About measures for further enhancement of procedure for licensing of activities for rendering non-state educational services in the field of preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation

According to resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of March 2, 2017 "About measures for implementation of new samples of the national car driver license and the registration certificate of the automotor-vehicle" and of February 23, 2018 No. 139 "About measures for enhancement of system of preparation, retraining and advanced training of drivers of automotor-vehicles" the Cabinet of Ministers decides No. 116:

1. Approve:

Regulations on procedure for licensing of activities for rendering non-state educational services in the field of preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation according to appendix No. 1;

Regulations on order of registration of state educational institutions and educational groups of other legal entities performing activities for rendering non-state educational services in the field of preparation, retrainings and advanced trainings of drivers of automotor-vehicles and means of urban electric transportation, and also holding examinations and issue of the national car driver license according to appendix No. 2;

Regulations on procedure for preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation according to appendix No. 3;

The state requirements to preparation and retraining of drivers of automotor-vehicles and means of urban electric transportation according to appendix No. 4;

The state requirements to advanced training of drivers of automotor-vehicles and means of urban electric transportation according to appendix No. 5.

2. Make changes and addition to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 6.

3. Recognize since August 1, 2018 invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 7.

4. To the Ministry of Internal Affairs together with the Ministry of Justice of the Republic of Uzbekistan and the State inspectorate for supervision of quality of education under the Cabinet of Ministers to make in the Cabinet of Ministers offers on the changes and amendments in legal acts of the Republic of Uzbekistan following from this resolution in a month.

5. To the ministries and departments in two-month time to bring the regulatory legal acts adopted by them into accord with this resolution.

6. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov, the deputy prime minister of the Republic of Uzbekistan A. A. Abdukhakimov, the chief of the State inspectorate for supervision of quality of education under the Cabinet of Ministers of the Republic of Uzbekistan U. N. Tashkenbayev and the Minister of Internal Affairs of the Republic of Uzbekistan P. R. Bobozhonov.

Regulations on procedure for licensing of activities for rendering non-state educational services in the field of preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation

Chapter 1. General provisions

1. This Provision determines procedure for licensing of activities for rendering non-state educational services in the field of preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation.

2. Issue to legal entities of the license, prolongation of effective period of the license, suspension or cancellation of the license, and also its cancellation and renewal for the organization of activities for rendering non-state educational services in the field of preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation are performed by the State inspectorate for supervision of quality of education under the Cabinet of Ministers of the Republic of Uzbekistan.

3. The license for the right of implementation of activities for rendering non-state educational services in the field of preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation is issued without restriction of term of its action.

Chapter 2. Licensed requirements and conditions

4. Treat the general licensed requirements and conditions shown to legal entities when implementing activities for rendering non-state educational services in the field of preparation, retraining and advanced training of drivers of automotor-vehicles and means of urban electric transportation:

obligatory compliance with laws and legal acts of the Republic of Uzbekistan in the field of education;

obligation of secular nature of training, inadmissibility of use in educational process of propaganda for war, violence, infringement of constitutional rights and freedoms of citizens, undermining safety and social and political stability in the country, legal and spiritual basis of society, the civil world, interethnic and interfaith concord, distribution of unreliable information on the Republic of Uzbekistan and misstatement of historical, cultural and cultural wealth of the people;

increase in efficiency and effectiveness of activities in the field of education on the basis of use of innovative pedagogical forms, methods and modern technologies of training taking into account the best international practices;

the organization of educational process according to the automotor-vehicles approved in accordance with the established procedure by the state requirements to advanced training of persons, managing (drivers), the state requirements to preparation and retraining of drivers of automotor-vehicles, curricula and programs of subject matters;

availability of two and more audiences with area at least 40 m2 everyone located in one territory, intended for implementation of licensed type of activity and belonging to the license applicant on the property right, leases or other corporeal right;

availability in each audience of the video projector or interactive monitor (TV) with diagonal at least 50 inches, computers, systems of audio and video surveillance, visual aids according to traffic regulations, and also systems of record of process for ensuring transparency of educational process and final testing;

implementation in educational process of the automated information system allowing to perform monitoring, and also the training process planning directed to increase in progress;

providing participants of educational process with educational, educational and methodical literature and other information and library resources necessary for achievement of effectiveness of the declared level of educational process;

providing each teacher with training programs, the detailed process charts including instructions for use of different pedagogical technologies;

providing everyone studying (listener) according to the state requirements electronic methodologies with the three-dimensional animation effect and video content covering all educational process;

availability of the separate audience for final testing of knowledge gained by studying (listeners) equipped with modern computers.

5. Treat the special licensed requirements and conditions shown to legal entities when implementing activities for rendering non-state educational services in the field of advanced training of drivers of automotor-vehicles and means of urban electric transportation:

the equipment of educational audience according to traffic regulations and traffic safety on basis and is strict according to the state requirements to advanced training of persons, managing (drivers) by automotor-vehicles;

availability of the single program of testing with animation effects for determination of quality of mastering of knowledge on professional development course according to the state requirements to advanced training of persons, managing (drivers) by automotor-vehicles;

teachers availability according to the state requirements to advanced training of persons, managing (drivers) by automotor-vehicles;

issue to graduates of the certificate on the termination of professional development course in accordance with the established procedure.

