About measures for implementation of the Resolution of the President of the Republic of Uzbekistan of August 28, 2018 No. PP-3924 "About measures for enhancement of order of registration for the place of permanent residence and the place of temporary stay of foreign citizens and persons without citizenship"

According to the resolution of the President of the Republic of Uzbekistan of August 28, 2018 "About measures for enhancement of order of registration for the place of permanent residence and the place of temporary stay of foreign citizens and persons without citizenship" the Cabinet of Ministers decides No. PP-3924:

1. Approve:

Regulations on order of registration in the place of permanent residence and the place of temporary stay of citizens of the Republic of Uzbekistan according to appendix No. 1;

2. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

3. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 4.

4. To the Ministry of Internal Affairs of the Republic of Uzbekistan together with the interested ministries and departments in two-month time to bring the regulatory legal acts adopted by them into accord with this resolution.

5. To impose control of execution of this resolution on the Minister of Internal Affairs of the Republic of Uzbekistan P. R. Bobozhonov and the Minister of Foreign Affairs of the Republic of Uzbekistan A. H. Kamilov.

Appendix No. 1

to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of October 22, 2018 No. 845

Regulations on order of registration in the place of permanent residence and the place of temporary stay of citizens of the Republic of Uzbekistan

Chapter 1. General provisions

1. This Provision determines order of registration by the place of permanent residence and the place of temporary stay of citizens of the Republic of Uzbekistan (further - citizens) in the Republic of Karakalpakstan and areas (further - areas) (except the Tashkent region).

The order of registration is determined by the place of permanent residence and the place of temporary stay of citizens of the Republic of Uzbekistan in the city of Tashkent and the Tashkent region by the separate regulatory legal act.

2. Citizens shall be registered in the place of permanent residence and/or the place of temporary stay according to the legislation.

Absence at the citizen of registration in the place of permanent residence or the place of temporary stay cannot be considered as the basis for refusal in provision to it services if other is not stipulated by the legislation.

Citizens shall within ten days from the date of arrival on the new residence hand over documents for registration in the place of permanent residence or the place of temporary stay.

Registration in the place of permanent residence and the place of temporary stay of persons which did not reach 16 years is performed on voluntary basis at the request of their parents or persons replacing them.

3. Registration in the place of permanent residence and the place of temporary stay of citizens is performed by law-enforcement bodies (further - Department of Internal Affairs) and provides factual determination of permanent residence or temporary stay of the citizen in certain place in area for the purpose of ensuring public safety and the prevention of offenses, and also population shift accounting.

For registration of registration in the place of permanent residence and the place of temporary stay citizens can address by means of the electronic system providing the simplified procedure of rendering the state services.

Chapter 2. Order of registration in the place of permanent residence of the citizen

4. For receipt of registration in the place of permanent residence in areas the citizen represents to department of migration and registration of nationality (further - OMIOG) district (city) management (department) of internal affairs (further - RGUOVD) the Republic of Karakalpakstan and areas the following documents:

the statement in form according to appendix No. 1 to this Provision;

the passport of the citizen of the Republic of Uzbekistan (further - the passport);

the identity certificate of the contract serviceman or the identity certificate of the officer of Armed Forces of the Republic of Uzbekistan (for the military personnel living out of barracks, the ships and vessels);

the original of documents for housing (copies are made, originals return);

the statement (consent) of the owner (owners) of housing for provision of living space or the notarized statement (consent) in case of impossibility of personal giving;

the certificate on marriage or on the birth of children, and also the documents confirming guardianship or guardianship (copies are made, originals return);

the receipt on payment of the state fee for registration in the place of permanent residence in the amount of, established by the Law of the Republic of Uzbekistan "About the state fee".

5. The orphan children, children without parental support who are in educational, medical and other institutions and also persons which are in retirement homes are registered in the place of permanent residence on the living space provided by the specified organizations.

