of bioethanol meets the requirements of regulatory legal acts and which belong to biofuel;
liquid fuel from biomass - biofuel diesel, the bioethanol, biobutanol, net oil and other synthetic fuel made of biomass;
synthetic biofuels - the synthetic hydrocarbons and mixes of synthetic hydrocarbons made of biomass;
solid biofuel - solid biomass which is used as boiler and oven fuel, including firewood, peat, sawdust, the chips, straw, other agricultural waste, granules and briquettes made from biomass, charcoal and carbonaceous substance.
The basic principles of state policy in the field of alternative types of fuel are:
assistance to development and rational use of unconventional sources and types of energy raw materials for production (production) of alternative types of fuel for the purpose of economy of fuel and energy resources and reduction of dependence of Ukraine on their import;
step-by-step increase in normative certain share of production and use of biofuel and smesevy fuel motor. Content of bioethanol in gasolines motor which are made and/or implemented in the territory of Ukraine will constitute:
in 2013 - recommended content at least 5 percent (volume);
in 2014-2015 - obligatory content at least 5 percent (volume);
since 2016 - obligatory content at least 7 percent (volume);
reduction of harmful effects on state of environment due to use as raw materials for production of alternative types of fuel of any waste of activities, observance of ecological safety of production (production), transportation, storage and consumption of alternative types of fuel;
support of development of scientific and technical base of production (production) of alternative types of fuel, promotion of scientific and technical achievements in this sphere;
support of entrepreneurship in the field of alternative types of fuel on the basis of the state protection of interests of the entrepreneur;
promotion among the population of economic, ecological, social and other benefits of production (production) and consumption of alternative types of fuel;
development of the international sci-tech cooperation, wide use of opportunities of world science and technology in the field of alternative types of fuel;
the prevention of artificial creation of monopolies in the market of alternative types of fuel, and in case of recognition in the procedure for natural monopolies established by the legislation control of their activities, non-admission of monopoly abuses and restriction of monopolism if need of such restriction is not established by the legislation.
Fuel is determined alternative if it:
completely made (got) of the nonconventional and updated sources and types of energy raw materials (including biomass) or is mix of traditional fuel with alternative which content shall answer technical standard rates of motor fuel;
