About approval of Rules of maintaining customs statistics of foreign trade in goods of the Republic of Kazakhstan with the states which are not members of the Eurasian Economic Union

According to Item 3 of article 23 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan", and also with Item 3 of article 360 of the Agreement on the Customs code of the Eurasian Economic Union ratified by the Law of the Republic of Kazakhstan of December 13, 2017 I ORDER:

1. Approve the enclosed Rules of maintaining customs statistics of foreign trade in goods of the Republic of Kazakhstan with the states which are not members of the Eurasian Economic Union.

2. Declare invalid the order of the Minister of Finance of the Republic of Kazakhstan of September 2, 2016 No. 473 "About approval of Rules and terms of publication of data of customs statistics of foreign trade of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts for No. 14284, published on October 14, 2016 in information system of law of Ad_let).

3. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining customs statistics of foreign trade in goods of the Republic of Kazakhstan with the states which are not members of the Eurasian Economic Union

Chapter 1. General provisions

1. These rules of maintaining customs statistics of foreign trade in goods of the Republic of Kazakhstan with the states which are not members of the Eurasian Economic Union (further - Rules) are developed according to Item 3 of article 23 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" (further - the Code) and determine procedure for customs statistics of foreign trade in goods of the Republic of Kazakhstan with the states which are not members of the Eurasian Economic Union.

2. In these rules the following concepts are used:

1) the responsible person - person according to functional obligations, responsible for forming and publication of foreign trade statistics of the Republic of Kazakhstan;

2) the operator of service of technical support - person to who ensuring functioning of information system is assigned;

3) information system - the set of information and communication technologies, service personnel and documentation intended for forming of the statistical database and output indicators of foreign trade statistics of the Republic of Kazakhstan.

Chapter 2. Procedure for maintaining customs statistics of foreign trade in goods of the Republic of Kazakhstan with the states which are not members of the Eurasian Economic Union

3. Data of customs statistics of foreign trade in goods of the Republic of Kazakhstan with the states which are not members of the Eurasian Economic Union (further - the Foreign trade statistics) are published for users of statistical information.

4. The publication of foreign trade statistics is made on official Internet resource of Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further - Committee): kgd.gov.kz.

5. The foreign trade statistics is published by responsible persons of Committee.

6. Information sources for maintaining foreign trade statistics goods according to the decision of Board of the Eurasian economic commission of December 25, 2018 No. 210 "About approval of Methodology of maintaining statistics of mutual trade in goods of state members of the Eurasian Economic Union and Methodology of maintaining customs statistics of foreign trade in goods of state members of the Eurasian Economic Union" use the data containing in declarations on goods and other documents and also other data of territorial authorities of state revenues.

Within this Item other data are understood as data of territorial authorities of state revenues during the course of performance of the activities.

7. The information system includes the following subsystems:

1) data loadings;

2) data analysis of customs statistics of foreign trade;

3) publications of reports on official Internet resource of Committee: kgd.gov.kz.

8. The operator of service of technical support of Committee performs data loading in information system with use of the tool of chain of processes.

9. Updating of data is carried out in the automated mode with use of the tool of chain of processes.

10. Forming of foreign trade statistics is performed by Committee:

1) monthly to the 5th, following the accounting period, the operator of service of technical support, on the basis of the request, data loading in information system with updating of data since the beginning of accounting year is performed;

2) monthly to the 7th, following the accounting period, responsible persons of Committee make quality check of updated data for the accounting period;

3) monthly to the 10th, following the accounting period, in case of identification of mistakes, the service of technical support takes measures for elimination of the revealed mistakes;

4) monthly to the 12th, following the accounting period, repeated loading of the modified data is carried out to information system with the notification of responsible persons of Committee.

11. In case of the reasons promoting postponement of forming of foreign trade statistics, the responsible person without delay informs management of Committee on the reasons of delay of performance of works.

12. The responsible person monthly with 14 on 28 number of every month following the accounting period in subsystem of "the publication of reports in the Internet" of information system creates foreign trade statistics in form according to appendices 1, of 2, of 3, of 4, of 5, of 6, 7 and 8 to these rules.

13. The responsible person monthly to the 28th day of every month following the accounting period performs the publication of foreign trade statistics of the Republic of Kazakhstan.

14. The committee performs transfer of statistical information according to article 19 of the Code.

15. For 180 (hundred eightieth) day after the accounting period updating of annual data is made.

16. For 40 (fortieth) day after the accounting period, transfer of foreign trade statistics to the Eurasian economic commission and authorized bodies of the state members of the Eurasian Economic Union responsible for provision of statistical data of foreign trade is performed.

17. If the stage of forming of foreign trade statistics, and also the publication of statistical data of foreign trade of the Republic of Kazakhstan, is the share of day off or holiday, date is postponed the next working day.
