1.2. Form of the decision on not permission of entry into the Russian Federation foreign citizen or stateless person (appendix No. 2);

1.3. Form of the decision on cancellation of the decision on not permission of entry into the Russian Federation foreign citizen or stateless person (appendix No. 3);

1.4. Form of the notification of the foreign citizen or stateless person of the decision on not permission of entry into the Russian Federation made on it (appendix No. 4).

Procedure for consideration of the materials containing the circumstances which are the basis for adoption (cancellation) of the decision on not permission of entry into the Russian Federation concerning the foreign citizen or the stateless person

1. This Procedure determines the procedure of consideration of the materials containing circumstances which are the basis for adoption (cancellation) of the decision on not permission of entry into the Russian Federation concerning the foreign citizen or the stateless person (further - the decision on not permission of entrance).

2. Structural division of central office of Rosfinmonitoring or territorial authority of Rosfinmonitoring (further - the initiating division) in case of identification of the circumstances specifying availability of the bases provided by subitems 1 and 7 of part 1 of article 27 of the Federal Law of August 15, 1996 No. 114-FZ "About procedure for departure from the Russian Federation and entry into the Russian Federation" (The Russian Federation Code, 1996, No. 34, Art. 4029; 2003, No. 2, Art. 159; 2006, No. 31 (h 1), Art. 3420; 2007, No. 3, Art. 410; 2008, No. 30 (h 2), Art. 3616; 2012, No. 53 (h 1), Art. 7597; 2013, No. 27, Art. 3470, No. 30 (h 1), Art. 4040, 4057, No. 52 (h 1), Art. 6954; 2014, No. 52 (h 1), Art. 7557; 2015, No. 1 (h 1), Art. 77; 2016, No. 1 (h 1), Art. 58; 2017, No. 27, the Art. 3928) (further - the Federal Law No. 114-FZ) and being within the competence of Rosfinmonitoring, prepares and sends to the structural division of central office of Rosfinmonitoring authorized on implementation of functions on counteraction to terrorism financing (further - authorized division):

a) the letter on consideration of materials for decision making about not permission of entrance in which are specified:

the surname, name, middle name (in the presence) written by letters Russian and Latin (if is available) alphabets, birth date and birth place, nationality (in the presence), the place of stay (accommodation) of the foreign citizen or stateless person (further - the foreign citizen);

data on availability of permission to temporary residence or residence permit;

details of the identity document (in the presence);

identification number of the foreign citizen according to the legislation of foreign state (if is available);

the circumstances specifying availability of the bases for decision making about not permission of entrance provided by subitems 1 and 7 of part of 1 Federal Law No. 114-FZ;

the circumstances important by consideration of question of decision making about not permission of entrance (in the presence) (for example: the foreign citizen is refugee, the employee of diplomatic representation or consular establishment of foreign state or the employee of the international organization or its representation in the Russian Federation, has close relatives who have citizenship of the Russian Federation);

b) materials which confirm the bases for decision making about not permission of entrance.

3. The letter specified in the subitem "an" of Item 2 presents of the Procedure is signed by the chief (head) of the initiating division (person fulfilling its duties).

4. Authorized division:

a) 2 presents of the Procedure specified in Item consider documents and checks them regarding availability of the bases for decision making about not permission of entrance;

b) during consideration of the materials containing the circumstances which are the basis for decision making about not permission of entrance performs check of the foreign citizen on the information resources provided to Rosfinmonitoring of the Ministry of Internal Affairs of Russia in accordance with the legislation of the Russian Federation in the sphere of counteraction of legalization (washing) of income gained in the criminal way and to terrorism financing;

c) in the presence in the provided materials of the bases for decision making about not permission of entrance prepares the draft decision about not permission of entrance according to appendix No. 2 to the order which approved this Procedure vises it at the supervising deputy director of Rosfinmonitoring (person fulfilling its duties) and submits for approval to the director of Rosfinmonitoring (person fulfilling its duties) no later than fifteen working days from the date of document registration specified in Item 2 presents of the Procedure in time;
