About approval of General provisions of safety in case of removal from operation of nuclear power plants and research nuclear reactors

For ensuring legal regulation of removal from operation of nuclear power plants and research nuclear reactors and accomplishment of provisions of the Memorandum of understanding between the Government of Ukraine and the governments of the countries of "Group of Seven" and the Commission of the European commonwealth concerning closing of the Chernobyl NPP of December 20, 1995, taking into account the agreements reached on April 19-20, 1996 during the Moscow summit concerning nuclear safety and on accomplishment of the resolution of the Cabinet of Ministers of Ukraine of December 22, 1997 No. 1445, and also according to articles 18 and 39 of the Law of Ukraine "About use of nuclear energy and radiation safety" PRIKAZYVAYU:

1. Approve General provisions of safety in case of removal from operation of nuclear power plants and research nuclear reactors which are applied.

2. Costitute General provisions of safety in case of removal from operation of nuclear power plants and research nuclear reactors after state registration in the Ministry of Justice of Ukraine and establish the term of the first check of observance of these provisions - November, 2000.

3. Consider Item 5.6 of Section 5 of "General provisions of safety of nuclear power plants" (OPB-88) PNAEG-1-011-89 such that is not applied in the territory of Ukraine.

4. Minekobezopasnosti (Bogdan L. S.) to provide to management of radiation technologies and radioactive waste provisions of this order in five-day time on state registration in the Ministry of Justice of Ukraine.

5. To impose control over the implementation of this order on the head of Administration of nuclear regulation - the First deputy minister of protection of the surrounding environment and nuclear safety Smyshlyaev O. E.

General provisions of safety in case of removal from operation of nuclear power plants and research nuclear reactors

1. General provisions

1.1. This document determines general provisions concerning safety in case of removal from operation of blocks of nuclear power plants and research nuclear reactors (further installations) which did not suffer off-project accidents.

1.2. Requirements of this document are obligatory for all legal entities and physical persons which perform the activities connected with removal from operation of installations.

1.3. The safety purpose in case of removal of installation from operation is protection of personnel, the population and the environment against adverse effect of ionizing radiation and protection of future generations.

1.4. Removal of installation from operation is performed for exception of possibility of further use of this installation for the purpose of for which it was constructed.

1.5. Removal of installation from operation is performed for achievement in the territory which is occupied by installation, conditions that as much as possible reduce restriction for use of this territory. It provides:

- gradual release of installation from sources of ionizing radiation which are subject to control;

- cancellation of the mode of restrictions and reducing radiation control in zone of observation and the sanitary protection zone of installation.

1.6. Achievement in full of the purpose noted in item 1.5 of this document is not obligatory if based on part of installation which is taken out of service new object (new nuclear installation or the object appointed for the treatment of radioactive waste) be created.

In this case all actions and procedures shall be implemented that provided by regulatory legal acts and normative and technical documents for object which is recreated.

1.7. Certain part of installation which is taken out of service can be attached to other already existing object which is operated. The decision on inclusion of this part of installation in structure of such object shall be approved with Ministry for Protection of the Environment and Natural Resources of Ukraine and bodies of the public sanitary and epidemiologic service.

Part of installation is considered the installation excluded from structure that is taken out of service, after registration, approval and approval of all relevant documents on its inclusion in object which is operated or constructed.
