About approval of the Temporary order of interaction of authorized bodies of state members of the Eurasian Economic Union and Eurasian economic commission in case of realization of pilot project on forming of system of informing on products which are not conforming to requirements of technical regulations of the Eurasian Economic Union

1. Approve the enclosed Temporary order of interaction of authorized bodies of state members of the Eurasian Economic Union and Eurasian economic commission in case of realization of pilot project on forming of system of informing on products which are not conforming to requirements of technical regulations of the Eurasian Economic Union.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Temporary order of interaction of authorized bodies of state members of the Eurasian Economic Union and Eurasian economic commission in case of realization of pilot project on forming of system of informing on products which are not conforming to requirements of technical regulations of the Eurasian Economic Union

1. This Temporary procedure is developed for the purpose of execution of Item 1 of the actions plan on realization in 2018 - 2019 of pilot project on forming of system of informing on products which are not conforming to requirements of technical regulations of the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of May 10, 2018 No. 74, and determines rules of interaction of authorized bodies of state members of the Eurasian Economic Union (further respectively – state members, the Union) among themselves, and also with the Eurasian economic commission (further – the Commission) within realization of pilot project by forming of system of informing on products which are not conforming to requirements of technical regulations of the Eurasian Economic Union (further – pilot project).

2. This Temporary procedure does not extend to exchange of information, containing the data carried according to the legislation of state members to data of limited distribution (access).

3. The concepts used in this Temporary procedure are applied in the values defined by the Agreement on the Eurasian Economic Union of May 29, 2014, acts of bodies of the Union concerning creation and development of the integrated information system of the Union (further – the integrated system) and concerning technical regulation.

4. Participants of interaction within realization of pilot project are:

a) Commission;

b) the state bodies of state members authorized on implementation of the state control (supervision) of observance of requirements of technical regulations of the Customs union "About safety of the low-voltage equipment" (TR CU 004/2011), "About safety of products intended for children and teenagers" (TR CU 007/2011), "About safety of toys" (TR CU 008/2011), "About safety of wheel vehicles" (TR CU 018/2011), "About safety of milk and dairy products" (TR CU 033/2013), "About safety of meat and meat products" (TR CU 034/2013) (further respectively – authorized bodies, technical regulations).

5. Information on authorized bodies is posted on the official site of the Union.

6. In case of identification in the territory of state member of products which are not conforming to requirements of technical regulations, authorized bodies take measures, stipulated by the legislation state member, and within 3 working days from acceptance date of the relevant decision inform on it authorized bodies of other state members and the Commission by means of the direction of the notification in electronic form.

7. The scope of information, containing in the notification on identification of products which are not conforming to requirements of technical regulations and taking measures, is determined according to appendix.

Electronic copies of documents, stipulated by the legislation state member (including copies of protocols of researches (testing) of products), and also copies of other documents which formed the basis for taking measures concerning products which are not conforming to requirements of technical regulations are attached to the notification.

8. In case of obtaining by authorized body in the territory of which products which are not conforming to requirements of technical regulations, the additional information about product quantity, the legal entities and physical persons registered as individual entrepreneurs are revealed (further – individual entrepreneurs) to which such products were sent for realization in the territories of other state members, corresponding changes are made to the notification.

9. Within realization of pilot project the Commission performs:

a) forming and maintaining the general information resource containing data on results of the state control (supervision) of observance of requirements of technical regulations (including about violations of requirements of technical regulations and the taken measures concerning products which are not conforming to requirements of technical regulations) (further – general information resource);

b) publication on information portal of the Union of the following data received from authorized bodies:

data on the authorized body which revealed products which are not conforming to requirements of technical regulations (including full name);

date of identification of products which are not conforming to requirements of technical regulations;

information about the legal entity or the individual entrepreneur at which products which are not conforming to requirements of technical regulations (including full name, the location (the address of the legal entity) and the address (addresses) of the place of implementation of activities are revealed (if addresses differ) – for the legal entity or surname, name, middle name (in the presence), the residence and the address (addresses) of the place of implementation of activities (if addresses differ) – for the individual entrepreneur, and also registration or accounting (individual, identification) number assigned in case of state registration of the legal entity or individual entrepreneur according to the legislation of state member);