6. The homeowner has the right to register in the place of permanent residence of family members and other persons.

7. The owner having several apartment houses or apartments can be registered in the place of permanent residence only in one (one) of them.

8. Registration in the place of permanent residence of persons liable for call-up of persons is made after their statement on military accounting in departments of defense cases. Citizens aged from 16 up to 45 years are subject to statement on military accounting.

9. OMIOG RGUOVD, in case of establishment of completeness and authenticity of the submitted documents, within three working days in accordance with the established procedure draws up to the citizen registration in the place of permanent residence.

Chapter 3. Procedure for cancellation and cancellation of registration in the place of permanent residence

10. For the statement the citizen represents in OMIOG RGUOVD Respubliki Karakalpakstan and areas the following documents:

the statement in form according to appendix No. 2 to this Provision;

passport or certificate of birth;

accounting and military documents with mark of department of cases of defense on removal from accounting;

the house register or card of registration and apartment card (appendices No. 3 - 5 to this Provision);

the receipt on payment of the state fee for the statement in the amount of, established by the Law of the Republic of Uzbekistan "About the state fee".

11. The statement of persons condemned to imprisonment is made based on the power of attorney of the convict or by a court decision about loss of right to use by premises.

12. The dead are subject to the statement after registration of death.

The form of the death certificate is established by the Ministry of Justice of the Republic of Uzbekistan.

13. In case of establishment in the submitted documents of doubtful and inappropriate validity of information, and equally in forgery, formed the basis for receipt of registration in the place of permanent residence in areas, registration or its cancellation is subject to cancellation OMIOG RGUOVD Respubliki Karakalpakstan and areas with the subsequent direction of materials in investigation authorities.

14. Cancellation of registration in the place of permanent residence or cancellation of registration can be made also in other stipulated by the legislation cases, including by a court decision.

15. In case of cancellation or cancellation of registration in the place of permanent residence the inspector OMIOG within three days sends departure leaves (appendix No. 6 to this Provision) to address reference bureau of the Ministry of Internal Affairs of the Republic of Karakalpakstan or the Departments of Internal Affairs of areas.

Chapter 4. Order of registration of citizens in the place of temporary stay

16. Registration of citizens in the place of temporary stay (further - temporary registration) is made for a period of ten days up to one year without cancellation of registration of the citizen in the place of permanent residence. Lack of registration in the place of permanent residence is not the basis for refusal in registration in the place of temporary stay.

The citizens staying in the area for the term of no more than five days are not subject to temporary registration.

17. Temporary registration of the citizens who arrived to hotels, medical institutions, sanatoria, rest houses and other similar organizations in the area is performed on their arrival of these organizations by administration based on identity documents, irrespective of the term of stay and frequency of arrival.

18. For temporary registration in the area the citizen from the date of arrival submits within five-day term in OMIOG in the place of the temporary stay the following documents:

the statement in form according to appendix No. 7 to this Provision;

passport;

the identity certificate of the contract serviceman or the identity certificate of the officer of Armed Forces of the Republic of Uzbekistan (for the military personnel living out of barracks, the ships and vessels);

the certificate of birth and two photos of 35 x 45 mm in size - for persons which did not reach 16-year age;

statement (consent) of the owner (owners) of housing for provision of living space;

the original of documents for housing (copies are made, originals return);

the receipt on payment of the state fee for temporary registration in the amount of, established by the Law of the Republic of Uzbekistan "About the state fee".

19. The inspector OMIOG after registration of a statement, and also studying and execution of the submitted documents in accordance with the established procedure issues on the same day to the applicant the insert to the identity document of the citizen, about temporary registration in the area (further - the insert about temporary registration) or the insert with the protected BARE-CODE * according to appendices No. 8 and 9 to this Provision.

The insert about accounting is the document of the strict reporting. The insert about temporary registration and the insert with the protected BARE-CODE is the document confirming temporary registration of the citizen in the place of temporary stay and are valid during the term specified in them in case of presentation of the passport, identity certificate of the serviceman or the certificate of birth (for persons which did not reach 16-year age).

