About approval of the Regulations on procedure for confirmation of insurance years of service for purpose of pensions on the national pension social insurance

For the purpose of implementation of article 8 of the Law of the Kyrgyz Republic "About the national pension social insurance", according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for confirmation of insurance years of service for purpose of pensions on the national pension social insurance according to appendix.

2. Recognize invalid:

- The order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for confirmation of working life for purpose of pensions" of July 25, 1995 No. 310;

- The order of the Government of the Kyrgyz Republic "About approval of the Regulations on accounting treatment, calculations and confirmations of the insurance years of service considered in case of purpose of pensions on the national pension social insurance" of October 28, 1997 No. 635;

- the Items "z", "i" of the Order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of November 7, 1997 No. 651;

- The order of the Government of the Kyrgyz Republic "About modification and amendments in the Order of the Government of the Kyrgyz Republic of October 28, 1997 No. 635 "About approval of the Regulations on accounting treatment, calculations and confirmations of the insurance years of service considered in case of purpose of pensions on the national pension social insurance" of July 2, 2001 No. 311;

- The order of the Government of the Kyrgyz Republic "About modification and amendments in the Order of the Government of the Kyrgyz Republic of October 28, 1997 No. 635 "About approval of the Regulations on accounting treatment, calculations and confirmations of the insurance years of service considered in case of purpose of pensions on the national pension social insurance" of April 20, 2004 No. 271;

Regulations on procedure for confirmation of insurance years of service for purpose of pensions on the national pension social insurance

Chapter 1. General provisions

1. This Regulations on procedure for confirmation of insurance years of service for purpose of pensions on the national pension social insurance (further - the Provision) determine procedure for confirmation of insurance years of service for purpose of pensions by the national pension social insurance according to the Law of the Kyrgyz Republic "About the national pension social insurance".

2. The insurance years of service are the main condition for approach of the right of retirement according to the Law of the Kyrgyz Republic "About the national pension social insurance".

3. The working life before introduction of the personified accounting in case of appointment and recalculation of pensions is considered as insurance years of service.

4. The insurance years of service acquired before introduction of the personified accounting (till January 1, 1996), prove to be true according to the documents issued in accordance with the established procedure by employers or competent authorities.

5. The insurance years of service acquired after introduction of the personified accounting (since January 1, 1996), are established based on the data containing on personal insurance accounts of insured persons.

6. In insurance years of service before introduction of the personified accounting periods of time, the stipulated in Article 8 Laws of the Kyrgyz Republic "About the national pension social insurance" are also set off.

7. In the absence of documents on the available length of service before introduction of the personified accounting and impossibility of their obtaining in view of lack of contemporary records, complete liquidation of the organization or owing to their negligent custody and intentional destruction and other similar reasons not because of the worker, the insurance years of service are established according to the testimony.

8. In case documents on length of service did not remain fully or partially as a result of natural disasters, accidents, catastrophic crashes or other emergency situations, confirmation of insurance years of service before introduction of the personified accounting is performed by the special commissions on establishment of length of service created by the Cabinet of Ministers of the Kyrgyz Republic.

9. In disputable cases and in case of refusal in award of pension questions are considered by the permanent commission of Social fund of the Kyrgyz Republic (further - Social fund) according to documents for award of pension. The operating procedure of the commission specified in this Item is determined by Social fund.

Chapter 2. Procedure for confirmation of insurance years of service before introduction of the personified accounting

10. The main document confirming length of service before introduction of the personified accounting is the service record.

In the absence of the service record, and also cases when in the service record there are no necessary records or contain the wrong and inexact records about the work periods, the documents issued in accordance with the established procedure by employers or competent authorities, statements from orders, personal accounts and distribution slips of the salary, employment, civil contracts which subject is the performance of works and rendering services containing data on the work periods are accepted.
