Requirements to the agreement of the special account and procedure for use of the bank account which is available for the procurement participant as the special account

2. The agreement shall conform to requirements of the legislation of the Russian Federation and these requirements.

3. Including shall be included in the agreement:

a) the list of the transactions performed by bank on the special account, stipulated in Item 4 these requirements, terms of their implementation;

b) cases and term of the termination of blocking by bank of money of the procurement participant;

c) regulations on banking liability before the procurement participant for observance of the stipulated in Clause 44 Federal Laws of terms of the termination of blocking of its money on the special account concerning which blocking for the purpose of providing the corresponding requests according to the Federal Law is performed;

d) regulations on use of money of the procurement participant which are on the special account, for the purposes of providing requests only of this procurement participant;

e) regulations on interest payment for use of the money which is on the special account including during their blocking for the purpose of providing the corresponding request, about determination of the size of such percent;

g) consent of the procurement participant to transfer by bank to the operator of an electronic trading platform of information on opening and closing of the special account.

4. The agreement shall provide implementation of the following transactions by bank based on information obtained from the operator of an electronic trading platform:

a) blocking and the termination of blocking of money according to requirements of article 44 of the Federal Law. Such blocking consists in restriction of the rights of the procurement participant to dispose at discretion of the money which is on its special account in the amount of providing the corresponding request during the term established according to requirements of article 44 of the Federal Law;

into the account on which transactions with the means arriving to the customer are in accordance with the legislation of the Russian Federation considered;

in the relevant budget of the budget system of the Russian Federation.

5. In case of availability at the procurement participant of the bank account in bank the procurement participant and bank has the right to sign the supplementary agreement about use according to Item 3 of these requirements of the available bank account as the special account.

Requirements to terms of agreement about interaction of the operator of an electronic trading platform with bank

2. The agreement shall contain including conditions:

a) about interaction implementation electronically and about its procedure;

b) about the direction bank to the operator of an electronic trading platform of information on the procurement participant for whom such bank opens the special account, and also about closing of such account;

d) about the operator liability of the electronic platform before bank for timeliness and accuracy of the information provided by the operator of an electronic trading platform to bank for the purpose of accomplishment of requirements of the Federal Law by bank;

e) about the direction the operator of an electronic trading platform in bank according to the contract between bank and the procurement participant of the order on money transfer in the amount of the payment provided by part 4 of article 24.1 of the Federal Law in case of collection of such payment from the procurement participant.
