About interaction of the State Parties of the CIS on ensuring readiness on case of nuclear accident or emergence of radiation emergency and mutual assistance in case of liquidation of their effects
The governments of the State Parties of the CIS which are hereinafter referred to as with the Parties
noting special importance of safety in the course of use of atomic energy in the peace purposes,
for the purpose of strengthening of already taken comprehensive measures for prevention of nuclear accidents and minimizing of their effects,
noting need of operational provision of information and the help in case of nuclear accident or emergence of radiation emergency for the purpose of minimization of cross-border radiation effects,
in view of the Concept of nuclear and radiation safety of the State Parties of the CIS in the field of use of atomic energy in the peace purposes of November 21, 2014, and also regulations of the Convention on the operational notification on nuclear accident of September 26, 1986 and the Convention on the help in case of nuclear or radiation emergency of September 26, 1986,
considering necessary simplification of procedures of movement of the specialized rescue units, the equipment, vehicles and materials used as hardware of these forming
aiming at ensuring nuclear and radiation safety, and also minimization of negative effects for the health of the population and the environment connected with use of atomic energy in the peace purposes
agreed as follows:
In addition to the terms determined by the Glossary of IAEA by safety issues (the edition of 2007) for the purposes of this agreement the used terms have the following values:
group on assistance – the organized group of qualified specialists of the providing Party directed for assistance in case of nuclear accident or radiation emergency, including incorporating the specialized rescue units equipped with special appliances, the equipment, equipment, tools and materials;
the requesting Party – the Party which appeals to other Party about the direction of groups on assistance or about provision of the special equipment, equipment, equipment, tools and materials;
the providing Party – the Party which grants request of the requesting Party for the direction of groups on assistance or for provision of the special equipment, equipment, equipment, tools and materials in coordination with authorized (competent) body of the requesting Party;
the authorized (competent) body – the ministry, department, the state corporation or other organization providing coordination of activities of the Party which is given authority on implementation of reaction and liquidation of nuclear accidents and radiation emergencies and is responsible for accomplishment of this agreement;
the term "nuclear accident" matters, determined in articles 1-3 of the Convention on the operational notification about nuclear accident of September 26, 1986.
The parties cooperate among themselves according to provisions of this agreement and other international treaties which participants are their states, for the purpose of assistance to immediate assistance in cases of nuclear accident or radiation emergency for minimizing of their effects and for protection of health of the population, property and the environment against impact of radioactive emissions and ionizing radiation.
The party in the territory of which state there was nuclear accident or arose radiation emergency, can address through the authorized (competent) body with the written appeal about assistance authorized (competent) bodies of other Parties.
Authorized (competent) bodies of the Parties jointly develop the unified notification forms on the basis of recommendations of IAEA, determine contents of the transmitted data, identification of the equipment of Items of communication and the notification, cooperate in creation of interstate monitoring system yaderno and radiation dangerous subjects to use of atomic energy.
The parties within 30 days after entry into force of this agreement through diplomatic channels notify depositary on the authorized (competent) bodies (and also on changes of the specified bodies), responsible for implementation of this agreement.
The help is provided based on the written address in which the requesting Party informs on nuclear accident or radiation emergency and, whenever possible, about assessment of degree of its danger, specifying type and amount of necessary assistance.
The providing Party instantly considers the appeal of the requesting Party and in turn informs the last on opportunity, amount and conditions, including financial, assistance, and also about the appointed heads of groups on assistance and carries out with it the corresponding approvals.
The requesting and providing Parties perform interaction through authorized (competent) bodies.
In case of impossibility of determination by the requesting Party of type and amount of necessary assistance and in the presence of the consent of the providing Party to give help the relevant authorized (competent) organs hold consultations with the purpose of refining of type and amount of the help.
The requesting or providing Party can send in writing the appeal to other Party at any time about the help termination then the Parties instantly hold consultations about procedure for completion of assistance.
The help in mitigation of consequences of nuclear accident or radiation emergency appears authorized (competent) bodies of the Parties by the direction of groups on assistance or provision of the special equipment, the equipment, equipment, tools and materials.
The management, control and coordination of actions of groups on assistance within the territory of the state of the requesting Party are performed by authorized (competent) body of the requesting Party.
Groups on assistance are used for accomplishment of wrecking in zone of nuclear accident or radiation emergency.
The requesting Party informs groups on assistance on the situation which developed in zone of nuclear accident or radiation emergency on specific sites of works and if necessary provides these groups with means of communication, centralized placement and food, and also provides protection and will organize delivery of health care on a grant basis.
Equipment of groups on assistance by necessary means shall be sufficient for conducting autonomous actions in zone of nuclear accident or radiation emergency within 72 hours if other is not stipulated by authorized (competent) bodies of the requesting and providing Parties in addition. Upon termination of inventories the requesting Party provides the specified groups with necessary means for their further work if other is not stipulated by the Parties in addition.
The requesting Party according to the legislation of the state provides first-priority (priority) entrance on the territory of its state for groups on assistance of the providing Party.
