About approval of the Procedure for development and approval of standard rates granichno admissible emissions of pollutants from stationary sources

1. Approve the Procedure for development and approval of standard rates granichno of admissible emissions of pollutants from stationary sources it (is applied).
2. To provide to the ministry of protection of the surrounding environment of Ukraine together with the interested executive bodies which sphere of management the companies, the organizations and the organizations performing emissions of pollutants in atmospheric air from stationary sources treat during 2002-2007 step-by-step development of standard rates granichno of admissible emissions.
3. To the ministry of protection of the surrounding environment of Ukraine to develop till June 1, 2002 and to approve:
Technique of determination of standard rates granichno admissible emissions of pollutants from stationary sources;
the list of types of the equipment for which noted standard rates are developed.

1. This Procedure determines requirements concerning development and approval of standard rates granichno of admissible emissions of the pollutants and their set containing in composition of pylegazovozdushny mixes which are taken away from separate types of the equipment constructions and arrive in atmospheric air from stationary sources.
2. Norms granichno of admissible emissions of pollutants from stationary sources are determined by technique which affirms the Ministry of the environment, for the purpose of ensuring compliance with standard rates of ecological safety of atmospheric air taking into account economic feasibility, level of engineering procedures, technical condition of the equipment and gas-cleaning installations, requirements of the national legal system and the European Union law and are developed:
per unit mass for unit of time;
per unit of products or raw materials.
Rather admissible emissions of pollutants or their mixes (including extent of cultivation) the technological standard rates consisting from are established:
the current technological standard rates - for the operating separate types of the equipment, constructions at the level of the companies with the best existing production technology of engineering procedures, similar on capacity;
perspective technological standard rates - for the new and projectible, under construction or modernized, separate types of the equipment, constructions taking into account the advanced domestic and world achievements in the respective sphere.
Technological norms of admissible emissions of pollutants are determined in the place of their exit.
3. The standard rate granichno of admissible emission of pollutant from stationary source per unit mass for unit of time is established for certain actual mass speed in engineering procedure.
Mass speed is determined as the relation of all mass of materials which are used in specific engineering procedure (or in one finished transaction), by the time of implementation of this process.
4. The standard rate granichno of admissible emission of pollutant from stationary source per unit of products or raw materials is determined as the relation of amount of pollutant that is thrown out atmospheric air, to amount of products of the company or the raw materials used by it.
5. Standard rates granichno of admissible emissions of pollutants are developed for new stationary sources and the designed, under construction or modernized, separate types of the equipment, constructions taking into account the advanced domestic and world technologies and achievements in development of technologies of reduction of emissions of pollutants in atmospheric air.
In case when the European Union law for new stationary sources and designed, under construction or modernized, establishes standard rates granichno of admissible emissions of pollutants, in Ukraine regulations of this legislation are applied.
6. Standard rates granichno of admissible emissions of pollutants for the operating stationary sources are established on average values of the emissions determined for equipment types where amounts of such emissions are the smallest:
for 12 percent of types of the equipment - in the presence of 30 or more types;
for 5 types of the equipment - in the presence of less than 30 types.
7. The list of types of the equipment on which standard rates granichno of admissible emissions of pollutants from stationary sources are developed is determined by the Ministry of the environment.
8. Standard rates granichno of admissible emissions of pollutants from stationary sources are developed by the interested executive bodies which sphere of management the companies, organizations, the organizations performing emissions of pollutants in atmospheric air from stationary sources treat and affirm the Ministry of the environment.
9. The ministry of the environment performs at least once in 10 years review of standard rates granichno of admissible emissions of pollutants from stationary sources. The basis for such review is:
need of prevention or the data to minimum of general impact on the surrounding environment of emissions of pollutants;
availability of opportunities for reduction of emissions of pollutants and development of new engineering procedures taking into account economic feasibility of such reduction, technical condition of the equipment, gas-cleaning installations;
changes in the national legal system and the European Union law concerning emission limitation of pollutants from stationary sources.
