About approval of the Regulations on accreditation of child care facilities of residential type, irrespective of the patterns of ownership performing activities for care of children

For the purpose of enhancement of the procedure of accreditation of the subjects rendering services to the children who are in difficult life situation according to articles 26 and 39 of the Code of the Kyrgyz Republic about children, articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on accreditation of child care facilities of residential type, irrespective of the patterns of ownership performing activities for care of children according to appendix.

2. Declare invalid the Order of the Government of the Kyrgyz Republic "About approval of the Regulations on accreditation of the subjects rendering services to the children who are in difficult life situation" of March 23, 2015 No. 140.

3. To the Ministry of Labour and social development of the Kyrgyz Republic to take necessary measures for implementation of this Resolution.

4. To impose control of execution of this Resolution on department of social development of Government office of the Kyrgyz Republic.

5. This Resolution becomes effective after ten days from the date of official publication.

Provision
about accreditation of child care facilities of residential type, irrespective of the patterns of ownership performing activities for care of children

Chapter 1. General provisions

1. This Regulations on accreditation of child care facilities of residential type, irrespective of the patterns of ownership performing activities for care of children (further - the Provision), determine the basic principles, tasks, requirements, procedure and conditions of carrying out accreditation of the child care facilities of residential type rendering services to the children who are in difficult life situation.

2. In this Provision the following concepts are used:

child care facilities of residential type - organization, irrespective of pattern of ownership, the rendering services to the children who are in difficult life situation, and intended for the round-the-clock stay of children;

the subject of accreditation - the child care facilities of residential type of all patterns of ownership rendering services in content and day-and-night care for the children who are in difficult life situation;

accreditation - assessment procedure of subjects of accreditation by results of which the certificate on accreditation certifying that the accredited organization conforms to the established requirements is granted;

the accredited organization - the organization recognized by authorized body to render services to the children who are in difficult life situation, and received in accordance with the established procedure the certificate on accreditation;

authorized body - the state body authorized by the Government of the Kyrgyz Republic on protection of children performing accreditation;

the certificate on accreditation - the official document issued by authorized body on activities implementation to subjects of accreditation for provision of high-quality services in day-and-night care and content of the children who are in difficult life situation;

assessment - action for high-quality and quantitative determination of compliance of services of the subject of accreditation to the established requirements;

the valuation report - the document on results of assessment submitted by expert group to authorized body for confirmation of professional activity of the subject of accreditation on care of children.

3. The main objectives of accreditation are:

- ensuring provision of high-quality services to the children who are in difficult life situation;

- improvement of quality of provision of services to the children who are in difficult life situation;

- determination of skill level of activities of the accredited organizations;

- development of competitive environment in the sphere of rendering services to the children who are in difficult life situation.

4. Accreditation is based on the following principles:

- availability of information on procedures, accreditation criterions;

- transparency of carrying out accreditation;

- non-admission of discrimination when carrying out accreditation;

- unity and integrity of accreditation system.

5. Accreditations are subject the child care facilities of residential type irrespective of patterns of ownership performing activities for care of the children who are in difficult life situation, intended for the round-the-clock stay of children.

6. Accreditation is subdivided into initial accreditation which is carried out prior to provision of services by subjects of accreditation, and the repeated accreditation which is carried out at least once in three years.

7. Aggregate term of consideration of the applications of subjects of accreditation and decision making on them constitutes 30 working days.

8. Requirements imposed to subjects of accreditation:

- obligatory passing of the procedure of accreditation;

- compliance with law of the Kyrgyz Republic on acceptance of children in accreditation subject;

- provision of services on day-and-night care and content of children according to the Minimum standards on care, education and socialization of children in the organizations rendering social services to the children who appeared in difficult life situation approved by the Order of the Government of the Kyrgyz Republic of October 9, 2012 No. 691 (further - the minimum standards);

- safety of the children staying in the subject of accreditation.

Chapter 2. Rights and obligations of authorized body and subject of accreditation

9. The authorized body has the right:

- request in accordance with the established procedure from legal entities and physical persons information on activities of subjects of accreditation;

- perform assessment of the subject of accreditation;

- perform monitoring of accredited subjects of accreditation;

- inform the state and judicial authorities, and also the public on accredited subjects of accreditation.

10. The authorized body fulfills the following duties:

- performs accreditation of subjects of accreditation;

- makes the decision on accreditation or refusal in accreditation, on suspension or renewal of action of the certificate on accreditation;
