No. 83-87, 431) and article 6 of the Law No. 10/2009 on the state supervision of public health (The official monitor of the Republic of Moldova, 2009, No. 67, the Art. 183) DECIDES: the Government

1. Approve Sanitary regulations about the active and intellectual materials and products intended for contact with foodstuff it (is applied).

2. Resolve realization of the active and intellectual materials and products intended for contact with foodstuff, imported on the market legally before entry into force of these Regulations, before exhaustion of inventories.

3. To impose control over the implementation of this resolution on the National agency of public health.

4. This resolution becomes effective after 3 months from the date of publication.

Sanitary regulations about the active and intellectual materials and products intended for contact with foodstuff

The sanitary regulations about the active and intellectual materials and products intended for contact with foodstuff (further - Regulations) shift provisions of Regulations (SE) No. 450/2009 of the Commission of May 29, 2009 about the active and intellectual materials and products intended for the contact with foodstuff published in the Official magazine of the European Union by L 135/3 of May 29, 2009.

I. General provisions

1. These Regulations extend to the active and intellectual materials and products intended for contact with foodstuff, listed in the Sanitary regulations on the materials and products intended for contact with foodstuff approved by the Order of the Government No. 308/2011, which are made and placed in the market of the Republic of Moldova.

2. For the purpose of these Regulations the determinations stated in the Sanitary regulations about the materials and products intended for contact with foodstuff approved by the Order of the Government No. 308/2011, and in the Sanitary regulations about the materials and products from plastic intended for contact with foodstuff approved by the Order of the Government No. 278/2013, and also the following specific determinations are used:

component - individual substance or combination of separate substances which cause active and/or intellectual functions of material or product, including products of reaction of formation of these substances. The term "component" does not include passive parts, such as material to which it is added or in which it is included;

functional barrier - the barrier consisting of one or more layers of the materials intended for contact with foodstuff which guarantees that ready material or product in the normal or predicted conditions of use does not transfer to foodstuff the chemicals containing in them in quantities which can:

1) to pose threat for health of the person;

To lead 2) to unacceptable changes in structure of foodstuff;

To lead 3) to deterioration in organoleptic characteristics;

releasing active materials and products - the active materials and products designed with deliberate inclusion of components which emit substances in or for the packed foodstuff, or on environment in which there is foodstuff;

the released active agents - the substances intended for release from releasing active materials and products in or on the packed foodstuff, or on environment in which there is foodstuff and which play part in foodstuff.

3. Active and intellectual materials and products can be placed in the market only if:

1) are suitable and effective for proper use;

2) satisfy the general terms stated in Item 5 of Sanitary regulations on the materials and products intended for the contact with foodstuff approved by the Order of the Government No. 308/2011;

3) satisfy the special conditions stated in Items 7, 8 and 9 Sanitary regulations about the materials and products intended for the contact with foodstuff approved by the Order of the Government No. 308/2011;

4) conform requirements for marking, the stated subitem 5 of Item 11 of Sanitary regulations on the materials and products intended for the contact with foodstuff approved by the Order of the Government No. 308/2011;

5) satisfy the conditions concerning structure specified in Items 5-11 of these Regulations;

6) conform to the requirements of marking and declarations stated in Items 14-16 and 17-20 of these Regulations.

II. Structure and the list of the permitted substances which can be used in active and intellectual components

4. The national agency of public health will provide takeover and will make public the list of the permitted substances (further - the list) for inclusion in the active or intellectual materials and products intended for contact with foodstuff or the list (lists) of the active or intellectual materials and products intended for contact with foodstuff and, if necessary, special conditions of use of these substances and/or materials and products in which they are included.

5. The substances only included in the list can be adopted and used in components of the active and intellectual materials and products listed in appendix No. 2 to these Regulations.
