About approval of modules of assessment of conformity in the sphere of rail transport

According to part four of article 14 of the Law of Ukraine "About technical regulations and assessment of conformity" the Cabinet of Ministers of Ukraine decides:

1. Approve modules of assessment of conformity in the sphere of rail transport which are applied.

2. Make change to the resolution of the Cabinet of Ministers of Ukraine of January 13, 2016 No. 95 "About approval of modules of assessment of conformity which are used for development of assessment procedures of compliance, and rules of use of modules of assessment of conformity" (The Official Bulletin of Ukraine, 2016, No. 16, of the Art. 625), having added the deciding part with Item 1-1 of the following content:

"1-1. Operation of this resolution does not extend to use of modules of assessment of conformity in the sphere of rail transport.".

3. This resolution becomes effective in six months from the date of its publication.

Modules of assessment of conformity in the sphere of rail transport

1. Assessment of conformity of components of operational compatibility (further - component) is carried out according to modules of assessment of conformity.

The CA module (internal control on production)

2. Internal control on production - assessment procedure of compliance by means of which the producer fulfills the obligations determined by Items 2 - 5 of these modules, guarantees and declares under the sole responsibility that the component conforms to requirements of the regulating documents and/or technical specifications of operational compatibility (further - the regulating document) applied to it.

Technical documentation

3. The producer develops technical documentation which allows to carry out assessment of conformity of component to requirements of the regulating document.

In technical documentation applicable requirements are specified and the project, production, maintenance and operation of component are described.

In case the component was already applied, in technical documentation it is noted that it is accepted to implementation with the same appointment and conforms to requirements of the regulating document.

Technical documentation shall include:

general description of component;

project (in the presence), production drawings, electric, hydraulic and other circuits (in the presence) component components;

descriptions and explanations (in the presence), necessary for understanding of such drawings, schemes, operation method, including condition of use and maintenance of component;

conditions of integration of component into system of rail transport and the necessary conditions connected with the interface;

the list of the regulating documents applied fully or partially, and descriptions of the decisions accepted for fulfillment of requirements of regulating documents if such documents are not applied. In case the regulating document is partially applied, in technical documentation parts which are applied are specified;

results of the executed project calculations, the conducted researches and so forth;

test reports.

Production

4. The producer takes the measures necessary in order that the production process and its monitoring provided compliance to the constituting technical documentation specified in Item 3 of these modules and to requirements of the regulating documents applied to component.

Declaration of conformity of component

5. The producer constitutes the written declaration of conformity of component and stores it together with technical documentation for giving on request of body of the state market supervision during the period determined in the relevant regulating document and in case in this document such period is not determined, within 10 years after production of the last component.

The declaration of conformity of component is identified with component.

The copy of the declaration of conformity of component is provided to appropriate authorities according to their requirement.

Authorized representative

6. From his name and under its responsibility his authorized representative on condition of determination of such obligations in the power of attorney can perform the obligations of the producer established in Item 5 of these modules.

7. Internal control on production with check by individual research - assessment procedure of compliance by means of which the producer fulfills the obligations established in Items 8 - 10 and 12 of these modules both guarantees and declares under the sole responsibility that the component conforms to requirements of the regulating documents applied to it.

Testing are carried out by accredited test laboratory of the producer or under responsibility of the appointed conformity assessment body chosen by the manufacturer.

Certificate of conformity of component

11. The appointed body issues the certificate of conformity of component of rather conducted researches and testing.

The manufacturer stores the certificate of conformity of component in the type available to check of the state market supervision by body, during the period determined in the relevant documents and in case in documents such period is not determined, within 10 years after production of the last component.

Declaration of conformity of component

12. The producer constitutes the written declaration of conformity of component and stores it together with technical documentation for giving on request of body of the state market supervision during the period determined in the relevant regulating document and in case in the document such period is not determined, within 10 years after production of the last component.

The declaration of conformity of component is identified with component.

Internal control on production with check through any periods - assessment procedure of compliance by means of which the producer fulfills the obligations established in Items 15 - 19 and 21 of these modules, guarantees and declares under the sole responsibility that the component conforms to requirements of the regulating documents applied to it.

15. The producer develops technical documentation which allows to carry out assessment of conformity of component to requirements of regulating documents. 17. At choice of the producer of testing of component are carried out it by accredited test laboratory or under responsibility of the appointed conformity assessment body chosen by the manufacturer through any periods.

18. The producer represents the components in the form of uniform batches and undertakes necessary measures in order that the production process provided uniformity of each batch of the made components.

19. All components shall be available for conducting check in the form of uniform batches. From each batch in accidental procedure the sample undertakes. All components in such selection are checked separately, on them the corresponding testing for determination of compliance of component to the standard sample described in technical documentation and/or to requirements of the regulating documents applied to them for the purpose of recognition of suitability or unfitness of such batch for use are carried out.

Certificate of conformity of component

20. The appointed body for results of the conducted researches and testing issues the certificate of conformity of component.

The manufacturer stores the certificate of conformity of component for giving on request of body of the state market supervision during the period determined in the relevant regulating document and in case in this document such period is not determined, within 10 years after production of the last component.

21. 23. Examination of type - part of assessment procedure of compliance by means of which the appointed body researches the engineering design of component and checks and confirms that this project conforms to requirements of the regulating documents applied to it.

24. Expertize of type can be carried out by one of the following methods:

evaluating adequacy of the engineering design of component by examination of engineering documentation and the confirmatory proofs specified in Item 25 of these modules without sample research (project appraisal of standard sample);

evaluating adequacy of the engineering design of component by examination of engineering documentation and the confirmatory proofs specified in Item 25 of these modules with research of one or several significant parts of samples of component which are representative for the provided production (combination of examination of standard sample and its project);

researches of samples of component which are representative for the provided production (examination of standard sample).

25. The producer submits the application for examination of type to the appointed body at own choice.

The request includes:

the name and the location of the producer and if the application is submitted from the authorized representative, its name and the location;

samples which are representative for the provided production. The appointed body can request additional samples if it is necessary for accomplishment of the program of testing;

the proofs confirming adequacy of the solution of the engineering design. Such proofs shall contain references to all used documents, in particular in case of non-use of the relevant regulating documents in full. Proofs include results of the testing which are carried out by the relevant laboratory of the manufacturer or other test laboratory from his name and under its responsibility;

the written application about not application in other appointed body;

technical documentation.
