Based on article 20 of the Law No. 162/2005 on the status of the military personnel (The official monitor of the Republic of Moldova, 2005, Art. No. 129-131, 618) DECIDES: the Government

1. Approve Regulations on establishment conditions, procedure of payments and payments of lump-sum allowance of compulsory national insurance of life and health of the military personnel it (is applied).

2. Declare invalid the Order of the Government No. 214/1996 about compulsory national insurance of the military personnel and citizens having military training (The official monitor of the Republic of Moldova, 1996, Art. No. 35-37, 262).

3. To the Ministry of Defence to bring the regulations into accord with provisions of this resolution.

Regulations on establishment conditions, procedure of payments and payments of lump-sum allowance of compulsory national insurance of life and health of the military personnel

I. General provisions

1. The regulations on establishment conditions, procedure of payments and payments of lump-sum allowance of compulsory national insurance of life and health of the military personnel (further - the Provision) regulate appointment cases, procedure, conditions of calculation and the size of one-time insurance benefit on insured event.

2. Execution by citizens of obligations of military service represents the increased risk for their life and health.

This risk is insured by the state which guarantees to the military personnel or in case of their death (death) to members of their families payment of compensation in the form of monetary compensation (further - one-time insurance benefit) for the caused damage to health and lives as a result of damage of health: injuries (mutilations, wounds, contusions), death (death) during execution of the functional obligations provided in the job description or in case of execution of orders of the commanders/chiefs provided by army regulations.

3. For the purposes of this provision the following concepts are applied:

1) injury - the violation of anatomic integrity of fabrics or bodies with damage of their functions caused by impact of various external factors (mechanical, thermal, chemical, beam, etc.);

2) mutilation - the heavy damage of fabrics, bodies and systems as a result of external impact which is followed by temporary, partial or complete loss of capability to execution of military service;

3) wound - damage of fabrics or bodies with violation of their integrity and formation of wound as a result of external mechanical impact (the operational wound does not belong to the concept "wound");

4) contusion - the damage of health (pathological condition) which is followed by consciousness loss, violation of warm activities or breath, resulted from mechanical impact of blunt object on all surface of body or its most part, the sharp pressure difference of the environment or vibration.

4. Action of this provision extends to the following categories of citizens:

1) contract servicemen as a part of the Ministry of Defence and the General inspectorate of carabineers of the Ministry of Internal Affairs, irrespective of the place of execution of military service;

2) the military personnel of conscription service or the reduced military service;

3) the reservists called in accordance with the established procedure by the military centers on charges on mobilization, military preparation (these categories are referred to as "military personnel").

II. Sizes of one-time insurance benefit

5. In case of death (death) of the serviceman during fulfillment of duties of military service or before the expiration of one year from the date of its dismissal in reserve owing to the injury (mutilation, wound, contusion) got in case of fulfillment of duties of military service, members of the family of the serviceman will receive equal shares of one-time insurance benefit:

1) on the contract serviceman - equivalent to the monthly cash allowance in 10 years put in month of death (death) or dismissal in reserve (monthly allowance x 12 months x 10 years);

2) on the serviceman of the conscription (reduced) service, and also on the reservist who in day of appeal on military charges was not employed, - equivalent to the average salary over the country in the I quarter of year of death (death) or dismissal in reserve in 10 years;

3) on the reservist called on military charges who was employed to appeal - equivalent to its average salary in 10 years which he received in the I quarter of year of death (death) or year of the end of charges, but is at least average salary over the country in the I quarter of year of death (death) or the end of charges.

6. In case of approach of restriction of possibility of the serviceman owing to fulfillment of duties of military service to it the one-time insurance benefit percentage of the amount provided in Item 5 for the corresponding category is established:

1) 100% - for heavy extent of restriction of opportunities;

2) 80% - for the expressed extent of restriction of opportunities;

3) 60% - for average extent of restriction of opportunities.

7. In case of temporary disability of the serviceman owing to traumatized (mutilations, wounds, contusions), the military service received in case of fulfillment of duties, to it the one-time insurance benefit percentage of the amount provided in Item 5 for the corresponding category is established:

1) 3% - in case of slight injury;

2) 5% - in case of average injury;

3) 7% - in case of severe injury.

8. Payment of the one-time insurance benefit provided in Items 5 and 6, is performed with deduction at the rate of earlier received payments for this insured event.

III. Cases in case of which the one-time insurance benefit is provided

9. Under execution by the serviceman of obligations of military service in case of which the one-time insurance benefit in case of getting injured is established (mutilations, wounds, contusions) or death (death), it is understood:

1) movement to the place and from the duty station, treatments or performances of the mission or movement of the serviceman for the purpose of accomplishment of the order of the commander/higher official, irrespective of method of movement or the vehicle used by it;
