1. Approve Rules of conducting the automated monitoring of issues to the environment when carrying out production environmental control and the requirement to the reporting under results of production environmental control according to appendix 1 to this order.

2. Approve the List of invalid some orders of the Minister of environmental protection of the Republic of Kazakhstan and the Minister of Energy of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to committee of ecological regulation and control of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of conducting the automated monitoring of issues to the environment when carrying out production environmental control and the requirement to the reporting under results of production environmental control

Chapter 1. General provisions

1. These rules of conducting the automated monitoring of issues to the environment when carrying out production environmental control and the requirement to the reporting under results of production environmental control (further - Rules) are developed according to the subitem 30) of Article 17 and the subitem 5) of Item 1 of article 130 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 and determine procedure for establishment of the automated monitoring system of issues to the environment on pollution sources when carrying out production environmental control, conducting the automated monitoring of issues to the environment when carrying out production environmental control and the requirement to the reporting under results of production environmental control.

2. The concepts and determinations used in this Procedure are applied according to the legislation of the Republic of Kazakhstan.

Chapter 2. Procedure for establishment of the automated monitoring system of issues to the environment on pollution sources when carrying out production environmental control

3. Designing and commissioning of the automated monitoring system of issues to the environment (further - the automated monitoring system of issues) consists of the following stages:

preproject inspection of production facilities;

development of the expanded specification;

project development;

purchase and installation, connection of the analytical equipment which is part of the project;

commissioning and acceptance tests;

development of the maintenance instruction;

metrological certification (calibration);

acceptance tests;

commissioning.

4. The project of the automated monitoring system of issues is carried out by the user of nature independently or with attraction of third party.

5. The project of the automated monitoring system of issues includes:

the description of production facilities and processing equipment on which the automated monitoring system of issues is installed;

requirements to error of measurements of concentration of pollutants;

installation sites of the analytical equipment;

structure of the automated monitoring system of issues with the description of its elements;

the scheme of placement of the automated monitoring system of issues;

the software for data transmission of monitoring of issues in information system of authorized body in the field of environmental protection (further - authorized body);

types of measuring instruments taking into account conditions of production, type of processing equipment, design features, configuration, technological parameters, safety requirements, convenience of servicing.