6. Treat the special licensed requirements and conditions shown to legal entities when implementing activities for rendering non-state educational services in the field of preparation and retraining of drivers of automotor-vehicles and means of urban electric transportation:

the equipment of educational audience according to traffic regulations, bases of traffic safety and first aid and is strict according to the state requirements to preparation and retraining of drivers of automotor-vehicles;

the equipment of educational audience on structure of automotor-vehicles, operation bases, rendering technical (service) servicing, and also labor protection and is strict according to the state requirements to preparation and retraining of drivers of automotor-vehicles;

availability of teaching and instructor structure according to the state requirements to preparation and retraining of drivers of automotor-vehicles;

availability at the license applicant provided for implementation of the licensed type of activity, belonging to it on the property right or other corporeal right of the educational automotor-vehicles and means of urban electric transportation re-equiped and registered in accordance with the established procedure;

availability at the license applicant provided for implementation of the licensed type of activity, belonging to it on the property right or other corporeal right of the autodrome or the closed territory equipped in accordance with the established procedure;

issue to graduates of certificates on the termination of rates in accordance with the established procedure.

Chapter 3. Documents necessary for receipt of the license

7. For receipt of the license the license applicant represents directly to the Center of the state services or directs the following documents, in electronic form through the Single portal of interactive state services:

the statement for licensing with indication of the name and form of business of the legal entity, the place of its stay (postal address), the address of the place of implementation of activities for rendering non-state educational services, the name of organization of bank and the room of the settlement account in bank, the licensed type of activity, the list of the directions of educational activities. The consent of the license applicant with licensed requirements and conditions, and also the e-mail address of the applicant are specified in the statement for receipt of the license;

the conclusions of bodies of the firefighter and sanitary and epidemiological surveillance about compliance of the available buildings and rooms to requirements of fire safety and sanitary and hygienic regulations;

the document on accessory to the legal entity on the basis of the property right or other corporeal rights of the automated information system allowing to perform monitoring and the planning of training directed to increase in progress;

the document on security of the legal entity on the basis of the property right or other corporeal rights to the accreditation period the electronic methodologies developed for preparation and retraining of drivers of automotor-vehicles and means of urban electric transportation, and also separately for increase in their qualification with the three-dimensional animation effect and video content covering all educational process according to the state requirements;

the document on security of the legal entity for accreditation by the single testing program with animation effects, belonging on the basis of the property right or other corporeal right, for determination of quality of mastering of knowledge on professional development course according to the state requirements to advanced training of persons (drivers) managing automotor-vehicles;

information on teachers and instructors of practical driving;

curricula and programs in electronic form;

the document confirming payment by the license applicant of collection for consideration of the application.

Instruction of the e-mail address in the statement on receipt of the license means the consent of the license applicant to receipt of information on the made decision on its statement in electronic form.

8. The license applicant bears responsibility according to the legislation for provision of the doubtful or distorted data.

Chapter 4. Procedure for consideration of the applications on receipt of the license, decision making about licensing or about refusal in licensing

9. For consideration of the application of the license applicant collection in double size of basic settlement size is levied.

For receipt of the license in case of the address through the Single portal 90 percent from the amount of the collection specified in paragraph one of this Item are levied.

The amount of collection is distributed in the following procedure:

a) in case of the attendance appeal to the Centers of the state services:

20 percent - are enlisted into the off-budget account of the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan;

the rest is in full enlisted into the account of the licensing body;

b) in case of the address through EPIGU:

10 percent - are enlisted into the off-budget account of the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan;

11,25 of percent - is enlisted into the account state unitary enterprise "Project management center of the electronic government and digital economy under the National agency of project management in case of the President of the Republic of Uzbekistan;

the rest is in full enlisted into the account of the licensing body.

In case of refusal the license applicant from the submitted application the fee paid amount is not subject to return.

10. Licensing of activities for rendering non-state educational services in the field of preparation, retrainings and advanced trainings of drivers of automotor-vehicles and means of urban electric transportation is performed according to the scheme according to appendix to this Provision.

In case of application through the Center of the state services the ranking officer adopts the statement on receipt of the license and other necessary documents according to the list. The ranking officer of the Center of the state services directs the application of the license applicant to the State inspectorate for supervision of quality of education under the Cabinet of Ministers of the Republic of Uzbekistan in day of receipt of the statement together with necessary documents.

In case of filing of application through the Single portal of interactive state services the ranking officer of the State inspectorate for supervision of quality of education under the Cabinet of Ministers of the Republic of Uzbekistan notifies in electronic form the license applicant on receipt of the statement.

After receipt of the request the State inspectorate for supervision of quality of education under the Cabinet of Ministers of the Republic of Uzbekistan within 9 working days considers documents of the license applicant regarding their compliance to licensed requirements and conditions.

The state inspectorate for supervision of quality of education under the Cabinet of Ministers of the Republic of Uzbekistan (its territorial departments) will organize with involvement of qualified specialists of territorial subdivisions of Public service of traffic safety (further - GSBDD) the Ministries of Internal Affairs and the Ministries of transport of the Republic of Uzbekistan process of preparation of the expert opinion on compliance of the license applicant to the state requirements regarding availability of necessary material and educational and methodical base.

In case of adoption of the positive decision the electronic license which is confirmed by the digital signature and goes to the license applicant through the centers of the state services or the Single portal of interactive state services after payment of the state fee by the license applicant is drawn up.

In case of decision making about refusal in licensing the notification on refusal goes to the license applicant within one day after decision making through the Center of the state services or the Single portal of interactive state services with indication of causes of failure and term during which the license applicant, having eliminated the specified flaws, could submit documents for de novo review.

The decision on issue or on refusal in issue is submitted to the license applicant in time, not exceeding 9 working days from the date of receipt of the statement from the license applicant
