About completion of reforming of structure of the office of some ministries

For the purpose of ensuring realization of provisions of the Concept of optimization of the system of the central executive bodies approved by the order of the Cabinet of Ministers of Ukraine of December 27, 2017 No. 1013, of completion of implementation of actions for reforming of the ministries directed to strengthening of their institutional capability on forming of state policy, gradual deprivation of unusual powers, optimizations of levels of management in structure of the office of the ministries, streamlinings of functions and structure of the secretariat of the ministries, the Cabinet of Ministers of Ukraine decides:

1. Approve requirements to forming of structure of the office of the ministry which are attached.

2. Determine that forming of structure of the office of the ministries according to the requirements approved by this resolution takes root as pilot project which participants are the Ministry of Agricultural Policy and Food, the Ministry of Energy and Coal Industry, the Ministry of infrastructure, the Ministry of Culture, the Ministry of Education and Science, the Ministry of Health, the Ministry of Regional Development, Construction and Housing and the Ministry of social policy.

Actions for reforming of structure of the office of the Ministry of Finance and the Ministry of Justice continue to be performed according to the resolution of the Cabinet of Ministers of Ukraine of August 18, 2017 No. 644 "Some questions of streamlining of structure of the Secretariat of the Cabinet of Ministers of Ukraine, the office of the ministries and other central executive bodies" (The Official Bulletin of Ukraine, 2017, No. 71, the Art. 2161) and taking into account provisions of Item 1-1 of the resolution of the Cabinet of Ministers of Ukraine of March 12, 2005 No. 179 "About streamlining of structure of the office of the central executive bodies, their territorial subdivisions and local public administrations" (The Official Bulletin of Ukraine, 2005, No. 11, the Art. 522).

Other ministries can join pilot project according to the decision of the Cabinet of Ministers of Ukraine in case of introduction of the offer by the corresponding minister.

3. Determine that the resolution of the Cabinet of Ministers of Ukraine of March 12, 2005 No. 179 "About streamlining of structure of the office of the central executive bodies, their territorial subdivisions and local public administrations" is not applied when forming managements of the ministries specified in paragraph one of Item 2 of this resolution.

4. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

5. To the national agency concerning public service to submit from the date of entry into force of this resolution in accordance with the established procedure to the Cabinet of Ministers of Ukraine offers concerning reduction of acts of the Cabinet of Ministers of Ukraine to compliance with this resolution in a month.

6. To the ministries specified in paragraph one of Item 2 of this resolution:

1) in a month from the date of entry into force of this resolution:

take necessary measures for the purpose of accurate differentiation of functions for forming and realization of state policy, excessive and unusual functions, in particular on provision of administrative services, implementation of the state supervision (control) and management of objects of state-owned property, and also elimination of duplication of functions between structural divisions;

provide formation of managements in all spheres in which the relevant ministry provides forming of state policy, taking into account results of consideration by Coordination council concerning public administration of relevant proposals of the ministries;

From the date of entry into force of this resolution to bring 2) to Coordination council concerning reforming of public administration of the offer concerning deprivation in two-month time and transfer of excessive and unusual functions on realization of state policy, in particular on provision of administrative services, implementation of the state supervision (control) and management of objects of state-owned property (except for managements of objects of state-owned property which activities are aimed at providing economic servicing of the ministries), and also offers on entering of necessary changes into acts of the legislation, including regulations on the relevant ministries;

3) in three-months time from the date of entry into force of this resolution:

provide the announcement and carrying out tenders to positions of specialists in questions of reforms for the purpose of completion of forming of personnel structure of managements;

perform actions for reduction of structure of the office of the ministries in compliance with the requirements approved by this resolution and inform the Cabinet of Ministers of Ukraine on results of the carried-out work.

Requirements to forming of structure of the office of the ministry

1. The office of the ministry consists of the independent structural divisions providing accomplishment of the main objectives of the ministry, and secretariat which performs organizational, legal, material and other support of activities of the ministry.

2. The management of the ministry is the independent structural division of the office of the ministry created for accomplishment of the tasks connected with ensuring forming of state policy in one or several spheres of competence of the ministry, coordination and monitoring of its realization, other tasks except those that also 5 these requirements are specified in items 4.
