About establishment of priority types of activity (sectors of economy) of investment projects

For the purpose of application of the tariff privilege established by subitem 7.1.11 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130, according to articles 10 and 17   of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Establish the following priority types of activity (sectors of economy) to which the tariff privilege established by subitem 7.1.11 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130 is applied:

1) the industrial productions based on innovative technologies;

2) light industry;

3) food industry;

4) power;

5) agricultural industry, production and conversion of agricultural products;

6) assembly production;

7) tourism;

8) the production oriented to export;

9) communication networks and systems of kommutation;

10) road transport, including electrobuss, buses;

11) banking and payment activity;

12) health care (the medical equipment, including component parts and spare parts for it, and also products of medical appointment);

13) air transport (civilian passenger airliners);

14) construction.

1-1. Determine that the tariff privilege established by subitem 7.1.11 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130, is applied in case of observance of the following conditions:

1) the investment project within which implementation processing equipment, spare parts to it, the raw materials and (or) materials included in the register of investment projects is imported;

2) raw materials and (or) materials correspond to the goods included in the register of investment projects, to code of the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union, quantity, and also other data specified in the register of investment projects;

3) processing equipment, spare parts to it, raw materials and (or) materials are imported on customs area of the Kyrgyz Republic and are located under customs procedure of release for internal consumption;

4) processing equipment, component parts and spare parts to it, raw materials and (or) materials as a part of finished goods, in case of completion of customs procedures of free customs zone and free warehouse, and also when placing under customs procedure of release for internal consumption.

2. To national investments agency in case of the President of the Kyrgyz Republic:

- constitute the register of the investment projects corresponding to priority types of activity (sectors of economy) according to the criteria established by the paragraph the second subitem 7.1.11 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130, in form according to appendix to this Resolution;

- send the register of investment projects to Administration of the President of the Kyrgyz Republic, the State Customs Service under the Ministry of Finance of the Kyrgyz Republic.

3. To impose control of execution of this Resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

4. This Resolution is subject to official publication and becomes effective from the date of its signing.

Appendix

The register of the investment projects corresponding to priority types of activity (sectors of economy)

Note:

1. In column 3 details of the document according to which the investment project of state member of the Eurasian Economic Union is implemented (further - state member) are specified.

2. In columns 7 and 8 the data on goods quantity necessary for implementation of the investment project are specified.

3. In columns 9-12 data from the declarations on goods which are drawn up in case of the actual commodity importation necessary for implementation of the investment project are specified.

4. In column 9 the statistical cost of goods specified in column 46 of the declaration goods according to the Instruction about procedure for filling of the declaration on goods approved by the Decision of the Commission of the Customs union of May 20, 2010 No. 257 is specified (further - the Instruction).

5. In column 10 the net weight specified in column 38 of the declaration goods according to the Instruction is specified.

6. When filling column 12 the foreign exchange rate to state member currency established by national (central) bank of this state member on the date of registration of the declaration for goods is applied.

7. The approved register can be supplemented with new goods items during implementation of the investment project.
