DECISION OF BOARD OF THE EURASIAN ECONOMIC COMMISSION

of October 30, 2018 No. 179

About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions

According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix № 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of November 6, 2014 № 200, the Board of the Eurasian economic commission decided:

1. Approve enclosed:

Rules of information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions;

Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions;

Regulations of information exchange between customs authorities of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions;

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions;

Procedure for accession to general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions.

2. Determine that development of technical schemes of structures of the electronic documents and data provided by the Description approved by this Decision, and ensuring their placement in the register of structures of the electronic documents and data used in case of realization of information exchange in the integrated information system of foreign and mutual trade are performed by department of the Eurasian economic commission which competence includes coordination of works on creation and development of the integrated information system of the Eurasian Economic Union.

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Rules of information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions

I. General provisions

1. These rules are developed according to the following international treaties and acts constituting the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The decision of Council of the Eurasian economic commission of September 18, 2014 No. 73 "About the Concept of use in case of interstate information exchange of services and effectual in law electronic documents";

The decision of Board of the Eurasian economic commission of August 16, 2012 No. 134 "About regulatory legal acts in the field of non-tariff regulation";

The decision of Board of the Eurasian economic commission of November 6, 2014 No. 199 "About the Instruction about execution of the statement on licensing for export and (or) import of separate types of goods and about execution of such license and Instruction about execution of the import permit and (or) import of separate types of goods";

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Eurasian economic commission of April 21, 2015 No. 30 "About measures of non-tariff regulation";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 28, 2015 № 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and with the Eurasian economic commission".

II. Scope

2. These rules "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" (further – general process) in the part concerning licenses and permissions including the description of the procedures performed within this general process are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process.

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"the document granting the right to export and (or) import of separate types of goods" – the export license and (or) import of separate types of goods or the import permit and (or) import of separate types of goods;

"license" – the export license and (or) import of separate types of goods;

"permission" – the import permit and (or) import of separate types of goods;

"the national database" – the information resource of authorized body of state member containing data on the issued documents granting the right to export and (or) import of separate types of goods.

The concepts "import" and "export" used in these rules are applied in the values determined by the Protocol on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014).

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

IV. Main data on general process

5. Full name of general process: "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods". General process is implemented in the part concerning licenses and permissions.

6. Specification symbol of the general process realized in the part concerning licenses and permissions: P.AT.03, version 1.0.0.

1. Purpose and tasks of general process

7. The purposes of general process are:

a) simplification and acceleration of the procedures connected with export (import) of goods;

b) exception of abuses in case of submission of licenses and permissions to customs authorities of state members of the Union (further – state member).

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the automated obtaining by the Eurasian economic commission (further – the Commission) from authorized bodies of state members of information on issue of licenses and permissions, about suspension or renewal of action of the granted licenses, about cancellation of the granted licenses and permissions, and also about issue of duplicates of licenses or permissions;

b) provide the automated submission by the Commission to customs authorities of state members of data on the granted licenses and permissions got from authorized bodies of state members.

2. Participants of general process

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of submission of data on the granted licenses and (or) permissions in the Commission;

b) procedures of submission of data on the granted licenses and (or) permissions in customs authority of state member.

11. Authorized bodies of state members provide forming and maintaining national databases and represent data on the granted licenses and (or) permissions, data on suspension or renewal of action of the granted licenses, data on cancellation of the granted licenses or permissions, and also data on issue of duplicates of the licenses or permissions which are drawn up on paper to the Commission on measure of modification of national databases. The commission processes the data received from authorized bodies of state members and represents to customs authorities of state members of the data on the granted licenses and (or) permissions from national databases according to the parameters specified in request.

Information exchange between authorized bodies of state members and the Commission, and also between the Commission and customs authorities of state members is performed with use of the integrated information system.

12. The provided description of structure of general process is provided in the figure 1.

13. The procedure for performing procedures of general process, grouped according to the destination, including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language – Unified Modeling Language) and supplied with the text description.

4. Group of procedures of submission of data on the granted licenses and (or) permissions in the Commission

15. Performing procedures of submission of data on the granted licenses and (or) permissions in the Commission begins in case of change of state member of data by authorized body on the granted licenses or permissions in the national database.

In case of performing procedures of submission of data on the granted licenses and (or) permissions in the Commission the authorized body of state member in process of modification of the national database sends to the Commission of the data on the granted licenses and (or) permissions, and also data on suspension or renewal of action of the granted licenses, on cancellation of the granted licenses and permissions, and also on issue of duplicates of licenses or permissions (change of data on the granted licenses and (or) permissions). Submission of the specified data is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions, the approved Decision of Board of the Eurasian economic commission of October 30, 2018 No. 179 (further – Regulations of information exchange between authorized bodies of state members and the Commission). The format and structure of the represented data shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions, to No. 179 approved by the Decision of Board of the Eurasian economic commission of October 30, 2018 (further – the Description of formats and structures of electronic documents and data).

In case of submission of data on the granted license and (or) the permission included in the national database the "Submission of Data on the Granted License or the Permission Included in the National Database" procedure is performed (P.AT.03.PRC.001).

In case of submission of data on the changes made to the national database (in case of suspension or renewal of action of the granted license, cancellation of the granted license or permission, and also in case of issue of duplicates of the licenses or permissions which are drawn up on paper), the "Submission of Data on the Granted License or the Permission Changed in the National Database" procedure is performed (P.AT.03.PRC.002).

