About approval of Rules of revenues in special (out-of-competition) procedure to separate managerial positions of the public civil service in Government office of the Kyrgyz Republic

For the purpose of streamlining of questions of revenues to the public civil service in Government office of the Kyrgyz Republic and its passing, according to article 24 of the Law of the Kyrgyz Republic "About the public civil service and municipal service", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Rules of revenues in special (out-of-competition) procedure to separate managerial positions of the public civil service in Government office of the Kyrgyz Republic according to appendix.

2. To the chief of staff of the Government - the minister of the Kyrgyz Republic to take the measures following from this Resolution and for its strict execution.

3. Declare invalid the Order of the Government of the Kyrgyz Republic "About approval of Rules of revenues in special (out-of-competition) procedure to separate managerial positions of the public civil service in Government office of the Kyrgyz Republic" of February 10, 2017 No. 94.

4. This Resolution becomes effective after seven days from the date of official publication.

Rules of revenues in special (out-of-competition) procedure to separate managerial positions of the public civil service in Government office of the Kyrgyz Republic

1. General provisions

1. These rules of revenues in special (out-of-competition) procedure to separate managerial positions of the public civil service in Government office of the Kyrgyz Republic (further - Rules) determine conditions and procedure for revenues in special (out-of-competition) procedure to separate managerial positions of the public civil service in Government office of the Kyrgyz Republic (further - managerial positions).

2. The nomenclature of managerial positions for appointment

2. The Prime Minister of the Kyrgyz Republic performs appointment in special (out-of-competition) procedure to managerial positions:

1) deputy managers (including the first) Government office of the Kyrgyz Republic;

2) advisers and assistants to the Prime Minister of the Kyrgyz Republic, and also advisers and assistants to vice-Prime Ministers of the Kyrgyz Republic (including the first);

3) heads of structural divisions (managers of departments, deputy managers of departments, managers of sectors) of Government office of the Kyrgyz Republic;

4) special, permanent and plenipotentiaries of the Government of the Kyrgyz Republic in the relevant state bodies and international organizations.

3. The chief of staff of the Government - the minister of the Kyrgyz Republic (further - the Chief of staff of the Government) performs appointment in special (out-of-competition) procedure to managerial positions:

1) inspectors, experts of structural divisions of Government office of the Kyrgyz Republic;

2) assistants of structural divisions of Government office of the Kyrgyz Republic;

3) adviser to the head of state body (adviser to the Chief of staff of the Government), assistant administrators of Government office;

4) press secretary of the Prime Minister of the Kyrgyz Republic.

3. Conditions and procedure for appointment to managerial position

4. The candidate for replacement of vacant managerial position shall conform to the following requirements:

1) to be citizen of the Kyrgyz Republic;

2) to conform to the qualification requirements established by the legislation of the Kyrgyz Republic in the sphere of the public civil service and municipal service and also qualification requirements to the managerial state positions of Government office of the Kyrgyz Republic approved by the Chief of staff of the Government;

3) to assume the restrictions connected with the public civil service stipulated by the legislation the Kyrgyz Republic in the sphere of the public civil service and municipal service.

5. Person cannot be the candidate for replacement of vacant managerial position:

1) recognized as the judgment incapacitated or who conviction of court is forbidden to perform activities serving or to hold certain positions of the public and municipal service;

2) having the criminal record which is not removed or not extinguished in the procedure established by the legislation.

6. In case of appointment to managerial position it is preferred as candidates:

1) consisting in internal reserve of personnel of Government office of the Kyrgyz Republic or in the National reserve of personnel of the Kyrgyz Republic;

2) not consisting in the register of persons dismissed from the public or municipal service on the negative bases;

3) having work experience:

- in central offices of state bodies and/or offices of local government bodies of the cities of republican value;

- as the head (deputy manager) of organization, the organization or the company which is in structure of state body or local government body, the head of the structural unit of state body or local government body;

- at the different levels of public administration (republican and local).

7. Taking into account specialization of the relevant structural division of Government office of the Kyrgyz Republic and functional features of specific managerial position by the Chief of staff of the Government additional qualification requirements can be established, compliance to which is benefit in case of appointment to managerial position.

8. Confirmation of conformity to qualification requirements is performed on the basis:

1) provided by the candidate:

- the documents of the established sample confirming availability of professional education (copies of the diplomas and certificates certified notarially or on place of employment);

- copies of the service record certified notarially or on place of employment;

- the summary with indication of the achieved professional results on place of employment, on the form approved by the Chief of staff of the Government;

- at least three recommendations from heads and colleagues on the prior workplaces knowing the candidate on professional joint operation and confirming the high professional and moral and personal level of the candidate with indication of the achieved results.
