1. Approve the enclosed criteria of reference of the production facilities used by legal entities and individual entrepreneurs, making negative impact on the environment to certain category of risk for regional state ecological supervision.

2. Determine that when implementing regional state ecological supervision scheduled inspections of legal entities, the individual entrepreneurs using the production facilities making negative impact on the environment and referred to certain category of risk according to criteria of reference of the production facilities used by legal entities and individual entrepreneurs, making negative impact on the environment, to certain category of risk for regional state ecological supervision, approved by this resolution:

for category of high risk are carried out once in 2 years;

for category of significant risk are carried out once in 3 years;

for category of average risk are carried out not more often than once in 4 years;

for category of moderate risk are carried out not more often than once in 5 years;

for category of low risk are not carried out.

Criteria of reference of the production facilities used by legal entities and individual entrepreneurs, making negative impact on the environment to certain category of risk for regional state ecological supervision

1. The production facilities used by legal entities and individual entrepreneurs, making negative impact on the environment belong to certain category of risk for regional state ecological supervision according to the following criteria:

a) the objects of regional state ecological supervision corresponding to criteria of reference of the objects making moderate negative impact on the environment, to the category objects II provided by criteria of reference of the objects making negative impact on the environment, to objects I, II, III and IV of categories, approved by the order of the Government of the Russian Federation of September 28, 2015 No. 1029 "About approval of criteria of reference of the objects making negative impact on the environment to objects I, II, III and IV of categories" belong to the category of average risk (further - the resolution No. 1029);

b) the objects of regional state ecological supervision corresponding to criteria of reference of the objects making insignificant negative impact on the environment to the category objects III provided by criteria of reference of the objects making negative impact on the environment to objects I, II, III and IV of categories approved by the resolution No. 1029, and also objects only for collection and (or) transportation and (or) processing of production wastes and consumption of the V class of danger, except for objects to which in case of inclusion in the state register of the objects making negative impact on the environment the IV category is appropriated belong to the category of moderate risk;

c) the objects of regional state supervision corresponding to criteria of reference of the objects making the minimum negative impact on the environment, to the category objects IV provided by criteria of reference of the objects making negative impact on the environment, to objects I, II, III and IV of categories, approved by the resolution No. 1029 belong to the category of low risk.

2. The objects of regional state ecological supervision which are subject to reference according to Item 1 of this document to categories of average, moderate risk are subject to reference respectively to categories of significant, average risk if object of regional state ecological supervision is placed:

a) in borders of especially protected natural territory of regional value;

b) in the water protection zones of water objects or their parts.

3. The objects of regional state ecological supervision which are subject to reference according to Items 1 and 2 of this document to categories of considerable, average, moderate risk are subject to reference respectively to categories of high, significant, average risk in the presence of taken legal effect within 3 years preceding decision date about reference of object of regional state ecological supervision to category of risk:

a) resolutions on purpose of administrative punishment, except for administrative punishment in the form of the prevention, to the legal entity, his officials or the individual entrepreneur for making of the administrative offense provided by Articles 7. 3, 7.4, 7.6, 8.2, 8.4, 8.6, 8.7, 8.9, part 1 of Article 8. 10, Articles 8. 11, 8.12, 8.13, 8.14, 8.21, 8.32, 8.42, 8.44, 8.45, 14.1 and 19.20 of the Russian Federation Code of Administrative Offences and the object of the regional state ecological supervision which is taken out by officials of state supervision body or court based on the protocol on administrative offense made when implementing activities with use, constituted by officials of the specified body;