16. The provided description of group of procedures of submission of data on the granted licenses and (or) permissions is provided to the Commission in the figure 2.

5. Group of procedures of submission of data on the granted licenses and (or) permissions in customs authority of state member

18. Procedures of submission of data on the granted licenses and (or) permissions in customs authority of state member are carried out in case of receipt of the corresponding requests from information systems of customs authorities of state members.

Within performing procedures of submission of data on the granted licenses and (or) permissions in customs authority of state member the following types of the requests arriving from information systems of customs authorities of state members are processed:

a) information request about date and time of updating of national databases;

b) request of data on the licenses and (or) permissions containing in national databases, in full or as of certain date;

c) request of data on the changes made to national databases.

Submission of the specified data is performed according to Regulations of information exchange between customs authorities of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the database about the granted licenses, permissions and the conclusions (allowing documents) in the field of foreign trade in goods" in the part concerning licenses and permissions, the approved Decision of Board of the Eurasian economic commission of October 30, 2018 No. 179 (further – Regulations of information exchange between customs authorities of state members and the Commission). The format and structure of the represented data shall match the Description of formats and structures of electronic documents and data.

Information request about date and time of updating of national databases is carried out by customs authority of state member for the purpose of assessment of need of synchronization of data on the licenses and (or) permissions which are stored in information system of customs authority of state member with the data on licenses and (or) permissions containing in national databases. Information on date and time of updating of national databases is requested or regarding data on licenses and (or) permissions in full, or information on date and time of updating of part of data of national databases on the identifier of the authorized body of state member which issued the document, or on state member code, or by the form the document, or on the document identifier is requested. When implementing request the "Receipt of Information on Date and Time of Updating of Data on the Granted Licenses and (or) Permissions" procedure is performed (P.AT.03.PRC.003).

The request of data on licenses and (or) permissions is carried out from national databases for the purpose of obtaining by customs authority of state member of data on the licenses and (or) permissions included in national databases. The data on licenses and (or) permissions containing in national databases are requested or in full (taking into account historical data), or for certain date, or by the state member code, or on the identifier which issued the document of authorized body of state member, or by the form the document or on the document identifier. The request of data on licenses and (or) permissions from national databases is in full used in case of initial loading of data on licenses and (or) permissions in information system of customs authority of state member, for example, in case of initialization of general process, connection to it of the new participant of general process, recovery of information after failure. When implementing request the "Receipt of Data on the Granted Licenses and (or) Permissions" procedure is performed (P.AT.03.PRC.004).

In case of information request about the changes made to national databases data on licenses and (or) permissions which were added to national databases or to which changes in national databases since the moment specified in request until accomplishment of this request were made are represented. The changed data on licenses and (or) permissions are requested or in full since the date specified in request or by the state member code, or on the identifier which issued the document of authorized body of state member, or by the form the document or on the document identifier. When implementing request the "Receipt of the Changed Data on the Granted Licenses and (or) Permissions" procedure is performed (P.AT.03.PRC.005).

19. The provided description of group of procedures of submission of data on the granted licenses and (or) permissions is provided to customs authority of state member in the figure 3.

VI. Responsibility of participants of general process

22. Attraction to disciplinary responsibility for non-compliance with the requirements aimed at providing timeliness and completeness of transfer of the data participating in information exchange of officials and staff of the Commission is performed according to the Agreement on the Eurasian Economic Union of May 29, 2014, other international treaties and acts constituting the right of the Union, and officials and the staff of authorized bodies of state members and (or) customs authorities of state members – according to the legislation of state members.

VIII. Procedures of general process

1. Procedures of submission of data on the granted licenses and (or) permissions in the Commission

"Submission of Data on the Granted License or the Permission Included in the National Database" procedure (P.AT.03.PRC.001)

24. The scheme of accomplishment of the "Submission of Data on the Granted License or the Permission Included in the National Database" procedure (P.AT.03.PRC.001) is provided in the figure 4.

25. The "Submission of Data on the Granted License or the Permission Included in the National Database" procedure (P.AT.03.PRC.001) is carried out in case of inclusion of state member of data by authorized body on the granted license or permission in the national database.

26. The first carries out transaction "Submission of data on the granted license or permission" (P.AT.03.OPR.001) by results of which accomplishment the authorized body of state member sends to the Commission of the data on the granted license or permission, included in the national database.

27. In case of receipt in the Commission of data on the granted license or permission transaction "Acceptance and processing of data on the granted license or permission" is carried out (P.AT.03.OPR.002) by results of which accomplishment the Commission receives the specified data, carries out their processing and sends the notification on processing of the provided data to authorized body of state member.

28. In case of receipt in authorized body of state member of the notification on processing of data on the granted license or permission transaction "Receipt of the notification on processing of data on the granted license or permission" is carried out (P.AT.03.OPR.003) by results of which accomplishment the authorized body of state member which directed data performs processing of the received notification on processing of data.

29. Result of accomplishment of the "Submission of Data on the Granted License or the Permission Included in the National Database" procedure (P.AT.03.PRC.001) is processing by the Commission of data on the granted license or the permission included in the national database.

30. The list of the transactions of general process which are carried out within the "Submission of Data on the Granted License or the Permission Included in the National Database" procedure (P.AT.03.PRC.001), is given in table 6.
