About state examination on energy saving

According to the Law of Ukraine "About energy saving" the Cabinet of Ministers of Ukraine DECIDES:

1. Approve Regulations on state examination on energy saving it (is applied).

2. To the ministries, other central executive bodies, Council of Ministers of the Autonomous Republic of Crimea, regional, Kiev and to the Sevastopol city public administrations to provide fulfillment of requirements of the Regulations on state examination on energy saving.

3. To the state committee of construction, architecture and housing policies in coordination with the State committee on energy saving for 1998 to bring into accord with the Law of Ukraine "About energy saving" organizational and methodical standards of Ukraine in industry of construction and the industry of construction materials, having provided introduction in regulating documents of Sections on energy saving which are subject to state examination from energy saving.

4. To the state committee on energy saving in three-months time in coordination with the Ministry of Finance and the Ministry of Economics to develop the instruction about procedure for transfer of documentation and implementation of state examination from energy saving.

Regulations on state examination on energy saving

1. This Provision determines procedure for conducting state examination by energy saving (further - examination) objects which are subject to examination.

2. Examination is system of actions for establishment of compliance to the legislation concerning energy saving, to standards, regulations and standard rates of energy saving of productive activity of the companies, organizations and organizations, drafts of schemes of development and placement of productive forces, projects of development of industries of social production, territorial schemes of power supply, instructive-methodological and normative and technical acts, construction regulations and rules, documentation on creation and acquisition of the new power-intensive equipment, technology and materials, power technological part of feasibility statements and construction projects new and expansion with annual consumption of fuel and energy resources in one thousand and more tons in terms of conditional fuel - according to the decision of the customer in case of provision of preferences (subsidies, tax or financial and credit benefits) at the expense of budgetary funds, other peredplanovy and peredproyektny documentation, documents and materials which regulate all types of activity in the field of energy saving, for the purpose of achievement of the most bigger efficiency use of fuel and energy resources, implementation of modern achievements of the equipment and technologies in industries of social production.

3. The examination purpose - prevention to implementation of inefficient technologies, production of the inefficient equipment, equipment, devices, the household appliances connected with production, conversion, production, transportation, preserving and use of all types of fuel and energy resources.

4. Conducting examination is obligatory for the companies, organizations and the organizations of all patterns of ownership.

The list of objects which are subject to state examination on energy saving is determined in appendix to this Provision.

5. The main objectives of examination is:

determination of compliance of the management, investing and other activity connected with production, conversion, production, transportation, preserving and consumption of fuel and energy resources, to the legislation concerning energy saving;

establishment of compliance of peredproyektny, peredplanovy, project and other decisions to requirements normative and legal and the specifications and technical documentation concerning energy saving;

preparation of the expert conclusions connected with programs and projects in the field of energy consumption and energy saving;

participation in carrying out power technology inspections of the companies, organizations and the organizations of all patterns of ownership for energy saving and in preparation of recommendations of rather priority crediting of the power keeping actions.

6. State examination on energy saving is carried out by Gosenergoeffektivnosti. Expertize of construction projects is carried out according to article 31 of the Law of Ukraine "On regulation of town-planning activities".