The insert of temporary registration is made on single sample at the National production association "Davlat of Belgisa" at the expense of means of the Government budget of the Republic of Uzbekistan.

* The insert with the protected BARE-CODE becomes effective since April 1, 2019.

20. The mark about temporary registration in the passport of the applicant and the house register (registration card) for premises is not made.

21. The citizen who is temporarily registered in the area shall live in the place of temporary registration.

22. Registration in the place of temporary stay of the citizens who arrived to study to educational institutions is performed by the inspector OMIOG in the place of stay (premises).

In cases of the transfer to study to other educational institution located outside area, receipt of academic leave or expel from educational institution of the citizen, the management of data of organizations in day of adoption of the relevant decision notifies on it OMIOG, drawn up registration in the place of temporary stay in the place of its temporary stay.

Based on the notification of management of educational institution OMIOG cancels registration in the place of temporary stay.

23. Repeated registration of temporary registration is performed according to the procedure, stipulated in Item the 18th this provision.

24. The bases for refusal in registration of temporary registration are:

systematic making of offenses during stay in the place of temporary registration in the area;

availability of data that further stay of person in area will create condition for disorderly conduct;

availability of doubtful data in documents, stipulated in Item the 10th this provision.

In case of refusal in receipt of temporary registration by the citizen in the area, the inspector OMIOG constitutes the conclusion approved by the chief OMIOG in which the specific bases for refusal shall be specified.

The refusal in registration of temporary registration can be appealed judicially.

25. In case of loss or spoil of the insert about temporary registration, the citizen submits in corresponding OMIOG the application for execution of the duplicate of the insert for temporary registration with indication of circumstances of its loss or spoil and presentation of the document proving his identity.

The inspector OMIOG checks availability of data on temporary registration of this citizen in the specified place of stay. In case of their confirmation to the applicant the duplicate of the insert about temporary registration is drawn up on the same day.

26. The inspector OMIOG after issue of the insert about temporary registration to the applicant performs introduction corresponding the information about such citizens, in computer database OMIOG.

The inspector OMIOG fills arrival leaves (appendix No. 10 to this Regulations) on temporary registration of the citizen in the area and within a day sends them to address reference bureau of the Ministry of Internal Affairs of the Republic of Karakalpakstan or the Departments of Internal Affairs of areas.

Responsible persons of hotels, medical institutions, sanatoria, rest houses and other similar organizations in the area within 12 hours enter information on visitors in the specialized electronic automated program through the Internet (further - the Program).

OMIOG after introduction in the computer database of data on temporary registration of citizens transfer them on departmental data transmission network in real time to the central database of Head department of migration and registration of nationality (GUMIOG) of the Ministry of Internal Affairs of the Republic of Uzbekistan.

27. Inspectors of prevention of strong points of law-enforcement bodies exercise control of observance of rules of passport system in the territory served by them.

Chapter 5. Final provisions

28. Control of observance of requirements of this provision is exercised by Department of Internal Affairs and public authorities on places.

29. Registration of registration in the place of permanent residence and the place of temporary stay of citizens to non-residential premises is forbidden.

30. The homeowner providing living space for accommodation to the citizen who does not have registration in the place of permanent residence and the place of temporary stay in area for the term of at least five days shall notify on these persons of Department of Internal Affairs within five days from the date of provision of living space.

31. For registration of registration in the place of permanent residence and the place of temporary stay in the settlements located in border area also the entry visa in this zone got in accordance with the established procedure in law-enforcement bodies at the place of residence before entrance to border area is submitted.

32. Registration in the place of permanent residence and the place of temporary stay and cancellation of registration in the place of permanent residence of the citizen can be also made based on the power of attorney which is drawn up in accordance with the established procedure.

33. Persons guilty of violation of requirements of this provision bear responsibility according to the legislation.
