About the technical regulation of the Eurasian Economic Union "About safety of alcoholic products"
According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:
1. Accept the enclosed technical regulation of the Eurasian Economic Union "About safety of alcoholic products" (TP of EEU 047/2018).
2. Determine that the technical regulation of the Eurasian Economic Union "About safety of alcoholic products" (TP of EEU 047/2018) becomes effective since January 1, 2024.
3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Accepted by the Decision of Council of the Eurasian economic commission of December 5, 2018, No. 98
1. This technical regulation establishes obligatory for application and execution in the territories of state members of the Eurasian Economic Union (further respectively – state members, the Union) requirements to the alcoholic products released in the territories of state members, the related requirements to production processes, storages, transportations (transportation), realization and utilization, and also the requirement to marking and packaging of alcoholic products for ensuring its free movement.
If concerning alcoholic products other technical regulations of the Union (Customs union) establishing requirements to alcoholic products, the related requirements to production processes, storages, transportations (transportation), realization and utilization, and also the requirement to marking and packaging of alcoholic products, alcoholic products and processes of its production, storage, transportation (transportation), realization and utilization are accepted, and also marking and packaging of alcoholic products shall conform to requirements of all technical regulations of the Union (Customs union) which action extends to alcoholic products.
This technical regulation supplements requirements of the technical regulation of the Customs union "About safety of food products" (TR CU 021/2011) approved by the Decision of the Commission of the Customs union of December 9, 2011 No. 880 (further – the technical regulation of the Customs union "About safety of food products" (TR CU 021/2011)), the technical regulation of the Customs union "Food products regarding its marking" (TR CU 022/2011) approved by the Decision of the Commission of the Customs union of December 9, 2011 No. 881 (further – the technical regulation of the Customs union "Food products regarding its marking" (TR CU 022/2011)), and the technical regulation of the Customs union "About safety of packaging" (TR CU 005/2011) approved by the Decision of the Commission of the Customs union of August 16, 2011 No. 769 (further – the technical regulation of the Customs union "About the safety of packaging" (TR CU 005/2011)) and which are not contradicting them.
2. This technical regulation is developed for the purpose of protection of life and health of the person, property, the environment, life and health of animals and plants, the prevention of the actions misleading consumers of alcoholic products concerning its appointment and safety.
3. This technical regulation extends to the alcoholic products released in the territories of state members.
Objects of technical regulation of this technical regulation are:
alcoholic products;
the production processes connected with requirements to alcoholic products, storages, transportations (transportation), realization and utilization.
4. This technical regulation does not extend on:
a) the alcoholic products following en route through the territories of state members;
b) the alcoholic products made in the scientific purposes;
c) the alcoholic products made by physical persons for private use without the purpose of its subsequent realization in the territories of state members;
d) the alcoholic products exported according to agreements in foreign trade out of limits of the territories of state members;
e) products containing ethyl alcohol according to the list according to appendix No. 1.
5. For the purposes of application of this technical regulation the concepts established by the technical regulation of the Customs union "About safety of food products" are used (TR CU 021/2011), the technical regulation of the Customs union "Food products regarding its marking" (TR CU 022/2011) and the technical regulation of the Customs union "About safety of packaging" (TR CU 005/2011), and also concepts which mean the following:
"alcoholic products" – the food products made without use or with use of the ethyl alcohol made from food raw materials, and (or) alcohol-containing food products with volume fraction of ethyl alcohol of more 0,5 of percent, except for products included in the list provided by appendix No. 1 to this technical regulation. Alcoholic products are subdivided into such types as ethyl alcohol, alcoholic drinks, low alcohol drinks, wine-making products, distillates, brewing products, medovarenny products, alcohol-containing food products;
"alcoholic products in bulk" – the alcoholic products placed in in or transport plant container (in the capacity equipment, including barrels, reservoirs, cistern and automobile cars, fleksitanka and the similar equipment intended for transportation (transportation) by different types of transport), intended for pouring in consumer packaging or productions of other types of alcoholic products or other products and which are not subject to realization to the consumer as ready-made product before its pouring or conversion in case of production of other alcoholic products or other products;
"wine-making products" – alcoholic products:
made as a result of complete spirit fermentation of the whole or crushed berries of fresh grapes or fruit, must grape, mashes fruit;
made with the subsequent distillation of products of fermentation and endurance or without endurance;
made as a result of complete or incomplete spirit fermentation of the whole or crushed berries of fresh grapes, fruit or must grape, mashes of one or more, fruit with addition, of the following products: the rectified ethyl alcohol from food raw materials, distillate of grape origin, distillate wine, distillate fruit, including the rectified, sacchariferous products, flavoring substances, nutritional supplements, fragrances, carbon dioxide, water specified in the document (documents) according to which alcoholic products are made (the standard, the standard of the organization, specifications or other document).
For production of wine-making products according to the list according to appendix No. 3 use of the technological transactions and technological means specified in the table 10 of appendix No. 3 to this technical regulation is authorized;
"distillate" – the alcoholic products with volume fraction of ethyl alcohol more than 52 percent received by the simple or fractioned distillation (distillation) or rectification of the fermented must, wine filling (wine materials), alcohol-containing barmy rainfall, gushchevy rainfall, alcohol-containing residue, other alcohol-containing food products. Distillate is applied to production of alcoholic products, including wine-making products, and can have the name of raw materials or drink for which it is made;
"medovarenny products" – the alcoholic products made from honey without addition or with addition of the rectified ethyl alcohol, sugar, distillate honey, distillate of the fruit, concentrated fruit juice, carbon dioxide, fresh mashes of the fruit, alcoholized fruit juice, natural vkusoaromatichesky substances and medicines and having the prevailing aroma and taste of honey;
"brewing products" – the alcoholic products made from brewing raw materials and (or) beer without addition or with addition of fruit and other vegetable raw materials, products of their conversion, fragrances without addition of ethyl alcohol;
"low alcohol drinks" – the alcoholic products with content of ethyl alcohol (fortress) in finished goods less than 7 percent made without use or with use of the rectified ethyl alcohol and (or) alcohol-containing food products, the prepared (corrected) water or mineral water with general mineralization no more than 1 g/l containing ingredients which use is provided by the document (documents) according to which alcoholic products are made (the standard, the standard of the organization, specifications or other document), including sacchariferous products, acids, carbon dioxide, infusions, extracts of fruit (fruits, berries) and grain raw materials, juice, vegetable raw materials, dairy products, honey and other products of beekeeping (including honey in cells, propolis, забрус, uterine bee milk), salts, other alcoholic drinks, nutritional supplements, and not belonging to wine-making and brewing products;
"alcoholic drinks" – the alcoholic products made with use of the rectified ethyl alcohol, and (or) alcohol-containing food products, and (or) other alcoholic products;
