I ORDER:

1. Approve the enclosed Methodical instructions of calculation of rates of payment for forest uses on sites of the state forest fund.

2. Declare invalid the order of the acting minister of agricultural industry of the Republic of Kazakhstan of June 12, 2009 No. 344 "About approval of Rules and Methodical instructions for calculation of rates of payment for forest uses in the state forest fund and in especially protected natural territories" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan No. 5719, is published on July 24, 2009 in the Yuridicheskaya Gazeta newspaper No. 111 (1708).

3. To provide to committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Agriculture of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this order.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These Methodical instructions of calculation of rates of payment for forest uses on sites of the state forest fund (further - Methodical instructions) are developed according to the subitem 17) of Item 1 of Article 13 of the Forest code of the Republic of Kazakhstan of July 8, 2003 and are intended for determination of calculation of rates of payment for forest uses on sites of the state forest fund.

2. Main objective of Methodical instructions is development of mechanisms of single approach to calculation of rates of payment for forest uses in all territory of the Republic of Kazakhstan.

3. In Methodical instructions the following basic concepts are used:

1) the withdrawn forest resources - the types of forest resources got or collected in the wood with subsequent their export for the purpose of consumption;

2) not withdrawn forest resources - sites of forest fund and types of useful properties of the wood which are inherent to the growing wood and physically cannot be torn away by nature the woods;

3) minor wood resources - bark, branches, stubs, roots, leaves, buds of trees and bushes;
