Rules of consideration of the application about holding open tender on right to contract of lease of the wood lot which is in the state-owned or municipal property for wood procurement

1. These rules establish procedure for consideration of the application about holding open tender on right to contract of lease of the wood lot which is in the state-owned or municipal property for wood procurement (further respectively - tender, the statement).

2. The application is submitted by the legal entity or the individual entrepreneur owning on the property right or on other legal cause the objects of wood-processing infrastructure intended for production of products from wood and other products of conversion of wood which types are determined by the Government of the Russian Federation according to part 2 of Article 80.1 of the Forest code of the Russian Federation (further - the applicant).

3. The documents containing the technical characteristics and parameters of the objects specified in Item 2 of these rules, and reasons for need for additional amount of procurement of wood of certain specific (pedigree) and assortment structure for the purpose of providing with raw materials the specified objects, provided by part 4 of Article 80.1 of the Forest code of the Russian Federation are enclosed to the application (further - documents).

4. Consideration of the application and documents is performed by the public authority or local government body performing according to Articles 81 - 84 Forests codes of the Russian Federation of power according to the order the timberland (further - authorized body).

5. The statement and documents are registered in authorized bodies in day of their receipt. Completeness of the statement and documents is checked in case of their receipt.

6. Day of receipt of the statement and documents is day of their registration in authorized body.

7. Consideration of the application and documents includes:

a) consideration of the application and documents on compliance or discrepancy to requirements, stipulated in Clause 80.1 Forest code of the Russian Federation;

b) assessment of additional requirement for wood based on the data specified in the statement and documents according to technique of assessment of additional requirement for wood and availability in the territory of the subject of the Russian Federation of the timberland which parameters of use of the woods in borders allow to satisfy additional requirement for the wood approved by the order of the Government of the Russian Federation of December 4, 2018 No. 1475 "About approval of Rules of consideration of the application about holding open tender on right to contract of lease of the wood lot which is in the state-owned or municipal property for procurement of wood and technique of assessment of additional requirement for wood and availability in the territory of the subject of the Russian Federation of the timberland which parameters of use of the woods in borders allow to satisfy additional requirement for wood".

8. By results of consideration of the application and documents by authorized body within one month from the date of obtaining specified the statement and documents the decision on carrying out tender or on refusal in carrying out tender is in writing made.

9. The decision on refusal in carrying out tender is made in the cases established by part 8 of Article 80.1 of the Forest code of the Russian Federation.

10. The decision on refusal in carrying out tender with motivated reasons for such refusal goes authorized body to the applicant within one working day from the date of adoption of such decision.
