About approval of Rules of implementation of technical advice behind decked small size vessels
According to subitem 55-26) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" and subitem 26-28) of Item 1 of article 9 of the Law of the Republic of Kazakhstan of July 6, 2004 "About inland water transport" PRIKAZYVAYU:
1. Approve the enclosed Rules of implementation of technical advice behind decked small size vessels.
2. Declare invalid the order of the acting minister on investments and development of the Republic of Kazakhstan of April 17, 2015 No. 458 "About approval of Rules on technical advice behind small size vessels" (it is registered in the Register of state registration of regulatory legal acts for No. 11351, it is published on July 10, 2015 in information system of law of Ad_let).
3. To provide to committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.
4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
5. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of implementation of technical advice behind decked small size vessels (further - Rules) are developed according to subitem 55-26) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" and subitem 26-28) of Item 1 of article 9 of the Law of the Republic of Kazakhstan of July 6, 2004 "About inland water transport" and determine procedure of technical advice behind decked small size vessels.
2. These rules extend to the decked small size vessels which are subject to state registration in the ship book.
3. In these rules the following concepts are used:
1) the decked small size vessel - the small size vessel having the horizontal waterproof overlapping from nose to stern from flooring and set in the vessel case relying on boards, partitions and deck stanchions;
2) the Shipping register - the republican state state company of classification and ensuring technical safety of ships, decked small size vessels created according to the decision of the Government of the Republic of Kazakhstan;
3) technical advice - activities of the Shipping register for survey of decked small size vessels;
4) survey - survey of the vessel for the purpose of determination of its technical condition according to the requirements established by the technical regulations and rules of the Shipping register aimed at safety control of navigation of the vessel taking into account its purpose and confirmation of class;
5) the Act of survey of the decked small size vessel - the document issued by the Shipping register and containing results of survey;
6) removal to the place of shelter - the most admissible kilometric distance (further - km) which is measured along the shortest safe way in the navigation relation from point on the route chosen for navigation of the vessel, to the nearest available port or the place of shelter;
7) the place of shelter - naturally or artificially protected water area which is used judgment as shelter in case of circumstances which threaten its safety;
8) wave height of 1% of security (% h1) - wave height characterizing the mode of cross sea in which in case of continuous long observation of 1% of the actual waves have height exceeding specified;
9) wave height of 3% of security (% h3) - wave height characterizing the mode of cross sea in which in case of continuous long observation of 3% of the actual waves have height exceeding specified.
4. The technical advice is exercised based on the request of the shipowner in form, according to appendix 1 to these rules.
5. By results of technical advice the Shipping register to the shipowner issues the Act of survey of the decked small size vessel.
6. The technical advice consists of the following stages:
1) initial assignment survey;
2) repeated survey;
3) extraordinary survey.
7. Initial assignment survey is carried out ashore or afloat.
In case of registration of the vessel in the Shipping register before its state registration, the vessel undergoes initial assignment survey for confirmation of the actual compliance of the vessel to the data on it specified in documents of title.
During initial assignment survey operability and operability of ship technical means, technical documentation is checked for the vessel, conditions, technical requirements on its load-carrying capacity and passenger capacity, power carrying capacity and the number of engines (suspended motors), the admissible area of sails, the sailing area (to removal from the coast), to the minimum height of freeboard, the allowed wave height, equipment are established by life and fire-proof preservers, signal lights, aid and other to navigation.
8. The decked small size vessel shown to initial assignment survey for the purpose of registration is completed with rescue and other supply, according to appendix 2 to these rules (further - appendix 2).
9. Repeated survey is carried out no later than 5 (five) working days before the term of the initial assignment survey specified in the Act.
