About approval of the Regulations on procedure for carrying out psychosocial consultation in connection with HIV

According to article 7 of the Law of the Kyrgyz Republic "About HIV/AIDS in the Kyrgyz Republic", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for carrying out psychosocial consultation in connection with HIV according to appendix.

2. This Resolution becomes effective after ten days from the date of official publication.

Regulations on procedure for carrying out psychosocial consultation in connection with HIV

1. General provisions

1. This Regulations on procedure for carrying out psychosocial consultation in connection with HIV (further - the Provision) determine procedure for carrying out dotestovy and posttest psychosocial consultation of persons undergoing medical examination (testing) for HIV.

2. Psychosocial consultation represents the confidential dialogue between the examined person and person providing support giving the chance to overcome psychoemotional stress and to make the decision concerning HIV/AIDS.

3. Psychosocial consultation is provided to all persons undergoing medical examination (testing) for HIV.

4. Main objectives of psychosocial consultation are:

- rendering psychological and information support to the patient;

- prevention of spread of HIV infection.

5. Person has the right to refuse performing medical examination (testing) for HIV at any its stage, except for forced medical examination.

2. Procedure for carrying out dotestovy and posttest psychosocial consultation in connection with HIV

6. Psychosocial consultation is carried out by specially trained staff of the organizations of health care and other organizations performing medical examination (testing) of persons for HIV.

7. The specialists who are carrying out psychosocial consultation in connection with HIV shall inform person receiving the consultation, basic provisions concerning medical examination (testing) for HIV and also to inform:

- about the purposes of performing medical examination (testing) for HIV;

- about ways of transfer of HIV;

- about methods of protection against HIV infection;

- about types of the medical and psychosocial care which persons infected with HIV can receive.

8. Process of psychosocial consultation in connection with HIV consists of dotestovy and posttest consultation. Any medical examination (testing) for HIV is followed by dotestovy and posttest psychosocial consultation.

9. Dotestovy psychosocial consultations it is carried out before blood sampling for research on HIV.

10. Carrying out dotestovy consultation on HIV includes:

- provision of information on HIV;

- informing on the procedure of medical examination (testing) for HIV;

- informing on values and possible consequences of medical examination (testing) for HIV;

- discussion of probability of receipt of negative or positive result of inspection on HIV, consequences and options of the behavior which addressed in each situation;

- receipt of the informed consent of person on passing of medical examination (testing) for HIV.

11. Content of posttest psychosocial consultation depends on results of medical examination (testing) for HIV (positive, negative or uncertain (not final)).

12. Carrying out posttest psychosocial consultation in case of positive result of inspection on HIV includes:

- rendering psychoemotional support to the patient;

- informing the patient on feasibility of further observation and consultation at specialists of the organizations of health care;

- the direction of the patient in the organizations providing the medical and public assistance, additional services for persons living with HIV.

13. Carrying out posttest psychosocial consultation in case of negative result of inspection on HIV includes:

- provision of information on availability of "the window period", as about the reason of need of repeated medical examination (testing) for HIV;

- explanation of measures of prevention of HIV.

14. Carrying out posttest psychosocial consultation in case of uncertain (not final) result of inspection on HIV includes:

- informing patient on results of medical examination (testing) for HIV;

- discussion with the patient of the received result of medical examination (testing) for HIV;

- explanation under what circumstances there is uncertain result;

- discussion with the patient of question of feasibility of repeated passing of medical examination (testing) for HIV, for receipt of final result;

- discussion of resources of support during expectation of results of medical examination (testing) for HIV;

- provision of information on the organizations providing medical care and support concerning HIV.

15. Persons performing dotestovy and posttest psychosocial consultation bear responsibility for observance of requirements of this provision, and also the legislation of the Kyrgyz Republic in the sphere of HIV/AIDS.
