Declare invalid the joint order of the Minister of cases of public service of the Republic of Kazakhstan of April 14, 2016 No. 76 and the Minister of national economy of the Republic of Kazakhstan of April 26, 2016 No. 186 "About approval of criteria for evaluation of risk degree and checking sheets behind compliance with law in the sphere of public service by state bodies and behind respect for office ethics by government employees" (it is registered in the Register of state registration of regulatory legal acts for No. 13744, it is published on June 8, 2016 in information system of law of Ad_let).

3. In the sphere of public service of the Agency of the Republic of Kazakhstan for public service and to anti-corruption in the procedure established by the legislation to provide to inspection department:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this joint order the direction it the copy in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this joint order on Internet resource of the Agency of the Republic of Kazakhstan for public service and to anti-corruption.

4. To impose control of execution of this joint order on the vice-chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of Bektenov O. A.

5. This joint order becomes effective after ten calendar days from the date of its first official publication.

Chapter 1. General provisions

1. These Criteria for evaluation of risk degree behind compliance with law in the sphere of public service by state bodies and behind respect for office ethics by government employees (further – Criteria) are accepted according to the Entrepreneurial code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan" (further – the Law), the Ethical code of government employees of the Republic of Kazakhstan (Rules of office ethics of government employees) approved by the Presidential decree of the Republic of Kazakhstan of December 29, 2015 No. 153 (further – the Ethical code), and also Rules of forming by state bodies of system of risks assessment and form of checking sheets, approved by the order of the acting minister of national economy of the Republic of Kazakhstan of July 31, 2018 No. 3 (it is registered in the Register of state registration of regulatory legal acts for No. 17371) for selection by the Agency of the Republic of Kazakhstan for public service (further – the Agency) and its territorial subdivisions of state bodies for the purpose of conducting checks and preventive control with visit of the subject of control.

2. In these Criteria the following concepts are used:

1) the subject of control - state bodies of the Republic of Kazakhstan;

2) risk - probability of damnification as a result of activities of subjects of control (or their government employees) to the rights and legitimate interests of government employees, other persons in state bodies, to interests of physical persons and legal entities, valuable interests of the state taking into account severity of its consequences;

3) system of risks assessment of the Agency and its territorial subdivisions - complex of the events held by the Agency and its territorial subdivisions for the purpose of purpose of preventive control with visit of the subject of control;
