1. Approve enclosed:

1) the List of executive positions in operational investigative divisions of bodies of state revenues (service of the economic investigations) replaced on competitive basis according to appendix 1 to this order;

2) Rules and conditions of carrying out tender on higher executive positions in operational investigative divisions of bodies of state revenues (service of economic investigations) according to appendix 2 to this order.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules and conditions of carrying out tender on higher executive positions in operational investigative divisions of bodies of state revenues (service of economic investigations)

Chapter 1. General provisions

1. These rules and conditions of carrying out tender on higher executive positions in operational investigative divisions of bodies of state revenues (service of economic investigations) (further - Rules) are developed according to Item 1-1 of article 33 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service" (further - the Law) and determine procedure and conditions of carrying out tender on higher executive positions in service of economic investigations (further - the SIR).

2. Competition is held by the bodies of state revenues on areas, the cities of republican value and the capital having vacant and temporarily vacant positions (further - vacant positions) according to the list of the executive positions in the SIR replaced on competitive basis.

3. Tender consists of the following types:

1) internal tender - tender among employees the SIR (further - internal tender);

2) external tender - tender among the staff of all law enforcement agencies (further - external tender).

4. In the absence of the candidates who received the positive decision of tender committee at internal tender external competition is held.

5. The main selection criteria of candidates for the admission to tender on higher executive positions are:

the candidate's compliance to imposed qualification requirements stipulated in Item 3 articles 29 of the Law, to business and personal qualities;

results of office activities.

6. In reorganization cases, or liquidation of body of state revenues, the announced competition is subject to cancellation at any stage of its carrying out with the obligatory notification about it on Internet resources of bodies of state revenues.

Chapter 2. Forming of tender committee

7. For the announcement and carrying out tender by body of state revenues the tender committee for implementation of candidate screen on higher executive positions (further - tender committee), the Chairman and which structure affirms the head of the body of state revenues having the right of appointment to the corresponding position is created.

8. The tender committee consists at least of 5 (five) members, including the chairman. At the same time tender committee representatives of service of internal security whose personnel service and structural divisions for vacancies competition is held are included.

9. The secretary of the commission is the representative of personnel service who performs organizational support of its work and does not take part in vote.

10. The solution of tender committee is the basis for occupation of higher executive position or refusal in appointment to the corresponding position.

Chapter 3. Procedure and conditions of carrying out internal tender

11. The announcement of carrying out internal tender is published on Internet resource of bodies of state revenues.

12. The application for participation in internal tender is submitted to personnel service, no later than 3 (three) working days after day of release of the publication of the announcement on Internet resource of bodies of state revenues in form according to appendix 1 to these rules.

The copy of the identity document of the candidate is enclosed to the application.
