1. Approve the enclosed Rules of recognition of the organizations providing informal education and forming of the list of the acknowledged organizations providing informal education.

2. To provide to department of the higher and postgraduate education of the Ministry of Education and Science of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;

4) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of Education and Science of the Republic of Kazakhstan Aymagambetov A. K.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of recognition of the organizations providing informal education, and forming of the list of the acknowledged organizations providing informal education

Chapter 1. General provisions

1. These rules (further - Rules) are developed according to subitem 38-4) of article 5 of the Law of the Republic of Kazakhstan of July 27, 2007 "About education" and determine procedure for recognition of the organizations providing informal education, and forming of the list of the acknowledged organizations providing informal education.

2. In these rules the following concepts are used:

1) informal education of adults – the education type performed by the organizations which provide the educational services rendered without the place, terms and form of education and is followed by issue of the document confirming results of training;

2) the list of the acknowledged organizations providing informal education (further – the List) – the list of the Kazakhstan and foreign organizations providing informal education irrespective of patterns of ownership created by authorized body in the field of education;

3) recognition of the organizations providing informal education - the procedure of confirmation of powers of the organizations rendering educational services in informal education.

Chapter 2. Procedure for recognition of the organizations providing informal education and forming of the list of the acknowledged organizations providing informal education

3. For recognition of the organizations providing informal education and forming of the List by authorized body in the field of education the Commission is created (further - the Commission).

4. The commission consists of the odd number of members which part heads of structural divisions of authorized bodies and independent experts in the field of education are.

5. From among members of the commission the commission chairman who directs activities of the commission, and in case of its absence the vice-chairman is by a majority vote elected.

Functions of the secretary of the commission are performed by the specialist of authorized body in the field of education who is not the member of the commission.

6. The decision of the commission is made by a majority vote from total number participating in commission session.

7. The decision of the commission is drawn up by the protocol in any form.

8. In case of recognition of the organization, providing informal education, correspond to the following criteria:

1) rendering educational services;

2) availability of material resources necessary for obligation fulfillment on provision of educational services;

3) availability of qualified specialists necessary for obligation fulfillment on provision of educational services.

9. For forming of the List of the organizations providing informal education, the organizations submit the following documents:

1) the statement in any form;

2) notarially attested copies of constituent documents. In case of submission of documents in foreign languages, their notarially attested transfer into the Kazakh or Russian languages;

3) notarially attested documents confirming availability own or being on other legal causes educational audiences, and also the audiences equipped with the computers connected to the Internet;

4) availability of contracts with physical persons on provision of educational services.

10. The documents submitted according to Item 9 of these rules are signed by the head of the organization or the legal representative of the organization.

11. The term of consideration of the documents submitted by the organization for recognition constitutes thirty working days from the date of adoption of documents, stipulated in Item 9 these rules.

12. By results of consideration of the documents Commission makes the decision:

about recognition of the organization and inclusion in the List;

about refusal.

13. The authorized body makes the decision on recognition of the organizations and inclusion in the List according to the protocol the commission, for a period of five years.

14. Recognition of the organization in the List proves to be true once in five years.

15. The organization for confirmation of powers in thirty calendar days prior to the expiration of recognition sends to authorized body in the field of education documents, stipulated in Item 9 these rules.

16. The decision on prolongation of term of recognition of the organization, or on refusal in prolongation of term of recognition is accepted by authorized body.
