About the technological documents regulating information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union"

According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix № 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of November 6, 2014 № 200, the Board of the Eurasian economic commission decided:

1. Approve enclosed:

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union";

Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union";

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union";

Procedure for accession to general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union".

2. This Decision becomes effective after 30 calendar days from the date of its official publication, but not earlier than the date of entry into force of the Agreement on movement of ozone-depleting substances and products containing them and accounting of ozone-depleting substances when implementing mutual trade of state members of the Eurasian Economic Union of May 29, 2015.

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union"

I. General provisions

1. These rules are developed according to the following acts incoming the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The agreement on movement of ozone-depleting substances and products containing them and accounting of ozone-depleting substances when implementing mutual trade of state members of the Eurasian Economic Union of May 29, 2015;

The decision of Board of the Eurasian economic commission of August 16, 2012 No. 134 "About regulatory legal acts in the field of non-tariff regulation";

The decision of Board of the Euroasian economic commission of November 6, 2014 No. 200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 No. 5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 28, 2015 No. 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and the Eurasian economic commission".

II. Scope

2. These rules are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union" (further – general process), including the description of the procedures performed within this general process.

3. These rules are applied by participants of general process in case of control of execution order of procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"the conclusion (the allowing document)" – the document confirming the right to movement of ozone-depleting substances and products containing them;

"condition of information object of general process" – property which characterizes information object at certain stage of accomplishment of the procedure of general process and which changes in case of accomplishment of transactions of general process.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 No. 63.

IV. Main data on general process

5. Full name of general process: "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union".

6. Specification symbol of general process: P.LL.06, version 1.0.0.

1. Purpose and tasks of general process

7. The purpose of general process is increase in efficiency of control concerning import and export of ozone-depleting substances and products containing them due to enhancement of mechanisms of information exchange between authorized bodies of state members of the Union (further – state members).

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the automated exchange of the data necessary for control of import and (or) export of ozone-depleting substances and products containing them, between authorized bodies of state members with use of the integrated information system of the Eurasian Economic Union according to the international treaties and acts constituting the right of the Union;

b) provide application of the unified structures of the electronic documents and data constructed on the basis of use of general data model of the integrated information system of the Eurasian Economic Union;

c) provide use of state members of single system of normative reference information of the Union by authorized bodies.

2. Participants of general process

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of information support of control of issue of the conclusions (allowing documents);

b) procedures of submission of data on need of the termination of issue of the conclusions (allowing documents);

c) procedures of submission of data on the issued conclusions (allowing documents) on demand;

d) procedures of ensuring production control and movement of ozone-depleting substances and products containing them.

11. In case of performing procedures of general process, the procedures of information support of control of issue of the conclusions (allowing documents) incoming group, exchange of the data necessary for control of import and (or) export of ozone-depleting substances and products containing them is performed.

In case of accomplishment of the specified procedures the following actions are performed:

a) submission of data on the issued conclusion (the allowing document);

b) submission of data on the cancelled conclusion (the allowing document).

In case of performing procedures of general process, the procedures of submission of data on need of the termination of issue of the conclusions (allowing documents) incoming group, the authorized body representing data sends to the competent authority accepting data, other state member of the data on need of the termination of issue of the conclusions (allowing documents).

In case of performing procedures of general process, the procedures of submission of data on the issued conclusions (allowing documents) incoming group on demand, the competent authority representing data represents data on the issued conclusions (allowing documents) at the request of the competent authority accepting data.

In case of performing procedures of general process, the procedures of ensuring production control and movement of ozone-depleting substances incoming group and products containing them, the applicant goes to the competent authority representing data, request for receipt of the conclusion (the allowing document).

Submission of the specified data is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union", the approved Decision of Board of the Eurasian economic commission of December 11, 2018 No. 201 (further – Regulations of information exchange). The format and structure of the represented data shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving ozone-depleting substances and products containing them when implementing mutual trade within the Eurasian Economic Union", to No. 201 approved by the Decision of Board of the Eurasian economic commission of December 11, 2018 (further – the Description of formats and structures of electronic documents and data).

12. The provided structure declaration of general process is provided in the figure 1.

13. The execution order of the procedures of general process grouped according to the destination including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing communications between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language – Unified Modeling Language) and supplied with the text description.

4. Group of procedures of information support of control of issue of the conclusions (allowing documents)

15. In case of control of issue of the conclusions (allowing documents) the competent authority representing data creates and sends data on the issued conclusion (the allowing document) to the competent authority accepting data. At the same time the "Submission of Data on the Issued Conclusion (the Allowing Document)" procedure is performed (P.LL.06.PRC.001).

In case of cancellation of data on the conclusion (the allowing document) issued earlier, the competent authority representing data creates and sends data on cancellation of the conclusion (the allowing document) issued earlier to the competent authority accepting data. At the same time the "Submission of Data on the Cancelled Conclusion (the Allowing Document)" procedure is performed (P.LL.06.PRC.002).

5. Group of procedures of submission of data on need of the termination of issue of the conclusions (allowing documents)

18. In case of achievement in state member of settlement level of consumption of ozone-depleting substances, the authorized body representing data creates and sends to the competent authority representing data, other state member of the data on need of the termination of issue of the conclusions (allowing documents) for export of ozone-depleting substances and products containing them. At the same time the "Submission of Data on Need of the Termination of Issue of the Conclusions (Allowing Documents)" procedure is performed (P.LL.06.PRC.003).

6. Group of procedures of submission of data on the issued conclusions (allowing documents) on demand

21. Accomplishment of the procedure of submission of data on the issued conclusions (allowing documents) at the request of the competent authority accepting data is performed in case of absence in the competent authority accepting data of data about the issued competent authority representing data, the conclusions (allowing documents).

In case of need of receipt of data on the issued conclusions (allowing documents) the competent authority accepting data sends to the competent authority representing data, request for submission of data on the issued conclusions (allowing documents). At the same time the "Request of Data on the Issued Conclusions (Allowing Documents)" procedure is performed (P.LL.06.PRC.004).

7. Group of procedures of ensuring production control and movement of ozone-depleting substances and products containing them

24. When obtaining by the competent authority representing data, data for receipt of the conclusion (the allowing document) from the applicant the "Submission of Data for Receipt of the Conclusion (the Allowing Document)" procedure is performed (P.LL.06.PRC.005).

25. The provided description of group of procedures of ensuring production control and movement of ozone-depleting substances and products containing them is provided in the figure 5.

28. Attraction to disciplinary responsibility for non-compliance with the requirements aimed at providing timeliness and completeness of transfer of the data participating in information exchange of officials and staff of authorized bodies of state members is performed according to the legislation of state members.

VIII. Procedures of general process

1. Procedures of information support of control of issue of the conclusions (allowing documents)

"Submission of Data on the Issued Conclusion (the Allowing Document)" procedure (P.LL.06.PRC.001)

35. Result of accomplishment of the "Submission of Data on the Issued Conclusion (the Allowing Document)" procedure (P.LL.06.PRC.001) is obtaining by the competent authority accepting data, data on the issued conclusion (the allowing document).
