About approval of the Procedure for restriction of power consumption of consumers to the level of ecological armor of electric utility service or complete cessation of electric utility service by it and introduction of amendments to the resolution of the Cabinet of Ministers of Ukraine of August 31, 1995 No. 705

According to article 24 of the Law of Ukraine "About power industry" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for restriction of power consumption of consumers to the level of ecological armor of electric utility service or complete cessation of electric utility service by it (further - the Procedure) which is applied.

2. To the ministries, other central executive bodies, Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations to help power suppliers and the companies which perform transfer of electrical energy the high-level and local (local) power networks, the State inspectorate for energy supervision of the modes of consumption of electrical and heat energy in fulfillment of requirements of the Procedure approved by this resolution.

3. Bring in the resolution of the Cabinet of Ministers of Ukraine of August 31, 1995 No. 705 "About approval of the Regulations on procedure for disconnection of consumers from power supply sources" (the joint venture of Ukraine, 1996, No. 1, the Art. 25) the following changes:

to exclude Item 2 of the resolution;

in the Provision approved by the specified resolution:

in Item 1 of the word of "the heat and electric power" shall be replaced with words "heat energy (further - energy)";

third Item 2 to exclude the paragraph;

in Item 7 of the word of "the heat and electric power" to replace with the word "energies".

Procedure for restriction of power consumption of consumers to the level of ecological armor of electric utility service or complete cessation of electric utility service by it

1. This Procedure determines the sequence of actions of power suppliers, the companies which perform transfer of electrical energy the high-level and local (local) power networks (further - the electrotransferring organizations), body which exercises the state energy supervision of the modes of consumption of electrical and heat energy (further - Gosenergonadzor), and consumers (except the population) in case of introduction of restriction of power consumption of consumers to the level of ecological armor of electric utility service or complete cessation of electric utility service by it (daleeogranicheniye or the termination of electric utility service) in case of violation of discipline of payments by them for the consumed electric power, exceeding of limits of consumption of electrical energy and electric power, unsatisfactory technical condition and non-compliance with conditions of safe operation of electroinstallations.

Restriction or the termination of electric utility service are not applied to the objects of state-owned property having strategic importance for economy and safety of the state in the field of telecommunications and communication during the special period.

2. The power suppliers electroreporting the organizations or Gosenergonadzor not later than 3 working days before date of restriction or termination of electric utility service according to the functional obligations send to consumers the written prevention in which are noted the basis, date and time from which restriction or the termination of electric utility service will be introduced.

On planirovanny restriction or the termination of electric utility service of consumers which belong to ecologically or technogenic and dangerous it is at the same time notified to local executive bodies in the location of these consumers.

3. Consumers after receipt of the warning of restriction or the termination of electric utility service shall take measures for elimination of the reasons which caused the necessity of application concerning them such actions.

In case of impossibility of elimination of the specified reasons consumers shall:

take measures for prevention of injury rate or the threats of life working and the populations, to death of animals, damage to machinery, emergence of negative ecological and technogenic effects;

within a day to perform from own electroinstallations restriction of power consumption to the level of technological armor of electric utility service;

after safe completion of engineering procedure of production (with use of technological armor of electric utility service) to perform from own electroinstallations restriction of power consumption to the level of ecological armor of electric utility service or because of the absence of such completely to stop it.

In case of elimination by the consumer at the scheduled time of violations which caused the necessity of the warning of possible restriction or the termination of electric utility service concerning its electroinstallations actions for restriction or the termination of electric utility service are not applied.

4. Carrying out restriction or the termination electric utility service from power networks of power suppliers, the electrotransferring organizations is provided thus:

if restriction or the termination of electric utility service is performed by Gosenergonadzor, it provides the instruction to the corresponding power suppliers electroreporting to the organizations and consumers and the written notice is sent to the corresponding power supplier;

if restriction or the termination of electric utility service is performed by power suppliers, they send to the relevant electrotransferring organizations and consumers the written requirement and report about it to Gosenergonadzor;

if restriction or the termination of electric utility service is performed by the electrotransferring organizations, they send to consumers the written requirement and notify on it the corresponding power supplier and Gosenergonadzor.

5. The power suppliers electroreporting the organizations provide in terms according to requirements which are established by the legislation, this Procedure and terms of the contract of restriction of power consumption or the termination of electric utility service of consumers from own power networks taking into account the need of safe completion of engineering procedure of production at consumers established for them the size of ecological armor of electric utility service or its absence.

Written requirements of power suppliers, the electrotransferring organizations and the instruction of Gosenergonadzor concerning restriction or the termination of electric utility service are obligatory for accomplishment.
